Anaheim Boulevard. The meeting notice, agenda, and related materials were duly posted on April 7, 2022. MEMBERS PRESENT: Mayor Harry Sidhu and Council Members Trevor O'Neil, Jose Diaz, Gloria Ma'ae, Avelino Valencia, and Stephen Faessel. Council Member Jose F. Moreno joined the meeting during Closed Session. STAFF PRESENT: City Manager Jim Vanderpool, City Attorney Robert Fabela, and City Clerk Theresa Bass ADDITIONS/DELETIONS TO CLOSED SESSION: City Attorney Robert Fabela announced Closed Session Item No. 01 pertained to a State Housing and Community Development Department (HCD) dispute regarding the Surplus Land Act and the stadium transaction and Closed Session Item No. 02 pertained to potential litigation regarding the Covered Wagon Motel. Council Member Diaz recused himself from the discussion of Item No. 02 due to a real property interest as his 'residence is within 500 feet of the subject property. Mr. Fabela clarified Item No. 01 pertained to the HCD dispute regarding the stadium transaction, Item No. 02 pertained to the Covered Wagon Motel, Item No. 03 pertained to significant exposure to litigation related to the letter included in the agenda packet, and Item No. 04 pertained to existing litigation of Azzam v. City of Anaheim. Recognizing April 2022, as DMV, Donate Life California Month Recognizing April 2022, as National Poetry Month Supervising Librarian Joe Purtell accepted the proclamation recognizing April 2022 as National Poetry Month on behalf of the Anaheim Public Libraries. He encouraged residents to attend the library's open mic nights and introduced Anaheim Poet Laureate Wendy Van Camp who expressed her appreciation for the position and the Council's recognition. At 5:18 P.M., Mayor Sidhu called to order the Anaheim Housing Authority (in joint session with the City Council). ADDITIONS/DELETIONS TO THE AGENDAS: City Clerk Theresa Bass announced staff requested the withdrawal of Item No. 18, Right of Entry - Long Form and Right of Way Contract -State Highway for East Miraloma Way, to be brought back at a later date. Mayor Sidhu welcomed many youth in attendance at the City Council meeting, many of whom were from Acaciawood Preparatory Academy. PUBLIC COMMENTS (all agenda items, except public hearings: City Clerk Theresa Bass reported a total of three (3) public comments were received electronically prior to 1:00 P.M. related to City Council agenda items and matters within the jurisdiction of the Anaheim City Council. [A final total of 3 public comments were received electronically, distributed to the City Council, and made part of the official record]. — See Appendix. City Council Minutes of April 12, 2022 Page 3 of 26 Prior to receipt of public comments, an outline of rules for public comments and a brief decorum statement was provided by Ms. Bass. Aida Garcia called for City Council to address the needs of its residents by enacting a rent - stabilization ordinance for mobile homeowners. She also called for the construction of a multi -service center for the City's growing number of senior citizens. Mike Robbins questioned where the City has money to hire more police officers when it has to mortgage its police stations to pay its debts. He stated the Council Members are corrupt and have buried the City in debt. He called for more firefighters and reported that police officers are afraid to confront drag racing due to concerns for their safety. He advised the Angel Stadium sale could be renegotiated for a much higher price, providing funds for additional community benefits. He questioned how the City could support a larger police force for being broke. Paul Hyek stated old motels on Beach Boulevard should be renovated by the homeless for the homeless. He noted having homeless people perform the renovations and management of the motels would help the homeless find employment. He denounced Mercy House and the incompetence of its van drivers. He reported he would bring paperwork for Assembly Bill 139 by the next meeting. Cecil Jordan Corkern reported working to get April recognized as Sexual Assault Awareness Month. He reported Planning and Building Director Ted White offered to help him submit his reports to the Walt Disney Company. He requested cellular telephone numbers for the Council Members for better communications. He reported working on reports about Star Wars magazines in the past with Council Member Faessel and former Mayor Tom Tait. He pledged to go through reports of subliminal images in Disney movies with the company's security. Tamara Jimenez, Community Relations Manager for Anaheim Lighthouse Treatment Center, expressed the organization's gratitude for the recently -approved resolution stating the City's commitment to addressing the hazards of fentanyl. She also thanked Anaheim Police Chief Jorge Cisneros for his commitment. She detailed Anaheim Lighthouse's efforts to combat fentanyl addiction and thanked the City for its partnership. Julie Suchard reported the Placentia Yorba Linda Unified School District (PYLUSD) recently held a board meeting to discuss banning the use of critical race theory (CRT), and noted that the PYLUSD does not currently teach CRT and the proposal was made by extremist board members. She explained that a recap of the meeting in the OC Independent included many false statements leading to the harassment of members of a student diversity club and a cancellation of their fundraiser, while a PYLUSD Board member was noted in the article for her involvement in the January 6, 2021 insurrection at the United States Capitol. She noted the publisher of the OC Independent, Matthew Cunningham, is married to Anaheim Chamber of Commerce President Laura Cunningham. She advised the article's author, Elizabeth Matamoros, is also under contract with GC Strategies, which has a City contract for services by Cameron Wessel in support of Mayor Pro Tem O'Neil. She stated that GC Strategies is registered at the same address as Visit Anaheim but when she called Visit Anaheim, they reported not being affiliated with GC Strategies but only subletting an office. She believed that boycotts of Disneyland would lead to a vast amount of lost City revenues leading to a tremendous conflict of interest involving GC Strategies, and alleged that special interests and backroom deals were not aligning with the wishes of residents. She noted that GC Strategies had been suspended by the Franchise Tax Board in December 2021 and questioned how they were still doing business and being involved with the City. She questioned how Council Members might resolve potentially conflicting loyalties with their colleague and with Disney, which helped many of them get elected through campaign support. City Council Minutes of April 12, 2022 Page 4 of 26 Mark Richard Daniels called for the formal designation of Little Arabia. He expressed concerns about the fentanyl crisis, echoing the comments by Ms. Jimenez. He advised the closing of the Covered Wagon Motel on Beach Boulevard is a start in this direction. He called for the removal of the trash - infested motels on the agenda tonight for being havens of drug dealing. He lamented the decay of west Anaheim from his childhood. He requested the City gain access to more of Beach Boulevard from the California Department of Transportation (Caltrans). John Dunton reported the constitutional rights of Latinos are being violated by the City due to a lack of Spanish-speaking staffers. He advised it is unconstitutional to request visitors to City Hall to provide personal identification and noted he would be inquiring about this with the City Attorney. He requested more Spanish-speaking staff in the City Hall lobby. He reported residents are happy with the Police Department (APD) administration but asked they not violate constitutional rights by not having Spanish-speaking front lobby employees. He defended his sending of flowers to the funeral of the late APD officer Derek Trusk. Vance Dizney proposed having an adjustable center wall on the City's freeways to help traffic flow and advised it is a vastly larger issue than fentanyl. He explained the adjustable wall would also lessen pollution issues and he presented diagrams of the proposed wall. Donna Acevedo -Nelson reported her son was killed by the Anaheim Police Department (APD) in 2012. She reported change has happened slowly over the 10 years with many others killed by APD, including those with mental health problems. She spoke with happiness of a recent tour of the new Be Well facility, called for mental health issues to be handled less often by APD, and for increased public education about Be Well's services. Bryan Kaye reported seeing a video of City of Santa Ana Council Member Jonathan Ryan Hernandez confronting a Santa Ana police officer. He stated it was a great learning opportunity for the officer and police staff. He criticized the Council for standing by Police Chief Cisneros and the APD. He believed the Police Review Board to be a joke and denounced Board Chairman Jason Khoo and Board Vice Chair Daisy Chavez. He called for better discipline of APD officers. Mayor Sidhu addressed the youth in the audience stating there is a right to free speech but noted it was not right for them to have to hear foul language and hateful speech. Vern Nelson reported the portion of the Rancho La Paz Mobile Home Park within the City of Fullerton is patrolled by police regularly while the portion in Anaheim is unpoliced. He reported an elderly Rancho La Paz resident's golf cart was recently stolen but APD told her it no longer responds to reports of stolen property. He reported residents were able to locate the golf cart from its sale listing on a website but the listing was removed when the site's hosts became aware the