1968-745WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from Incentive. Aid Foundation, Inc., and George Page, 730 Sarbonne Road, Los Angeles, California, 90024, to establish an international trade center with markets, hotels, restaurants, a culture center, commercial office buildings, and other related uses, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1: RESOLUTION NO. 68R -745 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1065 All that certain land situated in the State of California, County. of Orange, City of Anaheim, described as follows: That portion of the Northeast quarter of Section 26, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of the East half of the. PARCEL 6: That portion of the northwest quarter of Section 26, Township 4 south, Range 10 west, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as said northwest quarter is shown on a map filed in book 44 pages 43 and 44 of Record of Surveys, in the Office of the County Recorder of said County, described as follows: Commencing at the north quarter corner of said Section 26, said point being distant north 89° 59' 38" east 2642.52 feet from the northwest corner of said Section 26; thence south 1° 16' 48" east 1319.65 feet, said point being the southwest corner of the northwest quarter of the northeast quarter of said Section 26; thence north 89° 58' 45" west 90.14 feet along the westerly prolongation of the southerly line of the north- west quarter of the northeast quarter of said Section 26 to a point on a curve in the southwesterly line of the land described in a deed to the Southern Pacific Rail road Company, recorded March 11, 1899 in book 40 page 216 of Deeds, concave northeasterly having a radius of 2894.83 feet, a radial line through said point bears south 74° 36' 52" west, said point being the true point of beginning; thence southerly along said curve through a central angle of 6° 03' 24" a distance of 306.01 feet to the easterly line of the northwest quarter of said Section 26; thence south 1° 16' 48" east 38.84 feet along said easterly line to the northeasterly line of land described on a deed to the State of California, recorded July 10, 1914 in book 258 page 62 of deeds; thence north 40° 48' 53" west 434.83 feet along said northeasterly line to the westerly prolongation of the southerly line of the northwest quarter of the north- east quarter of said section 26; thence south 89° 58' 45" east 186.73 feet to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on October 21 1968 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC68 -313 g�ranting Conditional Use Permit No. 1065, subject to the conditions therein set forth and WHEREAS, thereafter within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said conditional use permit and said appeal was set for public hearing on November 19 1968 at the City Hall, in the City of Anahe m and notices of i public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in granting said conditional use permit be, and the same is hereby suafned and that Conditional Use Permit No. 1065 Be, and the same is hereby, granted permitting the establishment of an international trade center with markets, hotels, restaurants, a culture center, commercial office buildings, and other related uses, on the property hereinbefore described, subject to the following conditions: 1. That the owners of subject property shall deed to the City. of Anaheim a strip of land 64 feet in width for the extension of Lewis Street, from Pacifico Avenue to Anaheim Boulevard, on an alignment satisfactory to the City Engineer. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Pacifico Avenue, including corner returns, from the center line of State College Boulevard to a point approximately 665 feet west thereof and from a point approximately 660.34 feet east of Lewis Street to the westerly property line, for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim along State College Boulevard, Orangewood Avenue and Pacifico Avenue including preparation of improvement plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the. City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 4. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of all engineering requirements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, along Lewis Street, said engineering requirements or improvements to be installed as required for traffic and upon demand of the City Engineer. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along State College Boulevard, Katella, Orangewood and Pacifico Avenues, and Lewis Street, for street lighting purposes. 6. That the .owners of subject property shall pay to the City of Anaheim the sum of 15 per front foot, along State College Boulevard, Katella, Orangewood and Pacifico Avenues, and Lewis Street for tree planting purposes. 7. That the owners of subject property shall deed to the. City of Anaheim adequate right- of-way for the. Orangewood Avenue overcrossing, and said right-of-way shall be deeded to the City upon demand of the City Engineer. 8. That sidewalks shall be installed along Katelia Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 9. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 10. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 11. That all air- conditioning facilities shall be properly shielded from view. 12. That approval Qf the City Council shall be obtained to th extension of Pacifico Avenue through sub ject `property 13. That conditions Nos. 1, 2, 3(b), 4, 5, 6, 7 and 12, above mentioned, shall be complied with prior to the issuance of a building permit or within a period of 180 days from date hereof, whichever occurs first, or such further time as the City Council may grant. 14. That Conditions Nos. 8, 9, 10 and 11, above mentioned, shall be complied with prior to final building and zoning inspections.
