1968-758RESOLUTION NO. 68R -758 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 1069. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a conditional use permit from Albert S. Toussau, 6672 Richfield Road, Anaheim, California, to establish a 166 -unit planned residential development, on the property hereinafter described, with waivers of the following Anaheim Municipal Code limitations or requirements: (a) Maximum building height (Section 18.28.050[5 -b]); (b) Minimum distances between buildings (Section 18.28.050 [7]) (c) Maximum distance from every living unit from a standard street (Section 18.28.050[9 -b]); and (d) Location of accessory buildings abutting side property lines (Section 18.28.050[6 -c]). Said property is situated in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows: The South 11.6 acres of the West 21.6 acres of the South- west quarter of the Southeast quarter of Section 13, Town- ship 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, Cali- fornia. EXCEPTING THEREFROM that portion thereof described as follows: Beginning at a point on the South line of said Section 13, said point being distant Easterly 677.7 feet from the South quarter section corner of said Section; thence North parallel to the North and South quarter section line of said section to the North line of the South 11.6 acres of the West 21.6 acres of the Southwest quarter of the Southeast quarter of said Section 13; thence East along said North line 26.35 feet, more or less, to the Northeast corner of the South 11.6 acres of the said West 21.6 acre parcel, thence South along the East line of said West 21.6 acre parcel to the Southeast corner thereof; thence West 26.35 feet, more or less, to the point of beginning. ALSO EXCEPT THEREFROM the Northerly 9.00 feet thereof. ALSO EXCEPTING THEREFROM the Southerly 205.00 feet, measured at right angles, from the center line of Ball Road, said center line being the Southerly line of said Section 13. ALSO EXCEPTING THEREFROM that portion included within the lines of Parcel 3 of that certain Final Order of Condemnation recorded June 3, 1964 in Book 7073, page 214 of Official Records of said county. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on November 18, 1968, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC68 -344 denying Conditional Use Permit No. 1069; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said conditional use permit and did thereupon fix the 17th day of December, 1968, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons 4 nterested therein an opportunity to be heard and did..feceiv vidence and reports; and x WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that Conditional Use Permit No. 1069 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 1069 be, and the same is hereby sustained, and that the request of Albert S. Toussau for a conditional use permit to establish a 166 -unit planned residenti devebpment on the property hereinbefore des w th versy the following Anaheim Municipal Code requirements or limitations: (a) Maximum building height (Section 18.28.050[5 -b]); (b) Minimum distances between buildings (Section 18.28.050[7]); (c) Maximum distance of every living unit from a standard street (Section 18.28.050[9 -b]); and (d) Location of accessory buildings abutting side property lines (Section 18.28.050[6-c]). be, and the same is hereby denied.