property was stolen. He requested dispatchers make it clearer that officers will respond to a large theft and called for more awareness of websites selling stolen goods. He encouraged a vote against Item No. 21 that would steer more public money towards the already -rich Resort district. Krista Robles, District 3 resident, denounced the situation at John Marshall Park where homelessness leads to crime and drugs. She reported the homeless and drug abuse leave the park useless for residents. She stated the City builds parks for dogs but cannot do anything to help house the homeless and break the culture leading to homelessness. She also denounced the amount of trash accumulating on City streets. Mayor Sidhu advised the City tries its best to address homelessness and expressed his sympathies for Ms. Robles's inability to properly enjoy John Marshall Park. He asked her to City Council Minutes of April 12, 2022 Page 5 of 26 meet with Police Chief Cisneros to address her issues. He also asked if Council Member Moreno could speak with her as a District 3 resident. Mr. Fabela clarified this was not an agendized item and advised no additional discussion should occur. Council Member Moreno called for a point of order because it is regular for Council Members to speak when their names are invoked. Mayor Sidhu advised there would be no more comments from the dais. Council Member Moreno advised he was not violating the Brown Act but rather taking personal privilege to clarify comments. He requested Mr. Fabela be consistent in future applications of the Brown Act. Mayor Sidhu advised Council Member Moreno could address Ms. Robles' comments during Council Comments. Council Member Moreno reported a neighborhood meeting is being organized to discuss these issues as the area is transitioning from District 2 to District 3. Kenneth Batiste announced the City is almost $2 billion in debt. He called for walk-in homeless shelters for those ready to transition off of the streets. He stated crime is getting worse in the City and homelessness has doubled while the Council Members are focused on a select few businesses. He called for City Council to take better care of its residents instead of running the City into debt. He advised if City Council showed residents more respect there would be less cursing at them during City Council meetings. CITY MANAGER'S UPDATE: City Manager Jim Vanderpool reported the Anaheim Police Department (APD) continues to play a leading role in responding to calls for service, including those involving mental health challenges. As part of a public -private partnership, BeWellOC began training in Anaheim this week and will respond to non-violent mental health calls as referred by APD. Mr. Vanderpool noted this would better address needs by having trained clinicians respond to mental health calls. He reported APD receives over 5,500 calls annually related to mental health concerns. He noted APD would always be available for public safety and mental health calls could be diverted to BeWellOC as early as May 2022. He noted residents can continue to call APD and then the appropriate resources would be dispatched. Mr. Vanderpool noted the Housing and Community Development Department (HCD) was awarded a $27,000,000 grant on March 28 from the State Homekey Program to acquire the Studio 6 development project at Harbor Boulevard and the 91 Freeway for conversion to permanent housing for those experiencing homelessness. The funds will be used to acquire and rehab the site, with the first phase beginning in May 2022, consisting of 87 units of transitional housing, to have units in service by Thanksgiving. Mr. Vanderpool also reported HCD received a $4,000,000 award from the Californians for All Youth Work Program, which will be administered by Workforce Development staff with the purpose to increase youth employment and develop an interest in career pathways. Mr. Vanderpool announced the Public Utilities Department would host a sustainability fair on Beach Blvd. on April 16, 9:00 A.M. to 1:00 P.M. The fair will include a free EV ride and drive event for residents to test zero -emissions vehicles, drought -tolerant landscaping demonstrations, dusk to dawn lighting distributions, efficiency program information, and participation by other departments. Approve the Reimbursement Agreement with Union Pacific Railroad Company, with a reimbursement payment amount up to $65,000, for preliminary engineering services for the existing crossing on Lincoln Avenue between Loara Street and Manchester Avenue. RESOLUTION NO. 2022-032 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM declaring certain property to be "Exempt Surplus" properties pursuant to California Government Code Section 54221(b)(1) [includes determination that this action results in no binding commitment by the City to authorize or advance the disposition of any of the Exempt Surplus Properties; will not result in a direct or indirect physical change in the environment; and does not constitute an "approval" of a "project" pursuant to California Environmental Quality Act Guidelines Sections 15004 and 15352]. Authorize the Director of the Economic Development Department to issue a Notice of Availability (NOA) in accordance with the Surplus Land Act (SLA); and authorize the Director of the Economic Development Department to review each Notice of Interest received during the 60-day NOA period, if any, and enter into negotiations with responsive bidder(s) for a period of 90 days in accordance with the SLA. END OF CONSENT CALENDAR: D160 5. Authorize the Police Department to implement a hiring incentive program to attract qualified police officer candidates through June 30, 2023. Mayor Sidhu advised the item seeks to address the challenges the Anaheim Police Department (APD) faces in recruiting police officers. He noted the community wants to see more police officers for safety. Police Chief Jorge Cisneros reported on December 21, 2021 the City Council authorized APD to request federal grant dollars to facilitate the hiring of 20 additional officers. He reported police agencies nationwide are having difficulty recruiting quality candidates. He advised, that despite APD's best efforts, it has 38 vacancies for sworn officers leading staff to propose three (3) hiring incentives. He reported the three (3) proposed incentives include hiring incentives of up to $15,000, a military veteran recruitment incentive to meet the requirements of the federal grant APD received, and a referral incentive of $2,000. City Council Minutes of April 12, 2022 Page 9 of 26 Police Chief Cisneros reported APD has received over 7,500 applications for sworn officer positions since 2018 with only 92 being hired, while APD has lost 123 officers since 2018 through retirement and attrition. He advised APD expects extreme attrition of 60-80 individuals in 2024. He reported that due to training, officers hired today would not be patrolling the streets for 16 months so APD needs to prepare for 2024 at this time. DISCUSSION: Council Member Ma'ae commended Police Chief Cisneros and APD for their service to the community, expressing her gratitude. She reported recently attending patrol briefings with APD and learning just how great the challenges are faced by APD officers. She noted APD must deal with the national -level criticisms of police, amplifying its staffing issues and the stresses officers already face. She reported much of this extends to dispatchers as well. She lauded the incentive program to help remedy APD's issues and help ensure community safety. Council Member Faessel thanked Police Chief Cisneros for his work and expressed support for the incentives. Council Member Moreno commended Police Chief Cisneros and his leadership team for moving APD towards community policing and increasing its residential respect. He apologized to Police Chief Cisneros for City Council not investing enough in the City's youth, leading inevitably to more work for APD. He encouraged City Council to help APD by investing in other areas such as the Community Care Response Team (CCRT) and community housing. In response to Council Member Moreno's inquiry, Police Chief Cisneros reported APD was budgeted for 408 officers and 172 professional staffers before the pandemic. He advised APD also used the pandemic to address matters without a criminal nexus, leading to the creation of the CCRT. He advised his goal to have all sworn officers and professional staff have 100 hours of annual training. He reported APD has a goal of returning to 408 officers through its 38 current vacancies. He noted that 21 of APD's officers are still either in training or attending a police academy, reducing its current patrol numbers even more. He advised APD's budget would be coming to City Council soon for the next fiscal year. Council Member Moreno advised he would like to increase APD's budget but this means there would be less money available for Community Services, which receives only 10% of the City's expenditures as opposed to APD's 50%. He noted investing in neighborhoods reduces crime and called for a look into ways the City could raise more revenue. Council Member Diaz commended Police Chief Cisneros for thinking outside of the box with the incentives and applying for grants. He advised safety is critical to his District 1 constituents. He noted the ongoing economic redevelopment of District 1 would help reduce crime, but it would take time as opposed to the quicker route of investing in the police. He noted the City is paying the consequences of the national backlash about police officers, hurting Anaheim from recruiting officers even with great pay. He expressed support for the item. Police Chief Cisneros noted APD and Anaheim Fire and