RESOLUTION NO. 668.-61
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 1152 .
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
STATER BROS. MARKETS, owner
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follo~:
The North 300 feet of Lot A in Tract No. 25 as shown on
a Map recorded in Book 9, page 28 of Miscellaneous Maps,
records of Orange County, California, measured from the
center line of the street 40 feet in width adjoining said
Lot on the North.
EXCEPT the West 200 feet of the North 200 feet thereof,
measured from the center lines of the streets adjoining
said Lot on the North and on the West.
ALSO EXCEPT the East 55 feet thereof.
AND WHEREAS, the City Planning Commission did hold a
public hear~~g.~t.~~e Ci~.Hall in the City ot Anaheim on .
December 20 , 1965, notice of which said public hearing
was duly given as requirea-by law and the provislon,_of Title' 1B,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, atter due
inspection, investigation. and studies made b,y itselt and in its
behalf, and after due consideration of all evidence. and reports
arfered.at said h~a~i~g,.d~~ ~d~p~.R~so~u~lon ~o. 1881 , Series
19 65-66 , denvina Variance No. 1152 . ; and
WHEREAS, theraft.er, within twenty-two :~22:L,days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council of the City of Anaheim protesting
the action ot the City Planning Commission denYi~ said.
variance, and said appeal was set for public hear ng.on
January 25" , 1966. , at 7:00 o'clock P.M. .at.the City
Hall in the City ot AnihiTm, and notice of such,public hearing
was duly given as required b,y law and the provisions of Title 18,
Chapter 18.76 ot the Anahe im Mun ic i pa 1 Code; and .' .
WHEREAS, aiter ~ue investigation and S~Y4~8S made by
itself and in its beha1f,.and after'due considet=...atioJ}. of all the
evidence and reports offered at said hearing, t~e, City Council
does find and determine .that:
1. There is no substantial property righ~_pos.e8sed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequa te ly deve loped and used under., UUJ present'
zone. .
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the ,.actlon or the City Planning Commission

denying Variance No. 1752, be, and the same is, hereby
disapproved, and that the petition for a zoning variance
permitting a waiver of the maximum height limitation of a
free-standing sign within 300 feet of a residential structure
(Section 18.62.090 (b-2)), on the property hereinbefore de-
scribed, be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by
25th day of January, 1966.
