0908ORDINANCE NO. 9o8 Aid OI DINANCE OF THE CITY OF ANNAHEIM AMEND- ING ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE BY ADDING THERETO CERTAIN NEW SECTIONS TO BE KNOWN AND DESIGNATED AS SECTIONS 9200.22, 9200.23 AND 9200.24, ESTABLISHING CERTAIN REGULATIONS GOVERNING THE ERECTION, CONSTRUCTION AND ALTERATION OF CERTAIN BUILDINGS, STRUCTURES AND IM- PROVETIENTS, Ai0 CERTAIN USES OF LAND; ESTABLISHING MINIMUM FLOOR AREAS OF BUILD- INGS AND STRUCTURES IN CERTAIN AREAS OF THE CITY; AND PRESCRIBING PENALTIES FOR THE VIOLATION OF AlvY OF THE PROVISIONS THEREOF. ',JHEREAS, the City Council finds that the regulations and provisions hereinafter set forth in this Ordinance are necessary for and are designed to lessen congestion in the streets; to secure safety from fire and other dangers; to pre- vent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of distribu- tion of water, sewage, parks and other public requirements; and that such provisions and regulations have been made with reasonable consideration, among; other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving property values and encourag- in the most appropriate use of land throughout the area, and in consideration of the direction of planning development according to a well considered plan; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Article IX, Chapter 2 of the Anaheim Municipal Code be, and the same is hereby, amended by the addition of new sections thereto to be known and designated as Sections 9200.22, 9200.23 and 9200.24, reading as follows: "Section 9200.22. No person, firm, corporation or association shall hereafter, within the following de- scribed area: Between the south line of West Wilhelmina Street and the north line of West Sycamore Street, the east line of North Citron Street, and the west line of North Palm Street, in the City of Anaheim, erect, construct or locate more than one single family dwelling and its accessory buildings upon any one lot or building site in the above mentioned area, nor erect, construct or locate any dwelling on any lot thereon with a minimum ground floor space of less thamseventeen. hundred ( 1,7oo ) square feet, and in computing the area, garage space shall not be included therein. "Section 9200.23. No person, firm, corporation or associa- tion shall hereafter, within the following described area: Between the south line of West North Street, the north line of Westmont Drive, the east line of North Loara Street, and the west line of North West Street, in the City of Anaheim, -1- "erect, construct or locate more than one single family dwelling and its accessory buildings upon any one lot or building site in the above mentioned area, nor erect, construct or locate any dwelling on any lot tber•eon with a minimum p-;round floor space of less than seventeen hundred (1,70o ) square feet, and in computing the area, garage space shall not be included therein. "Section 9200.24. (a) Before commencing any work pertaining to the erec- tion, construction, reconstruction, moving, conversion, alteration or addition to any building or structure within said district, a permit for each. separate build- ing and/or structure shall be secured from the Building Inspector of said City of Anaheim by the owner or his agent for said work, and it shall be unlawful to com- mence said work until and unless said permit shall have been obtained. No permit shall be issued by the Build- ing Inspector• for the erection or construction of any dwelling house within the areas mentioned in Sections 9200.22 and 9200.23 which shall contain less than the minimum square feet of floor space therein provided. Any buildings erected, constructed, altered or to which additions are made, shall comply with all of the pro- visions of the City Building. Code of the City of Anaheim. "(b) The City Council hereby reserves the right and power to grant variance permits for non -conforming uses in said areas mentioned and described in the two pre- ceding sections where unusual circumstances justify the issuance thereof and to avoid hardship and unfair- ness. Applications for variances shall be made to the City Planning Cormmission and granted or denied in ac- cordance with the provisions of Sections9200.15 and 9200.17 of this Code. "(c) Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating any of the provisions of Sections 9200.22, 9200.23 and 9200.24 of the Anaheim Municipal Code shall be guilty of a misdemeanor and u on conviction thereof shall be punished as provided in Section 1200 of this Code. Such person, firm or corporation shall be deemed guilty of a separate offense for each and every day during any portion of which any violation of t,)ese provisions is committed, continued or permitted by such person, firm or corporation, and shall be punishable as herein pro- vided." SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed and published once in the Anaheim Bulletin, a newspaper of general circula- tion., printed, published and circulated in the said. City of Anaheim, within fifteen (15) days after the passage thereof, and thirty (30) days after its final passage and adoption it shall take effect and be in full force.