Rescue (AF&R) comprise about 55% of the City's General Fund expenditures but advised the City has more than just the General Fund paying for things. Council Member Moreno commended Police Chief Cisneros for bringing a more comprehensive approach to public safety to APD in searching for the roots of the City's ailments through crime prevention. He commended how often APD attends community events. He advised this approach City Council Minutes of April 12, 2022 Page 10 of 26 does cost a lot of money. He echoed Council Member Diaz's comments about how well APD actively searches for grants and other sources of funding. In response to Council Member Moreno's inquiries, Police Chief Cisneros clarified the 7,500 applicants yielding 92 hires are cumulative since 2018, noting there was a pandemic year when they did almost no hiring. He advised there is a significant lag between the point of hire and when officers hit the streets because of the extensive levels of training. He advised they have high standards for officers, leading to such a low hiring rate. He stated nationwide there is difficulty hiring qualified police officers, despite offering good pay and expressed his belief in the potential benefits of the proposed incentive program. He stated he did not currently have the average pay of an APD officer available but advised APD's pay structure is among Orange County's three highest. In response to Council Member Moreno's inquiry, Police Chief Cisneros stated the incentive program would best incentivize the hiring of officers who are already trained. He stated about 55% of APD's officer hires since 2018 have been lateral hires from other agencies as opposed to rookies. He stated he would like to make this number even higher, cautioning they need to be prepared for the expected heavy attrition year of 2024. In response to Council Member Moreno's inquiries, Deputy Police Chief Rick Armendariz reported APD is woefully behind on its staffing because it cannot fill its open positions fast enough, bringing APD to a hiring crisis. He reported APD has to pull detectives off of assigned cases because there are not enough officers available to cover the streets. He stated the incentives would help attract lateral hires to also move into the community. He advised entry-level incentives would hopefully attract college graduates who can use the money for college debt repayment. He advised APD is having trouble hiring despite it being a top -tier department with good pay and benefits. Council Member Moreno noted the pipelines created through Sycamore Junior High School and Anaheim High School. Deputy Chief Armendariz responded to Council Member Moreno's earlier inquiry by stating an APD officer entry-level trainee makes $72,633 a year as a starting salary while lateral officer hires make between $78,000 and $126,000. He advised of the 92 hires made by APD since 2018, 51 have been laterals. He expressed hopes the incentives would help encourage officers to make lateral moves to Anaheim even if they would be further down the pecking order to start in APD's likely larger but better department than wherever they are coming from. Council Member Moreno noted these salaries make the officers eligible for affordable housing in Anaheim. Council Member Ma'ae noted these officers are not even making six -figure salaries while putting their lives on the line daily and also being community servants and positive influences to the City's youth in addition to their public safety roles. She encouraged the public to report criminal activity. He reported the bill would increase transportation services available for Orange County. City Council Minutes of April 12, 2022 Page 12 of 26 Assistant City Manager Greg Garcia advised SB 1196 would expand the definition of a State Transit Assistance (STA) Program eligible operator to include the ATN. He noted the ATN helps connect residents to jobs, particularly in the hospitality industry, but is not currently eligible for STA funding. He noted ATN's bylaws would have to be revised to increase transparency and accountability, along with allowing its Board of Directors to be appointed by the City Council. Council Member Moreno expressed appreciation for Mayor Sidhu agendizing the item as supporting the concept of the bill, noting it is a young bill and may be further amended. In response to Council Member Moreno's inquiries, Mr. Garcia clarified that ATN is eligible to receive other State funds but not STA funding. He advised the ATN also receives federal funds. Council Member Moreno noted there are often concerns when public funds are used by private agencies like subsidies. He advised he would support the item because the bill would only include ATN if it becomes publicly accountable. He advised the Orange County Transportation Authority (OCTA) has struggled with micro -transit in Anaheim. He noted that reduced State parking requirements in high -density neighborhoods would create a service opportunity for the ATN in these communities. In response to Council Member Moreno's inquiry, Mr. Garcia reported there have been many discussions about a possible cap of about $900,000 on the ATN's potential STA funding level. He advised the intent of both the ATN and Senator Umberg is to cap the available funds so as not to divert too much money from OCTA. RESOLUTION NO. 2022-035 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM approving Development Project No. 2022-00007 and modifying Conditional Use Permit No. 2237, and making certain findings in connection therewith (DEV2022-00007) (837 South Beach Boulevard). Mayor Sidhu clarified that Public Hearing Item Nos. 22 and 23 are separate but related appeals of Planning Commission decisions regarding Beach Boulevard motels. He noted the issues of human trafficking, drugs, and other crimes along Beach Boulevard are well-known and the City hopes to redevelop the area. Planning and Building Director Ted White reported this item is an appeal of the Planning Commission's February 28, 2022 decision to approve the modification of the Conditional Use Permit (CUP) for the Anaheim Lodge Motel. He advised the item is related to the City's larger Rebuild Beach efforts to help eliminate crime from the motels along the corridor. Mr. White reported City staff and the Anaheim Police Department (APD) identified two poorly managed motels, the Anaheim Lodge and the Travel Inn, operating with limited conditions of approval that would benefit from greater oversight. He reported the Anaheim Lodge has been operating since 1984 and was selected as a priority site in the Rebuild Beach effort due to its poor property maintenance and a significant amount of criminal activity. He reported the Planning Commission approved, 6-0, to modify the CUP to add security and operational -related conditions of approval. He advised the property owner's attorney requested an appeal. He reported the high calls for APD service at the property, noting from 2017 to 2021 the Anaheim Lodge accounted for 18% of all arrests occurring at Beach Boulevard motels. He advised there are also extensive code enforcement issues City Council Minutes of April 12, 2022 Page 14 of 26 on the property and the Anaheim Fire & Rescue Department (AF&R) is also frequently called to the property. Mr. White listed the permissible reasons for a CUP's revocation or modification and advised staff believes the motel has been operating in a manner detrimental to public health and safety and constitutes a nuisance. He advised this is a de novo appeal hearing, opening the entire scope of the CUP and conditions for modification for consideration. Mr. White shared the Planning Commission's recommended conditions of approval for the CUP, including an annual APD review of the Safety and Operations Plan, having 24-hour on -site management, and daily cleaning service. He advised staff has modified some of the Planning Commission's conditions only for the sake of clarity while maintaining the Commission's intent. Mr. White reported the appeal is based upon APD having entered and searched the property unlawfully, a violation of the owner's First Amendment rights, a lack of due process on the City's intent to close the motel, an unfair hearing before the Planning Commission, and a lack of evidence that the motel is violating the law or creating a public nuisance. He reported staff has found all claims to be meritless. Mr. White reported staff received a letter from an adjacent property owner about the inadequacy of the Anaheim Lodge's surrounding walls and fence dating back to the motel's initial approval in 1981. He advised the City Attorney stated in 2016 that the 1981 conditions were unenforceable. He reported the property owner has requested additional conditions of approval to help alleviate the intrusion of motel guests into their backyard, including an eight -foot masonry wall on the west side, a six-foot wall on the south property line, and a requirement for the existing chain link fence to remain locked. He clarified the Planning Commission did not include these conditions but noted the City Council could add these conditions because this is a de novo hearing. Mr. White advised that staff recommends upholding the Planning Commission's unanimous decision and deny the appeal. No Council Members disclosed any ex parte communications. Mayor Sidhu opened the public hearing. Frank A. Weiser, attorney for the applicant, advised that City Council is adjudicating the CUP, which is protected by due process, and City Council must follow due process in modifying or revoking a CUP. He detailed a Fourth Amendment challenge he litigated against the City of Montclair about a code enforcement action where evidence was taken. He explained the ruling, upheld by