RESOLUTION NO. 71R-253
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2249.
WHEREAS, after a request for variance by Hub City
Construction Co., owner; James K. Schule.r & Associates, aqent
was received, a public hearing before the Planning Commission of
the city of Anaheim was held upon due and proper notice as a
result of which Variance No. 2249 was denied covering the following
described property:
Those porti.ons of Lots 1, 2 and 3 of South Pla.centia Tract
No.1, as shown on a Map recorded in Book 5, page 42 of
Miscellaneous Maps, in the office of the County Recorder of
said County, described as follows:
Beginning at a point in that certain course in Parcel 6,
of State Highway Relinquishment No. 557, recorded .in Book
8706, pages 3 .and 4 of Official Records in said office,
having a bearing and length of North 780 15.' 01' East,
323.43 feet, distant Southwesterly thereon 31.98 feet from
the Northeasterly terminus thereof; thence North 630 02'
201. West., 262. 97 feet to a t.angent curve, concave Southerly
and having a radius of 400.00 feet; thence Westerly along
said curve, through an angle of 290 55' 3511 an arc distance
of 208.92 feet to a compound curve, concave Southeasterly
and having a radius of 550.00 feet; thence Southwesterly
along last mentioned curve through an angle of 530 04' 48"
an arc distance of 509.53 feet; thence South 00 14' 05" West,
8.01 feet~ thence South 72q 50' 10.. East, 52.12 feet to the
curved portion of the general Northerly boundary of said
Parcel 6, of Highway Relinquishment No. 557, being concave
Northerly and having a radius of 4,970.00 feet; thence
Easterly along said boundary to the point of beqinninq.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a public
hearing noticed and held as prescribed by law and as a result
thereof the City Council does hereby make the following findings:
1. That there are special circums.tances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim, that said variance be granted subject. to the
following conditions:

1. That this variance is granted subject to the completion
of Reclassification No. 70-71-45, now pendinq.
2. That subject property shall be developed substantially
in accordance with plans and specifications 'on file
with the City of Anaheim, marked Exhibit Nos. 1, 2
and 3.
3. That Condition No.2, above mentioned, shall be com-
plied with prior to final building and zoning
inspections.
BE IT FURTHER RESOLVED that the city Council hereby
reserves the right to revoke such variance permit for good cause
or failure of said owner, his heirs, successors .or assigns to
comply with the Anaheim Municipal Code and regulations and the
conditions herein. Said variance is granted for the term pre-
scribed by the Anaheim Municipal Code unless otherwise specified
herein.
THE FOREGOING RESOLUTION is approved and signed by me
