RESOLUTION NO. 66R-l20
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXECUTION
OF AN AGREEMENT t-lITH SOUTHERN PACIFIC
COMPANY PROVIDING FOR THE IMPROVEMENT, AND
DEDICATION TO THE CITY OF ANAHEIM, OF CER-
TAIN STREETS KNOWN AS VERNON STREET AND
WINSTON ROAD: AND RESCINDING RESOLUTIONS
NUMBERED 65R-293 and 65R-305.
WHEREAS, Southern Pacific Company is the owner of
certain land in the City of Anaheim, which property includes
Winston Road and Vernon Street; and
WHEREAS, the City Council of the City of Anaheim does
determine that it is in the interest of the City to have such
streets dedicated for public use; and
WHEREAS, it is in the interest of the Southern Pacific
Company and the City of Anaheim that said streets be improved
in such a manner to facilitate the movement of traffic within
the area; and
WHEREAS, Southern Pacific Company desires to dedicate
said streets to the City in order to accomplish the foregoing;
and
WHEREAS, the City and Southern Pacific Company wish to
enter into an agreement providing for the improvement and dedi-
cation of said streets.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City enter into an agreement with
Southern Pacific Company providing for the improvement, and
dedication to the City of Anaheim, of Vernon Street and Winston
Road, upon the following terms and conditions:
1. Southern Pacific Company shall grade and improve
two roadways known as Vernon Street and Winston
Road as they presently extend north of Cerritos
Avenue and west of State College Boulevard,
respectively, to that location wherein said road-
ways presently intersect with one another, and as
described on the plans and specifications presently
on file in the Office of the City Engineer. Such
improvements shall include asphalt paving, con-
sisting of three inches of asphaltic concrete over
a three inch aggregate base, and the installation
of curbs, gutters, driveways, sewers, and drainage
facilities according to plans Nos. 6569! 6570,
6571, 6572, 6572-A and 6572-B, on file 1n the
Office of the City Engineer.
2. Southern Pacific Company shall also improve the
roadways at the intersections of Vernon Street
with Cerritos Avenue and Winston Road with State
College Boulevard with four inches of asphaltic
concrete over weed killer and three inches of
asphaltic concrete over an eight-inch ag$regate
base, according to the.p1ans identified 1n
paragraph 1. hereof.

3. Upon completion of the improvements described
above Southern Pacific Company shall dedicate to
the CitI said approved roadways. for public road
and uti ity purposes, excepting and reserving
however to Southern Pacific Company, its successors
and assigns, the right to construct, reconstruct,
maintain and use one drill track and one spur track
over, across and along said roadways in locations
to be agreed upon by the parties to said agreement;
PROVIDED, HOWEVER, that Southern Pacific Company
shall agree to .obtain from the City a franchise for
use of the public streets for said tracks. City
shall accept the dedication by Southern Pacific
Company of said improved roadways for publiC road
and utility purposes. City shall at the time of
such dedication, pay to Southern Pacific Company
an amount equal to the cost of that portion of
said impro~ments consisting of the installation of
the asphalt concrete paving and base of the roadways.
Southern Pacific Company shall agree that the City
shall have the right of review of such costs of
improvements, and that the awarding of the contract
for such improvements shall be wi.th the consent of
the City.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute such agree.nt for
and on behalf of the City of Anaheim. .
BE IT FURTHER RESOLVED that Resolutions Nos. 6SR-293
and 6SR-30S be, and the same are hereby rescinded.
THE FOREGOING RESOUJTION is approved and signed by me