the Ninth Circuit Court of Appeals, clarified that public areas of the motel are not subject to Fourth Amendment protections while the private areas are subject to those protections. He advised he has yet to see any police reports against the property so the appellant does not have any ability under due process to properly contest the City's claims of crime issues at the motel. He reported the City is violating the Fourth Amendment by not providing evidence of any crime at the property. Mr. Weiser denounced the City for singling out a couple of motels out of an entire crime -ridden area. Mr. Weiser reported his clients are not opposed to voluntarily working with the City to abate any claimed nuisance activity. He advised his clients have voluntarily hired a reputable security service, posted rules for guests about following laws, and require vehicle registration. City Council Minutes of April 12, 2022 Page 15 of 26 Mr. Weiser advised the way for the City to clear out the motels for redevelopment is to buy them out and not revoke their CUPS. He stated his clients want to cooperate with the City but there has not been any attempt at remediation such as what happens in the City of Los Angeles. He advised the rules the appellant has agreed to should not be imposed in a CUP format. He expressed concerns the Anaheim Lodge could be forced to suffer the same fate as the recently -closed Covered Wagon Motel. Mr. Weiser provided a copy of the new security services agreement for the Anaheim Lodge and advised it also applies to the Travel Inn for Item No. 23. He detailed many court cases upholding the core Fourth Amendment rights possessed by hotels and their guests. He requested City Council support their appeal. He suggested a compromise where City Council could opt for a trial period in consideration of the applicant's recent enhanced security efforts. He cautioned litigating a new CUP would be costly for the City. In response to Mr. Weiser's inquiry, Mayor Sidhu advised the new security service could address City Council as a public commenter and not as part of the applicant's allotted time. City Clerk Theresa Bass reported that a total of four (4) electronic comments were received electronically prior to 7:00 P.M. related to Public Hearing Item No. 22. [A final total of four (4) public comments were received electronically, distributed to the City Council, and made part of the official record]. — See Appendix. In response to Council Member Moreno's inquiries, City Attorney Robert Fabela clarified the process for whether or not the security contractor could speak in the appellant's window is unclear in the City's procedural rules. He advised if another member of the appellant's team wants to speak and needs more time than allocated, the Mayor can make the decision so long as due process is respected. He clarified the appellant can combine multiple speakers within their allotted 20 minutes. He confirmed that City Council could extend the appellant's time if deemed necessary. Emilio Pensado reported his company specializes in motel fences and security and now patrols the Anaheim Lodge and Travel Inn nightly. He advised his company has not found anything constituting a nuisance. He reported the fencing does not currently look like what is shown in staff's picture. He advised his company reports and deters any suspicious individuals coming to the motel off the street. He noted the Anaheim Lodge and Travel Inn are good motels and do not need much security work in both his professional and personal opinions. In response to Mayor Sidhu's inquiries, Mr. Pensado confirmed he is the owner of the third -party security company and confirmed his guards are armed. He explained many of his guards are military veterans and most have 4-8 years of experience in a security guard role. He reported his company is 12 years old and many of the guards have worked there for 5-8 years. In response to Mayor Sidhu's inquiries, Mr. Pensado advised his company employs 45-48 guards to cover 63 hotels, 48 motels, and 28 apartment buildings. He clarified the guards each have a patrol route like a police officer and cover multiple hotels in a shift. He confirmed there is not a guard in each hotel 24 hours a day. He explained a guard will pass by the Anaheim Lodge every 2-3 hours and also assist managers when they call with an issue. He advised there have been no calls for service from either the Anaheim Lodge or Travel Inn in 3-4 months of monitoring. He confirmed there have been no incidents at either motel over this span. He expressed shock at the high number of calls made to APD from 2017 to 2021 and noted he sees no proof of illegal activity. He advised his company will refer an incident to the local police about 15 times a month at the worst properties they City Council Minutes of April 12, 2022 Page 16 of 26 manage. He confirmed the company keeps a daily activity report and the reports say everything is fine at the two motels. He confirmed the activity reports would be available to APD if requested. Mahendar Ahir, Anaheim Lodge owner, advised he would follow the APD's and City's directions but felt the CUP conditions are not fair because their property would be treated differently than its peers. He advised they are doing everything they can to keep the property safe and that the CUP changes are unnecessary. He confirmed all of the City's advice has been implemented since the motel was identified as a public hazard. Kathy Tran expressed support for the Planning Commission's action and requested three (3) additional conditions of approval relative to the property line fencing and walls. She noted for 12 years now she has been proposing these barriers to prevent trespassing through her yard and vandalism to her property. She called on the City to take a more aggressive approach to revive Beach Boulevard and improve public safety for the motel's neighbors. She advised the motels need to clean themselves up and respect their neighbors. In response to Mayor Sidhu's inquiries, Ms. Tran confirmed within the past three (3) months the motel has finally locked the chain link fence. She acknowledged the illegal activity has disappeared for the moment while the City has its thumb on the property. She reported the same thing happened with the previous owner of the motel for a while which is why the conditions need to be in the CUP. She advised the last three (3) months have been quiet at the motel because they know they are being watched. Paul Hyek reported he has experiences with motels during his homeless years and followed motel regulations regarding age restrictions, valid identification, and not using drugs. He noted the rooms could be cleaned more often and the owner could require vehicles to be registered. He noted the motels need to be cleaned up. Lisa Klawe expressed support for adding the conditions of approval to the CUP and Ms. Tran's call for enhanced barriers. She noted she does not live close enough to speak to the Anaheim Lodge specifically, but advised she sees no changes in Beach Boulevard's general situation when she drives down it. She advised the police cameras seem to be helping somewhat. She said Anaheim Lodge is not a good place and she would not stop there. She called for enforcement of the conditions to help the motel attract better clientele. David Klawe agreed with Mrs. Klawe's comments. He advised residents and neighbors should be able to expect basic maintenance of the motel, adherence to safety rules, and cooperation with the APD. He noted residents do not want a four -star motel but a basic, clean, 2-3 star motel free of criminal activity. He encouraged City Council to read the more extensive public comments from neighbors at the Planning Commission's hearing. Tamara Jimenez reported she is on the board of a foundation performing outreach at the Anaheim Lodge including the distribution of the opioid overdose drug Naloxone (NARCAN). She reported the Anaheim Lodge is the foundation's highest user of NARCAN with large weekly deliveries. She reported her foundation performs outreach to all of the Beach Boulevard motels and the Anaheim Lodge is the worst for drug traffic. She advised the Anaheim Lodge also has prostitution and underage sex trafficking. She reported her foundation supports revoking the CUP. In response to Mayor Sidhu's inquiries, Ms. Jimenez advised they have received the same volume of calls from the Anaheim Lodge over the past three (3) months and advised they are delivering an City Council Minutes of April 12, 2022 Page 17 of 26 increasing amount of NARCAN. She advised fentanyl activity is increasing at the motel and APD is not lying about its statistics. She stated it is the worst motel her foundation visits. Robert Mirshafiee reported a targeted CUP modification is unfair to any business. He advised all of the motels should have to follow the same rules and advised many of the operational conditions go beyond what a city is responsible for. He advised that having a minimum age requirement for room rental of 21 instead of 18 is age discrimination. He noted many neighboring residents have observed improvements over the past few months and he recommended residents share the costs of the wall. Frank A. Weiser, attorney for the applicant, reported the United States Constitution is for everybody and to protect against the tyranny of the majority and passions of the public. He advised there is a need for actual documented evidence and not hearsay. He reported the appellant has not received any evidence of malfeasance at the motel and anything the City has was obtained in violation of the Fourth Amendment. He explained City Council is an adjudicating body bound by the Constitution. Mr. Weiser advised motels are often