71R-283 " ...--- RESOLUTION NO. 71R-283 A RESOLUTION or THE CITY COUNCIL OF TIlE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1236 WHEREAS. the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from WALTER A. DIEHL, OWNER: F. EARL MELLOTT, AGENT, to establish an animal clinic on the following described property: The Southerly 66 feet of that portion of the Southeast quarter of the Northeast quarter of Section 17, Township 4 South, Range 10 West, in the Rancho Los Coyotes, in the City of Anaheim, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of . said Orange County, described as follows: Beginning at the intersection of the Easterly prolongation of the Southerly line of Lot 76 of Tract No. 2402, as shown on a map recorded in book 79, pages 37, 38 and 39, Miscellaneous Maps, records of said Orange County with the center line of Euclid Avenue, as shown on said map and running thence Southerly along said center line 166 feet to a point: thence Westerly parallel with the Southerly line of said Lot 76 to a point in the Easterly line of said Tract No. 2402: thence Northerly along said Easterly line to the Southwesterly corner of said Lot 76; thence Easterly along the Southerly line of said lot and the Easterly prolongation thereof to the point of beginning. ,........... WHEREAS, thereafter, within twenty-~o (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in 6rantin~ said conditional use permit and did thereupon fix t e ~ day of ~e , 19 7l ,as the time and the Councrrcnamber in the lty Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices .of such public hearing were duly given as required by law and the provisions of Title 18, Chapt.r 18.76 of the Anaheim Il1.nicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein aD opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful cODside- ratlon of the recommendations of the City Planning Commission and all evidence and reports offered at said hearius,.that: 1. The proposed" use is properly one for which a conditional use permit is authorized by the Anaheim MUnicip41 Code. 2. The proposed use will not adversely affect the adjoining land uses. and the growth and development of the area in which it is proposed to"be located. 3. The size and shape of the site propos~d .for the use is ~dequate to allow the full develQpment.of the proposed use in a m8nnernot-detrlmental-to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed, use. will not impose an undue burden upon the streets'and high- ways designed and improved to carry the traffic in the area. .-..-.. 5. The granting of the conditional use permit under . the conditions imposed will not be detrimental to the peace, heal. th, safety and general we.lfare of the citizens of the City of Anaheim. . NOW, THEREFORE, BE IT RESOLVED by tbe City Council of the City of Anaheim that the action 'of the ~ity Planning Com- mission g"rantina said conditional use permit be, and the same is hereby sus~a~ed , and that Conditional Use Permit .No.. 1236 be, an the same 1s hereby, granted permitting the establishment of an animal clinic on the above described property subject to the following conditions: l. That this conditional use permit is granted subject to completion of Reclassification No. 70~71-54, now pending. 2. That subject property shall be developed substanti- ally in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No. l, Revision No.1. 3. That Condition No.2, above mentioned, shall be complied with prior to final building and zoning inspections. -2- The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, success.ors or assigns to comply wi.th t.he Anaheim Municipal Code and regulations and the conditions herein.
