A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FOR EXCEPTION TO THE 180-DAY WAIT
PERIOD IN COMPLIANCE WITH GOVERNMENT CODES
7522.56 AND 21224
WHEREAS, in compliance with Government Code Section 7522.56, the City
Council of the City of Anaheim must provide Ca1PERS this certification resolution when hiring a
retiree before 180 days have passed since his or her retirement date; and
WHEREAS, Robert Gomes retired from the City of Anaheim in the position of
Park Services Superintendent, effective July 7, 2023; and
WHEREAS, Section 7522.56 requires that post -retirement employment commence
no earlier than 180-days after the retirement date, without this certification resolution; and
WHEREAS, Section 7522.56 provides that this exception to the 180-day wait
period shall not apply if the retiree accepts any retirement -related incentive; and
WHEREAS, the City Council of the City of Anaheim and the City of Anaheim
Human Resources Department have not and will not provide any retirement -related incentive; and
WHEREAS, the City Council of the City of Anaheim hereby appoints Robert
Gomes as an extra help retired annuitant to perform the duties of the Part-time Park Services
Superintendent -Extra Help for the City of Anaheim under Government Code Section 21224,
effective September 29, 2023; and
WHEREAS, no matters, issues, terms or conditions related to this employment
exist and the appointment has been or will be placed on an off consent calendar; and
WHEREAS, the employment shall be limited to 960 hours per fiscal year for all
CalPERS employers; and
WHEREAS, the maximum base salary for this position is $11,421 per month, the
hourly equivalent is $65.89, and the minimum base salary for this position is $7,614, the hourly
equivalent is $43.93; and
WHEREAS, the hourly rate paid to Robert Gomes will be $64.14; and
WHEREAS, Robert Gomes has not and will not receive any other benefit,
incentive, or compensation in addition to this hourly pay rate; and
THEREFORE, BE IT RESOLVED THAT the City Council of the City of Anaheim
hereby certifies the nature of the appointment of Robert Gomes as described herein and that this
appointment is necessary to fill the critically needed position of Part-time Park Services
Superintendent -Extra Help for the City of Anaheim by September 29, 2023