singled out for a city's social ills and are not the cause of the social ills. He explained many motel owners like his clients are hard-working people trying to make a living. He advised this is not the right way to handle clients like his who are trying to work with the City and noted how much better the City of Los Angeles handles due process matters. Mr. Weiser reported opioids are a big social concern but there is no documented evidence of it at the motel. He noted the equal protection and selective enforcement issues mentioned by Mr. Mirshafiee. He noted the motel owner is working with the City and fears they will all be back in a year for an unconstitutional hearing to revoke the CUP. He reported the City is trying to close the motels like the Covered Wagon. He called for support of the appeal or a continuance so they could receive the evidence against the motel, particularly since the hiring of private security. He noted the courts would rule on their side and see the lack of due process. Mayor Sidhu closed the public hearing. DISCUSSION: In response to Mayor Sidhu's inquiries, Mr. Fabela confirmed the City did not violate any of the legal issues raised as part of the basis for the appeal. He advised he feels strongly about the process and evidence presented and confirmed they did not violate any First Amendment rights He confirmed the due process was followed including notice. He confirmed APD did not enter the motel unlawfully and advised this is not the basis of any presented evidence. In response to Mayor Sidhu's inquiries, APD Sergeant Brian Paqua confirmed APD received 16 calls for service from the motel so far in April after receiving 90 calls in March and 25 in February. He reported narcotics have been the most common source of the calls. He confirmed APD has not received any prostitution -related calls in March or April. He advised a call for an overdose would be filed in the narcotics category and could also go to the AF&R instead of APD. In response to Mayor Sidhu's inquiry, Mr. White created a visual diagram of where the higher walls requested by Ms. Tran would be. In response to Mayor Sidhu's inquiries, Sergeant Paqua confirmed suspects have often in the past taken advantage of the low fences as a means of escaping APD on foot and he has personally climbed over the fence in pursuit of suspects. He advised that APD, in anticipation, would put units on each side of the motel when responding to a call because of the very high frequency of suspects escaping over the low fences. He advised suspects jumping over the north and south fences is routine and, although rarer, suspects do jump the fence by Ms. Tran's house. City Council Minutes of April 12, 2022 Page 18 of 26 In response to Mayor Pro Tern O'Neil's inquiries, Sergeant Paqua confirmed there have been 152 calls for service to the Anaheim Lodge thus far in 2022. He commended the high -quality work of the contracted security company but noted they cannot be on site 24 hours a day. He applauded the motel owners for hiring a very good security company but theorized criminals could anticipate when their checks occur. He confirmed the contracted security company is the type that will occasionally drive by and check in as opposed to being on -site around the clock. In response to Mayor Pro Tern O'Neil's inquiry, Mr. White advised if the Planning Commission's conditions of approval are upheld, the City Council could in the future remove the additional conditions if the motel has improved itself. He advised the action could be initiated by the owner, City staff, or City Council. In response to Mayor Pro Tern O'Neil's inquiry, Mr. Weiser confirmed the owners already have a Security and Operations Plan, 24-hour on -site manager, daily cleaning service, a prohibition on room rentals under 12 hours, and regular maintenance. He advised the age minimum of 21 to rent a room has legal impediments because State law allows hotel room rentals at 18. He clarified his objection is not to having conditions to meet but rather having them included in the CUP because of the power it allows a government to revoke the CUP. He advised there should instead be a preparatory compliance window to see if the conditions can be achieved by the property owner on its own and without the conditions being part of a CUP. In response to Mayor Pro Tern O'Neil's inquiry, Mr. Weiser questioned how he is supposed to know APD calls of service are real without seeing documentation. He advised it is a violation of due process to not have credible documented police reports available. He clarified City Council in this scenario is not a legislative body but an adjudicating body ruling on property rights. In response to Mayor Pro Tern O'Neil's inquiry, Deputy City Attorney Leonie Mulvihill confirmed documentation of the calls for service were provided to Mr. Weiser and mailed on March 23, 2022. She advised the calls for service were also reflected in the staff reports for both the Planning Commission and City Council public hearings. She advised the City Attorney's office respects due process and noted appropriate meeting notices were issued, documentation was provided, and the appellant has been allowed to be heard. Mr. Weiser advised none of the underlying evidence was put into the record and this contention would be worked out in court. He explained the government has the burden of providing proof. In response to Council Member Moreno's inquiry, Ms. Mulvihill confirmed the calls for service were shared with the applicant. She clarified staff is recommending the conditions be modified due to the existence of a nuisance on -site as evidenced by the photographs and the high number of calls for service. She advised the existence of a nuisance has been established by the staff reports, APD testimony, and calls for service provided to the appellant. Council Member Moreno clarified what he heard from the appellant tonight is the due process violation accusation is because they do not view the volume of calls, maintenance, and other issues as being a public nuisance. In response to Council Member Moreno's inquiry, Ms. Mulvihill confirmed there have been multiple conversations between City representatives and the motel owners documenting the condition of the property, its classification as a nuisance, and demands to correct the problems. City Council Minutes of April 12, 2022 Page 19 of 26 In response to Council Member Moreno's inquiries, Ms. Mulvihill confirmed the City has a right to require a CUP for a motel. She advised the motel currently has a CUP and clarified every CUP is specific to its property and is treated individually. She noted this is why there are separate items for the two properties being discussed tonight because they are making findings specific to each property. In response to Council Member Moreno's inquiry, Ms. Mulvihill clarified the goals of this exercise are to gain compliance with the Anaheim Municipal Code and the abatement of a known nuisance. Council Member Moreno advised he does not recall any Council Member stating they want to close motels on Beach Boulevard but rather only commenting on their desire to clean the motels up. He clarified his goal is to rebuild Beach Boulevard with no types of businesses being targeted to be pushed out of the area. He clarified closing all of the motels is often said in public comments but it is not City Council's goal. In response to Council Member Faessel's inquiries, Mr. Fabela confirmed due process was given and the City did not violate the 14th Amendment. He confirmed the Fourth Amendment is not applicable in this case and he has looked at the cases cited by Mr. Weiser. Council Member Faessel advised APD observed things in public areas visible to anyone. He noted Ms. Mulvihill stated police reports were provided to Mr. Weiser. Ms. Mulvihill clarified the City provided calls for service by APD and not police reports because the volume of calls is the basis of the nuisance finding. She advised nothing would preclude Mr. Weiser from requesting arrest reports as they are public records. She clarified in the presentation to both the Planning Commission and City Council it was the high number of calls for service, draining of police resources, and issues found by APD once on -site, leading to the nuisance finding and not any specific arrest reports. In response to Council Member Faessel's inquiries, Ms. Mulvihill confirmed no evidence was collected without consent. She advised Mr. Weiser acknowledged public areas do not trigger Fourth Amendment concerns. She explained due process requires the City to send notice before acting on a CUP along with an opportunity to be heard. She advised both of these criteria have been met. In response to Council Member Faessel's inquiry, Mr. White clarified there are conditions applied to every CUP by definition. In response to Council Member Faessel's inquiry, Ms. Mulvihill clarified when conditions are being drafted, the City Attorney reviews them to ensure constitutional rights are honored. She advised these operational conditions are reasonably related to the City's legitimate interest in abating a nuisance. In response to Council Member Faessel's inquiry, Mr. Fabela confirmed the City Council is a quasi- judicial body in this hearing and is free to vote however it sees fit. Council Member Faessel reported he read all 71 pages of public comments provided by the City Clerk's Office. He noted one of the comments listed 45 calls of concern the neighbor made to the property. He advised the comments do not reflect the business being a good neighbor and the neighbors make it clear that for their welfare, better walls are needed. He agreed the request for improved walls is a reasonable addition to the