1968-775WHEREAS, the Southern Pacific Company, a corporation,
has tendered to the City of Anaheim an agreement permitting the
City of Anaheim to construct, maintain and use a pedestrian
walkway across the tracks and upon property of Southern Pacific
Company at MP 23.9 at or near Anaheim, County of Orange, State
of California, in the location as shown in yellow upon the print
of said Company's Los Angeles Division Drawing A7321, sheet No. 1,
dated September 8, 1967 attached to and made a part of said
agreement; and
WHEREAS, said agreement has this day been submitted to
the City Council of the City of Anaheim for its consideration,
and the City Council does find and determine that it would be for
the benefit and best interest of the City of Anaheim to enter into
said agreement with the Southern Pacific Company, and that the same
should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this day submitted to the
City Council to be executed by the Southern Pacific Company and
the City of Anaheim permitting the City of Anaheim, subject to the
covenants and agreements therein contained, to construct, maintain
and use a pedestrian walkway across the tracks and upon property
of Southern Pacific Company at MP 23.9 at or near Anaheim, County
of Orange, State of California, in the location as shown in yellow
upon the print of said Company's Los Angeles Division Drawing
A7321, sheet No. 1, dated September 8, 1967, attached to and made
a part of said agreement, be, and the same is hereby, approved and
accepted.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said agree-
ment for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is signed and approved by me
