RESOLUTION NQ. 68R- 746
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING, THE SETTLE-
MENT, OF CERTAIN EMINENT DOMAIN LITIGATION.
WHEREAS, heretofore, on the 15th day of March, 1968,
pursuant to authorization of the City Council, Superior Court
Action #159008, entitled "City of Anaheim vs. John M. Schlund,
et. al.," was filed condemning certain real property for public
street purposes; and
WHEREAS, a Judgment in Condemnation has been agreed
upon and reviewed by the City Council, which reflects the fair
market :value, of the property taken, the reasonable conditions
established in lieu of severance damages, and legal interest
from the date of the Order of Possession; and
WHEREAS, the City Council .findsl it is in the
best interests of the _Cityy to enter j into a .Stipulation for
Judgment incorporating said Judgment in Condemnation.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City: of Anaheim that John H. Dawson, Assistant City
Attorney, be and he is hereby authorized and directed to enter
into a Stipulation for Judgment in the above entitled,matter.
AND BE IT FURTHER RESOLVED that the Finance Director
be, and he is hereby authorized and directed to pay the sum of
$863.19, representing legal interest,to W. E. St John, County
Clerk, for deposit in Court pursuant to said Judgment, and the
sum of $361.54 payable to John M. Schlund, Paul F. Schlund and
Clyde B. Schlund; said warrants to be delivered to the City
Attorney's Office and charged to Work Order No. 247.
THE FOREGOING RESOLUTION is approved and signed by
me this 3rd day of December, 1968.