list of conditions and would like to see the request included in the hearing's findings. DISCUSSION: Council Member Valencia clarified he stepped away from the meeting briefly when City Council was making ex parte communication declarations. He reported meeting with Ms. Tran yesterday. Council Member Ma'ae agreed with Council Member Faessel's comments. Mayor Sidhu stated that the APD and the City Attorney have done their jobs properly. He agreed that the motel is a nuisance needing to be controlled. He advised it has been a documented nuisance for many years and this is the right thing to do for public safety. In response to Mayor Pro Tern O'Neil's inquiry, Mayor Sidhu confirmed they are voting to uphold the Planning Commission's decision, with the inclusion of Ms. Tran's recommended wall improvements, and to deny the appeal. In response to Mayor Sidhu's inquiry, Mr. White clarified Ms. Tran's request is to construct an eight - foot masonry wall on the west property line replacing the existing wooden fence. He clarified from an engineering standpoint this would need to be a new wall and not extend the height of the existing wall. He advised the request would also be to increase the existing wall to six (6) feet in height along the near south property line and to have the existing chain link fence locked at all times. In response to Mr. Fabela's inquiry, Council Members Faessel and Ma'ae both stated they were satisfied with Mr. White's clarification. Planning and Building Director Ted White reported the item is an appeal of the Planning Commission's February 28, 2022 decision to modify the Conditional Use Permit (CUP) for the Travel Inn. He advised, as with Public Hearing Item No. 22, the item is to help improve the quality of life along Beach Boulevard. He reported the property's CUP was approved with only one condition of approval and no operational, maintenance, or security conditions. He explained the property was selected as a priority site in the Rebuild Beach efforts due to its poor property maintenance and significant criminal activity harmful to public health and safety. He reported the Planning Commission voted unanimously to add conditions of approval to the CUP relating to operations and security and that decision has been appealed by the property owner. Mr. White advised the Travel Inn had the third -highest calls for service to the Anaheim Police Department (APD) out of the 18 motels on Beach Boulevard, with 259 in 2021. He reported between 2017 and 2021, the Travel Inn accounted for 12% of all APD arrests at Beach Boulevard motels, including arrests for illegal gambling, assault, battery, illegal drugs, firearms, and carjacking. He noted on December 28, 2021, APD broke up an illegal gambling ring, known as a slap house, in a Travel Inn room. He advised Code Enforcement notes a lack of adequate property maintenance among other issues, including a lack of pest control. He reported, that since 2019, Anaheim Fire and Rescue (AF&R) has responded to 42 calls for service for medical emergencies at the Travel Inn with a trend increasing dramatically annually over this span. Mr. White reported the findings reflect a need for additional conditions for CUP approval for being detrimental to public health and safety. He noted the Planning Commission advised identical conditions of approval to those in Public Hearing Item No. 22 except for the termination of an old entitlement on the property. He advised the basis for the appeal is identical to the basis of the appeal City Council Minutes of April 12, 2022 Page 22 of 26 in Public Hearing Item No. 22 and staff recommends upholding the Planning Commission's decision by denying the appeal. No Council Members disclosed any ex parte communications. Mayor Sidhu opened the public hearing. Frank A. Weiser, attorney for the appellant, reported he is making the same constitutional objections for this item as he did for the appeal in Public Hearing Item No. 22. Mr. Weiser advised in the hearing for Public Hearing Item No. 22, the City Attorney confirmed he did not receive the actual police reports. He disputed the receipt of the underlying documentary evidence about calls for service and reported he also did not receive the police reports for this item. He questioned whether or not he has to make a public record request or if the City is duty-bound to provide the reports. He noted the City of Fresno produced redacted police reports for him when recently hearing a similar situation there about a motel being deemed a public nuisance. He advised the City of Fresno also provided better documentation around the calls of service than Anaheim provided. He restated his earlier assessment that the City has not met its burden for due process and this would be settled in court. Mr. Weiser reported the current owner bought the Travel Inn in April 2021 and does not have a track record with the City. He advised the owner has invested money to upgrade the property and has voluntarily implemented the same conditions as at the Anaheim Lodge, including contracting the same security service. He noted he objects to the age restriction of 21 years due to laws making hotel room rental legal at 18 years of age. He advised the security service would be willing to address the City Council again but noted they would present the same evidence as in Public Hearing Item No. 22. Mr. Weiser clarified it is generally true the public areas of a motel are not subject to Fourth Amendment protection but advised there is a provision where if the government comes too frequently it could be legally considered a search. He explained the missing documentation about the details of APD visits to the property is critical to determining Fourth Amendment violations. Mr. Weiser requested City Council provide them with the police reports and better documentation of the calls for service. He encouraged City Council to continue the hearing until they could offer a better rebuttal based on the evidence. He requested the conditions not be imposed in the form of a CUP. City Clerk Theresa Bass announced there were no public comments submitted electronically regarding Public Hearing Item No. 23. Tracy Urueta reported she lives close to the motels and attended the Planning Commission's hearing about the Covered Wagon. She advised the Covered Wagon's owners similarly claimed its new ownership led to the appearance of negligence but advised this should not be an excuse. She reported the Planning Commission's conditions for the Covered Wagon were fair and should be the standard operating procedure for all Beach Boulevard motels due to the rising crime rate and the nature of those crimes. She commended APD for its efforts and for installing the security cameras. She explained the proposed CUP modifications are needed to help the corridor. She advised these motel -driven issues are not new and residents are tired of them. Jodie Mosley thanked City Council for its commitment to Beach Boulevard. She advised, as a long- time area resident, the motels have been a nuisance since the day they opened. She noted the situation speaks for itself and safety measures are not too much to ask for. She encouraged City City Council Minutes of April 12, 2022 Page 23 of 26 Council to listen to Sergeant Paqua because he knows the neighborhood well. She advised anyone who would object to these safety -driven modifications says a lot about them not being a legitimate business. She encouraged City Council to continue its recent successes in west Anaheim. Paul Hyek advised he has the same comments as in Public Hearing Item No. 22 about cleaning up the Beach Boulevard motels and relayed his negative experiences with the motels. He advised the security at the motels should be handled by Securitas Security Services USA. Tamara Jimenez reported her foundation also does outreach to the Travel Inn and it is comparably bad to the Anaheim Lodge. She advised the Travel Inn also receives weekly NARCAN deliveries from her foundation. She reported her larger concern with the Travel Inn is the manager accepts sexual intercourse as payment for rooms and advised it is often with underage people. She emotionally advised how difficult it is to get the youth out of this entrapping situation. Robert Mirshafiee advised his comments from Public Hearing Item No. 22 also apply here. He reported the high number of calls for service is not a nuisance because APD exists to help residents who need it. He advised it is wrong to say the volume of calls to help people is a burden on the City and noted none of the conditions would eliminate the underlying problems. He denounced APD for not being more specific than saying 35 of the March 2022 calls for service to the Anaheim Lodge were merely for narcotics. He advised there has been no dependable and credible evidence presented to substantiate any of staff's claims. He explained the City's actions only benefit the City itself and do not consider others. Mr. Weiser refuted Ms. Jimenez's comments by stating the manager at the Travel Inn is female and not male. He advised this allegation cuts to the fundamental issue he has with the hearing being based only on hearsay evidence. Mayor Sidhu closed the public hearing. Council Member Moreno expressed concern over the past few years over the conditions and neglect in west Anaheim. He explained the City is the public and he is looking at the City's benefit here. He advised if a business becomes a nuisance to public health and safety, it warrants specific attention. He advised the modifications would better secure the community's health and improve it under Rebuild Beach. He noted APD is understaffed and has to keep going to the same places repeatedly. In response to Council Member Moreno's