0917ORDINANCE NO. 917 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING ARTICLE III OF THE ANAHEIM MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTER AND SECTION THERE- UNDER, ESTABLISHING THE PEUCEDURE FOR THE HANDLING AND DISPOSITION OF UNCLAIMED PROPERTY IN THE POSSESSION OF THE POLICE DEPARTMENT, WHEREAS, certain articles of property having been lost, abandoned or stolen and in the possession of the Police Department, remaining unclaimed over a period of time, it becomes necessary to prescribe a method or methods of dis- posing of such property from time to time; NOW, THEREFOEE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Article III of the Anaheim Municipal Code be, and the same is hereby, amended by the addition thereto of a new chapter to be numbered Chapter 14. and a new section thereunder to be numbered Section 3500, reading as follows: "CHAPTER 4. -- LOST AND FOUIM. "SECTION 3500. DISPOSITION OF UNCLAIMED PROPERTY. "All unclaimed property in the possession of the Police Department shall be handled and disposed of in the following manner: "(a) Such property shall be held by the Police Department for a period of at least six (6) months. '1(b) Thereafter, if not reclaimed as herein pro- vided, such unclaimed property shall be sold at public auction to the highest bidder; provided, however, that in the event said property cannot be sold at public auction, it may be given away to any fraternal, benevolent, patriotic, chari- table or religious organization not organized for profit; but if any such property is of no value and cannot otherwise be disposed of by gift or sale, it may be destroyed as junk. "(c) Notice of such sale at public auction shall be given by the Chief of Police at least five (5) days before the time fixed therefor, by publica- tion in a newspaper of general circulation published in the County, specifying the time and place where such public sale will be held and generally describing the property to be sold at said public auction. 't(d) In the event the owner of any such property shall appear on or before the date fixed for the -1- sale thereof at public auction and reclaim said property and reimburse the City for all expenses incurred in the care and preser- vation of the property, then said property shall be restored to the owner." SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and tairty (30) days from and after its final passage it shall take effect and be in full force.
