1968-767A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DETERMINING THE NECESSITY
FOR, AND DIRECTING THE ACQUISITION, BY
EMINENT DOMAIN, OF REAL PROPERTY FOR
SANITARY SEWER PURPOSES.
WHEREAS, public convenience and necessity require
the acquisition of certain real property within the City of
Anaheim for the following purposes to wit: Sanitary sewer
purposes; and
WHEREAS, the City Council does find and determine
that public interest and necessity require the acquisition
of all that real property herein described by the City of
Anaheim for sanitary sewer easement purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that public interest and necessity
require the acquisition of the following described real property
to wit:
All that certain real property situated in
the City of Anaheim, County of Orange,
State of California, described as follows:
PARCEL ONE:
PARCEL TWO:
RESOLUTION NO. 68R -767
(Permanent Easement) An easement for the installation
and maintenance of a sanitary sewer line under and
across that portion of the fractional East half of
Section 7, Township 4 South, Range 9 West, S.B.B. M.,
in the City of Anaheim, County of Orange, State of
California, described as follows:
Beginning at the Northwest corner of Lot 19, Tract
No. 4321, as shown on a Map recorded in Book 197,
pages 9 through 12, inclusive, of Miscellaneous Maps,
records of said County; thence North 89° 51' 10" East,
along the northerly boundary of said tract, and its
easterly prolongation, 413.72 feet to a point in the
Southwesterly line of the Golden State Tract, as shown
on a Map recorded in Book 4, pages 66 and 67 of said
Miscellaneous Maps; thence along said Southwesterly
line, North 61° 26' 43" West, 52.05 feet to a point
hereinafter referred to as "Point A thence South
0 08' 50" East, 15 feet; thence South 89° 51' 10"
West, 373.08 feet; thence South 0° 08' 50" East, 10
feet; thence North 89° 51' 10" East, 5.02 feet to the
point of beginning.
(Temporary Easement) A temporary construction easement
over and across that portion of the fractional East
half of Section 7, Township 4 South, Range 9 West,
S.B.B. M., in the City of Anaheim, County of Orange,
State of California, described as follows:
Beginning at "Point A" hereinabove described in Parcel
One; thence South 89° 51' 10" West, 383.08 feet; thence
South 0° 08' 50" East, 25 feet; thence North 89° 51' 10"
East, 10 feet; thence North 0° 08' 50" West 10 feet;
thence North 89° 51' 10" East, 373.08 feet; thence North
0° 08' 50" West, 15 feet to the point of beginning.
BE IT FURTHER RESOLVED that the City Council find,
and it does hereby find and determine that public interest and
necessity require the acquisition of said property by the City
of Anaheim for the aforesaid purposes, and that the taking of
the property hereinabove described is necessary therefor, and
that the uses to which it is to be put are uses authorized by
law, and the taking of said property is necessary to such uses.
AND, BE IT FURTHER RESOLVED that the City Council
does hereby authorize the acquisition of said property by the
City of Anaheim, and the City Attorney of the City of Anaheim
is hereby directed to institute an action in eminent domain
for the acquisition of the title to said property, and to
perform and carry out all of the necessary proceedings and
steps incident to the acquisition of the title to said property
and to obtaining immediate possession thereof.
THE FOREGOING RESOLUTION is approved and signed by me
this 17th day of December, 1968.