inquiry, Police Sergeant Brian Paqua confirmed four (4) motels along Beach Boulevard create 68% of the calls for service. Council Member Moreno echoed Ms. Mosley's question of how this keeps happening over multiple decades. He stated these actions are finally happening because west Anaheim has two (2) votes on the City Council due to district elections after it went 22 years without a west Anaheim resident. He commended west Anaheim residents for making their voices heard and making the City more responsive to them. He advised the conditions are not unreasonable to help make the businesses a healthier place for everyone, including the motels' employees. Mayor Pro Tern O'Neil clarified that Public Hearing Item Nos. 22 and 23 are separate and the facts should not be combined but advised the issues between the two (2) motels do not appear to be substantially different, including the high volume of calls for service. In response to Mayor Pro Tern O'Neil's inquiry, Mr. White confirmed there is nothing substantially different between the two (2) cases. He advised the conditions of approval have been taken from City Council Minutes of April 12, 2022 Page 24 of 26 other motels in the City based upon best practices in Anaheim and from other cities. He advised many of the conditions proposed here came from the effective expansion of the Center City Motel. In response to Mayor Pro Tem O'Neil's inquiries, Sergeant Paqua confirmed the calls for service in 2022 for the Travel Inn are continuing to increase, similar to the Anaheim Lodge situation. He advised the call numbers are slightly less than the Anaheim Lodge. He noted the rate of calls for the Travel Inn in 2022 has almost tripled from 2021. DISCUSSION: Mayor Sidhu advised this was long overdue. He echoed Council Member Moreno's inquiry and stated the solution to Beach Boulevard takes leadership and vision. He agreed district elections have made a difference because Council Members Diaz and Ma'ae live in west Anaheim and see these problems daily. He advised he saw the same issues first-hand when campaigning in west Anaheim in 2018. He expressed concern that APD is forced to work overtime to keep the area peaceful. He noted that new motels have even tougher conditions for approval not being pushed onto the Travel Inn and Anaheim Lodge. Mayor Sidhu advised the City could have been harder on businesses the past few years but was not as to not impose more on them during the pandemic, but advised the pandemic is waning and it is time to improve public safety. Council Member Moreno recalled the 2010 documentary "The Motel Kids of Orange County" and asked what happens to these motel families who need protection from nefarious elements. He noted Mayor Sidhu was a Council Member in this timeframe and should give credit to several other people instead of taking sole credit for leadership on the matter. He credited former Council Member Denise Barnes for starting to push resources in west Anaheim's direction. He clarified Mayor Sidhu does deserve credit but encouraged him not to discredit others who deserve it when he did not take advantage of his opportunities to help west Anaheim in 2010. He encouraged Mayor Sidhu to walk the streets of west Anaheim again. Council Member Ma'ae reported she had contacted current Budget, Information, and Technology (BIT) Commissioner Leonard Lahtinen to request his resignation, as he is not a resident of District 2. She felt strongly about specific District 2 representation, has interested residents, and requested an agenda item at the next Council meeting to consider the removal of Mr. Lahtinen from the BIT Commission to replace him with a District 2 representative, concurred by Mayor Pro Tern O'Neil and Council Member Faessel. Council Member Faessel stated he concurred with the request for purpose of discussion when agendized. Council Member Ma'ae recognized the Servite High School soccer team for winning the CIF Southern California D1 championship for the first time in school history on March 5, 2022, and requested a proclamation and future Council recognition for the team, concurred by Mayor Pro Tern O'Neil and Council Member Faessel. She highlighted a community meeting on March 23 at the shopping center at Brookhurst Street and Ball Road, held in conjunction with Council Member Diaz and the Anaheim Police Department, to address street racing, share information with residents about what is being done to keep the community safe and how they could partner together. She thanked the community for a great turnout as well as Sgt. Paqua and Carmela Mendoza for helping to organize the event and sharing information. She also reported a March 31 event to beautify John Marshall Park, in partnership with UPS, Love Anaheim, and the Community Services Department. She thanked Brightview for providing plants and wood chips and reported the volunteers planted new plants, two trees, added wood chips, spread mulch, and did some touch-up painting. She thanked UPS employees from around the world for coming to help serve Anaheim at the park and the Second Harvest Food Bank. She wished everyone a Happy Easter. Council Member Moreno acknowledged the efforts of former Mayor Tait, Council Member Faessel, and himself for initiating the Beach Boulevard Specific Plan approved in November 2018 and recognized the current Council for continuing to implement the plan along with the staff. He reported a flashlight walk on April 6 in the Rose/BushNine neighborhood and thanked the neighborhood leader Maritza Bermudez, the Central Community Policing Team, and Rocio Burress for organizing the event, building stronger relationships and listening to resident concerns about not enough parking, pet feces on the street, homelessness, crime, disruptive residents at night, and difficulty knowing how to access City services. He announced the return of Greenbird Anaheim on April 30 at 10:00 A.M. to perform a neighborhood cleanup, starting at the Rosewood Barber Cafe on Broadway behind the Muzeo. He expressed condolences to the family of Guillermina Mayorga who passed away on April 2 of kidney failure at the age of 45. He noted her sons played local sports, she attended St. Boniface Catholic Church, and the family needs financial assistance. He also offered condolences to the families of three 24-year-old young men, Fernando Gutierrez, Juan Hernandez, and Pedro Zamora Rodriguez, who lost their lives in a high-speed crash at La Palma Avenue and Harbor Blvd. Council Member Moreno noted street racing is a common theme across the city, has become a public safety issue as well as a quality of life issue, he hoped the Council as a whole could address the issue with collaborative efforts with staff to find meaningful solutions and promising practices and hoped the topic would find its way to an agenda for discussion. He also noted communicating with School Board President Al Jabbar to collaborate on educating young people about the dangers of street racing. Mayor Sidhu announced he had asked Council Members Diaz and Faessel to join him on the Mayor's Anaheim First Ad Hoc Committee to guide as we move forward with the important neighborhood improvement initiative and comprehensive citywide investment program. A City- initiated request that the City Council consider the revocation or modification of Conditional Use Permit No. 2237 for an existing motel (Anaheim Lodge). The reasons are because there has been a dramatic increase in arrests and called for service at the Anaheim Lodge in recent years. Per Staff reported stated at Planning Commission meeting on Feb 28, 2022: Of the 18 motels on the boulevard, the Anaheim Lodge has the second highest calls for services in 2021; arrests at the property jumped 473% between 2020 and 2021. Police statistics show that between 2017 and 2021 the Anaheim Lodge accounts for 18% all arrests occurring at Beach Blvd motels. Criminal activities include assault, battery, drug use, firearms possession, and a homicide that occurred in April 2020. On June 4, and September 3, 2021, the Anaheim Police Department Gang Unit served several drug sales warrants in various room at the Anaheim Lodge. Recently, Code Enforcement records include complaints related to the lack of property maintenance, including broken windows, landscaping, general trash, and debris. City of Anaheim Fire and Rescue personnel generally respond to fires and medical emergencies and since 2019, Anaheim Fire and Rescue has responded to 35 calls for service for various medical emergencies. The number of calls in 2020 and 2021 more than doubled from previous years. Specifically, there are calls related to drug overdoses and poisoning, seizures, mental emotional or psychological issues, unconscious or unresponsive individual, cardiac arrest and even the fatal shooting in 2020.” Our neighborhood, primarily on South Hayward Street, adjacent behind the motes, is directly affected by this and other issues with having the many motels behind our backyards. Since this meeting is open to the public and to our opinions and suggestions, it is an excellent opportunity to make requests to ensure our property, family and neighborhood safety is protected from this day forward. The City of Anaheim has a list of 21 items or “conditions” that the ANAHEIM LODGE MOTEL must meet for approval to continue the permit of a motel. This list of 21 Conditions is attached for you to review. I have suggested in detail 3 more conditions. A. We moved to our home in late 1990 and we have had no problem until 2007. At that time, we started noticing people from theother sideofthe wall onthe Anaheim Lodge Motel side looking over into our living and bedrooms and also trespassing into our backyard by climbing over the wall. We reached out to the known owner of the motel, Mr. Yang Zhang. B. Our house was broken into 2 times in 2007. Our neighbors to the north and south of us also were broken into for 2-3 times in 2008. After many times asking and begging the new owner of Anaheim Lodge Motel to keep the chain link fence between their parking lot and the landscaped buffer area next to the wall locked toprevent people entering the area and jumping over 4.5feet height wall. Ultimately totrytoprevent people trespassing to our back yard, but to no avail. Ithen decided to try and get help from City of Anaheim. Ibrought my complaint about trespassing, invasion of privacy and safety issues to the City of Anaheim initially back in 2010. DETAILS OF WALL: 1. The block wall is only 4.5 feet height on the Anaheim Lodge Motel side; therefore, almost anyone can just climb or jump over, or anyone can just look over into my backyard and look into our living and bedrooms. 