A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA-
HEI~ ACCEPTING A SEALED PROPOSAL AND AWARDING A CON-
TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE
FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS
AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL
WORK NECESSARY TO CONSTRUCT AND, COMPLETE THE FOLLOW-
ING PUBLIC IMPROVEMENT: CONSTRUCTION OF A STORM

WHEREAS, the City Council of the City of Anaheim did cause t.o
be published in a newspaper of general circulation, printed, published
and circulated in the City of Anaheim, to wit: The Anaheim Gazette
on the 27th day of November and the JI th da~ nf nec:emh~r 1 q59
a notice inviting sealed proposals for furnishing the following:
All plant, labor. services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and complete
in a good and wor'1uTlanlike manner, in strict accordance with the
spF,~ifications, plans and drawings therefor on file in the office
)1' the City Engineer or City Clerk of the City of Anaheim, the
following publiC improvement, to wit: Construction of a storm
dratn in Lemon Street, from Oak Street to Broadway, in the City
of Anaheim, including the installation of 12 to 30-inch reinforced
concrete pipp. 2 manholes, construction of 5 catch basins, 1
juncti.on box, excavation, h,'3U 1 away , backfili, resurfacing and
appurtenant work, as indicatea on the plans, Job No. 487;
in accordance with the design, plans, profiles and specifications of
said public improvement on file in the office of the City Clerk of the
City of Anaheim; and
'WHEREAd, said notice inviting sealed proposals for said public
improvement did provide that sealed proposals would be received by the
City of Anaheim at the office of the City Clerk of the City of Anaheim
up to the hour of 2:00 o'clock P.M. on the 10th day of December
19....2.2., for the furnishing of all plant, labor, services, materials,
and equipment, all utilities and transportation, including power, fuel
and water, and performing all work necessary to construct and complet.e
in a good and workmanlike manner, the public improvement hereinabove
more partiCularly mentioned and described, and which notice did state
and declare that pursuant to the provisions of Section 1770 of the
Labor Code, the City Counpil of the City of Anaheim bad ascertained
the prevailing rate of wages in the locality in which this type of
labor is to be performed for each craft or type of workman or mechanic
needed to execute the contract and did set forth the prevailing hourly
wage scale so ascertained; and
WHEREAS, the City Clerk of the City of Anaheim did receive
the following sealed proposals prior to .? nn 0 I clock P.M. on the

AND WHEREA8, the City Engineer did thereupon examine and tabu-
late said sealed proposals and did report to the Citv Council the re-
sult of his examination and tabulation; and
wHEREAS, the City Council finds that the sealed proposal .sub-

is the lowest responsible proposal su.bmi tt.ed for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, including power, fuel and water and performing all work
necessary to construct and complete in a good and workmanlike manner,
in strict accordance with the specifications, plans and drawings there-
for on file in the office of the City Clerk of the City of Anaheim,
the public improvement hereinabove mentioned and described, together
with the appurtenances thereto, and as specified in the rotice inviting
sealed proposals, and that said proposal of said above named bidder
should be accepted and a contract awarded to said bidder in accordance
therewith; and
WHEREAS, the City Council finds that the above mentioned sealed
proposal is the lowest responsible proposal received and that the per-
stln, firm or corporation submitting said proposal is a responsible
person, firm or corporation and that the proposal submitted is the
best sUlted and fitted for the public improvement to be constructed.
NOW, 'r.IEREFORE, BE IT R8S0LVED by the City Council of the City

the City of Anaheim and the notice inviting sealed proposals, the pub-

described, together with tLe appurtenances thereto, be, and the same

pletion of said public improvement be, and the same is hereby, awarded
to the said above named bidder.
AND BB IT F1JRTHBl1 RE80LVED that the successful bidder or bidders
:Ipon each contract awarded as herein:l'oove set forth, shall be, and they
are hereby required to execute a contract in the required form with the
City of Anaheim upon the terms and conditions specified in the notice
inviting sealed proposals and the proposal submitted by said success-
ful bidder or bidders and in accordance with the plans and specifica-
tions for said public improvement hereinabove described, and in accord-

ance on th the terms, condl tlons and provi.sions of this resolution,
and that said successful bldder or bldders to whom each contract is
'lwarded shall be requlred to furnlsh a surety bond in an amount equal
to one hundred per cent (100%) of the contract price for all br)Qr,
materials and equipment to be furnished and performed, as set forth
in the sealed proposal submHted by said bidder for the c.onstruction
of '~,ild public improvement, together with the appurtenances there.t.o
or such portion thereof as is covered by said contract, as Bercuri ty
for the faithful performance of said contract and a separate surety
bond In an amount equal to one hundred per cent (100%) of the con-
struction cost of sald publlC improvement covered by said contract,

AND BE IT FURTHER. RESOLVED that said successful bidder or
hldders be, a:ld they are hereby required to furnish to the City of
Anahelmin companies satisfactory to the City of Anaheim,. public. lia-
bility, property damage, compensation, and other insurance. in the
amounts and for the purposes as set forth and specified in the notice
inviting sealed proposals, and subject to the approval of the City
Attorney as to form and sufflciency.
AND BE IT FURTHER RESOLVED that the Mayor and the. City Clerk
of the Cl ty of Anaheim be, and they are hereby. authorize.d. and
dlrected to make, execute and enter into, for and on behalf of the.
C1 ty of AnaheIill. a wrItten contract with said succ.essful bidder .or
bidders for the furnIshing of all plant, labor, mterials, and equip-
ment and perfornnng all work, as hereinabove more particularly des-
cribed, for the constructIon, installation and completion of said
publIC lmprovement hereinabove described upon the terms and conditlons
as speclfied ln the notice InvitIng sealed proposals, the detailed
deSIgn, plans, proflle,;, drawings and general specifications and de-
talled speclflcatlons and drawings, and all addenda thereto, and all
modlflcaUons incorporated therein prior to the date of the. opening
of bIds, on flle m the offIce of the City Clerk of the Ci tyof Ana-
heim and jn strict accordance WIth the terms, conditi.ons and provisions