2. In2010, Staff from City ofAnaheim Code Enforcement suggested “atest trial “to allow the motel owner to build 6 feet wood fence to see ifthat would help prevent people trespassing to my property and provide some privacy. The staff also promised if the trespassing continues, the City will request the motel toerect a 6 feet masonry block wall to meet compliance of the Condition Use Permit No. 6 of the Resolution No. PC 81-200 of the Anaheim Lodge Motel. 3. *Please remember, the wood fence was a test trial, not permanent solution, therefore it was not added or amended to CUP 2237. No permit, nor any inspection from City staff has been done in regards to how the wood fence has been constructed. After this “test trial of 3 years to Oct 17, 2013”, Ireached out to Sandra Sagert (Code Enforcement) and asked for help again because people continued trespassing to our back yard. She said “The City is proceeding with revocation of the CUP for the Anaheim Lodge Motel and we are reviewing all ofthe documents on file for the property including the one you mentioned in your email. Will keep you posted and appreciate your patience (emailed Oct 29, 2013).” 11/20/2013, Sandra Sagert sent email and stated: “the City isactually moving forward with filling acriminal complaint against the property owner instead oftherevocation process. As explained below, due tothe existing circumstances, it has been decided not to enforce a strict interpretation of the CUP’sblock wall height requirement.” City staffs recognized and agreed the height of the wall was not met to condition of Resolution No. PC 81-200, but decided not to enforce? How can this legally occur? A City - initiated request that the City Council consider the revocation or modification of Conditional Use Permit No. 2237 for an existing motel (Anaheim Lodge). The reasons are because there has been a dramatic increase in arrests and called for service at the Anaheim Lodge in recent years. Per Staff reported stated at Planning Commission meeting on Feb 28, 2022: Of the 18 motels on the boulevard, the Anaheim Lodge has the second highest calls for services in 2021; arrests at the property jumped 473% between 2020 and 2021. Police statistics show that between 2017 and 2021 the Anaheim Lodge accounts for 18% all arrests occurring at Beach Blvd motels. Criminal activities include assault, battery, drug use, firearms possession, and a homicide that occurred in April 2020. On June 4, and September 3, 2021, the Anaheim Police Department Gang Unit served several drug sales warrants in various room at the Anaheim Lodge. Recently, Code Enforcement records include complaints related to the lack of property maintenance, including broken windows, landscaping, general trash, and debris. City of Anaheim Fire and Rescue personnel generally respond to fires and medical emergencies and since 2019, Anaheim Fire and Rescue has responded to 35 calls for service for various medical emergencies. The number of calls in 2020 and 2021 more than doubled from previous years. Specifically, there are calls related to drug overdoses and poisoning, seizures, mental emotional or psychological issues, unconscious or unresponsive individual, cardiac arrest and even the fatal shooting in 2020." Our neighborhood, primarily on South Hayward Street, adjacent behind the motes, is directly affected by this and other issues with having the many motels behind our backyards. Since this meeting is open to the public and to our opinions and suggestions, it is an excellent opportunity to make requests to ensure our property, family and neighborhood safety is protected from this day forward. We reached out to the known owner of the motel, Mr. Yang Zhang. B. Our house was broken into 2 times in 2007.Our neighbors to the north and south of us also were broken into for 2-3 times in 2008. After many times asking and begging the new owner of Anaheim Lodge Motel to keep the chain link fence between their parking lot and the landscaped buffer area next to the wall locked to prevent people entering the area and jumping over 4.5 feet height wall. Ultimately to try to prevent people trespassing to our back yard, but to no avail. I then decided to try and get help from City of Anaheim. I brought my complaint about trespassing, invasion of privacy and safety issues to the City of Anaheim initially back in 2010. DETAILS OF WALL: 1. The block wall is only 4.5 feet height on the Anaheim Lodge Motel side; therefore, almost anyone can just climb or jump over, or anyone can just look over into my backyard and look into our living and bedrooms. 2. Will keep you posted and appreciate your patience (emailed Oct 29, 2013)." 11/20/2013, Sandra Sagert sent email and stated: "the City is actually moving forward with filling a criminal complaint against the property owner instead of the revocation process. By filing a criminal complaint, we can seek penalties and probation to ensure the property does not fail back out of Code compliance. I will keep you posted on our process." 02/9/2014, Sandra sent email and stated:" Our code enforcement case has been turned over to the City Attorney's Office for criminal complaint filing. It will be reviewed by the city attorney and they will notify the property owners if they are moving forward with filing. As soon as we know, 1 can provide another update but our process has been completed." 05/23/2014. i had meeting with Sandra Sagert and Mark Dickinson at City Hall. I shared pictures and Resolution No. PC 81-200 of the Anaheim Lodge Motel. 07/25/2014, The Anaheim Lodge changed to new owner, Mr, Mahendra Ahir. 08/5/2014, Mark Dickinson sent an email stating:" The City Attorney's Office stated they did not receive enough evidence from the PD to file a nuisance suit. I do believe the motel has sold. As to matter with the wall, Code Officer Happle researched the back wall a couple of year ago and had the building department verity that the current wall was built as required under the original construction." I continued to work with City staffs and kept reminding them of the assurance given to me that they had promised and ensured that the new owner must comply with the Condition No. fi in the Resolution No. PC 81-200. 08/20/2014, Mark Dickinson sent an email stating: "The Building Official has made the determination that the Anaheim Lodge Motel property and its wall were built to the specifications outlined in the original plans. In addition, the criminal cases were closed due to the change in ownership and the fact that the violations were corrected. If you disagree with the Building Officials determination of the wall, then that matter must be taken up with their department. Oscar Davalos is the building inspector because he conducted the original on -site inspection." 08/30/2014, 1 had a meeting with planner Mr. White and Mr. Cl of Planning Department, raising my concerns regarding the noncompliance item No. 5 in Resolution No. PC 81-200 and provided pictures. Mr. White said that he will look into it. 10/1/2014, 1 reached out to Mr. Heinrich (Building Department) for help. He assigned Mr. Gino Jimenez to help me. 10/20/2014, Sandra Sagert Sent an email and stated: "Both Code and Building have inspected the location and do not see Code Violation. Building indicated the wall was built to Code. I am sorry but there is nothing else we can enforce on this property." The City Staff decided not to enforce the condition of the block wall height requirement; which we are left with the need to continue to deal with these problems. 08/18/2015, 1 had meeting with Mayor Tait, Planning director (David BeImer), Code enforcement (Sandra Sagert) and Deputy City Attorney (Mark Facer) at the City Hall regarding the same trespassing, safety, and privacy issues and noncompliance item No. 6 in the Resolution No. PC 81-200. 08/30/2015, 1 reached out and sent an email to Mr. Mahendra Ahir, the owner of Anaheim Lodge Motel, to address the trespassing issues and notified him of one of the conditions of Resolution was not updated to Code. 09/17/2015, Mr. Ahir emailed and stated that they "will stay in compliance with all Codes." 10/14/2015, 1 had meeting with Code Officer Oscar Chavez at my property. 01/21/2016, Officer Oscar sent email and stated: "We found no violation, except far the height of the wall. As explained below, due to the existing circumstances, it has been decided not to enforce a strict interpretation of the CUP'S block wall height requirement." "City staffs recognized and agreed the height of the wall was not met to condition of Resolution No. PC 81-200, but decided not to enforce? How can this legally occur? We caught him in our patio and chased him away. **10/23/2020 9:00 am Same guy trespassed from Anaheim Lodge to my adjacent neighbor, stole some goods and used in my private walkway in my front yard to escape.
