1968-743RESOLUTION NO. 68R -743 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2026. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Rudy A. and Ella E. Heman, Edwin W. and Clara M. Brelje and City of Anaheim, owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: PARCEL 1. That portion of the 110 acre parcel of land allotted to Eduardo Polloreno in Decree of Partition of the Rancho Santiago de Santa Ana, recorded in book "B" of Judgments of the 17th Judicial District Court of Los Angeles County, California, in the County of Orange, State of California, described as follows: Beginning at the Southeast corner of said Polloreno Allott- ment; thence West 6.435 chains to a point 13.565 chains East of the Southwest corner of said Allottment; thence North to the Southerly line of the land described in deed to the State of California, recorded November 23, 1948 in book 1763, page 506 of Official Records of said Orange County; thence along the Southerly line of said land North 74° 17' 28" East 355.70 feet to the beginning of a tangent curve concave to the North having a radius of 2110 feet; thence Easterly 87.70 feet through an angle of 2° 22' 53" to the East line of said Allottment; thence South 0° 02' West along said East line to the point of beginning. PARCEL 2. That portion of the land allotted to Paula Peralta de Dominguez, in Decree of Partition of the Rancho Santiago de Santa Ana, recorded in book "B" of Judgments of the 17th Judicial District Court of Los Angeles County, Cali- fornia, in the County of Orange, State of California, described as follows: Beginning at a point 13.565 chains East of the common corner of Sections 1, 2, 11 and 12, Township 4 South, Range 9 West of said Rancho Santiago de Santa Ana, said point being the Southeast corner of the land described in deed to Frank E. Coulter and Robert E. Coulter, re- corded in book 220, page 220 of Deeds, of said Orange County; thence South 8.935 chains; thence East 6.435 chains; thence North 8.935 chains to the Southeast corner of said Coulter land; thence West 6.435 chains to the point of beginning. PARCEL 3. That portion of the land allotted to Paula Peralta de Dominguez in Decree of Partition of the Rancho Santiago de Santa Ana, recorded in Book "B" of Judgments of the 17th Judicial District Court of Los Angeles County, Cali- fornia, in the County of Orange, State of California, described as follows: Beginning at a point on the East line of the land described in deed to Frank E. Coulter and Robert E. Coulter, recorded in book 261, page 208 of Deeds of said Orange County, 111.36 feet South of the Northeast corner of said land; thence South 30° 29' 30" East 207.32 feet; thence South 17° 32' East 157 feet; thence South 4° 23' West 150.45 feet; thence West 141 feet to the Southeast corner of said land; thence North 478.35 feet along the East line of said land to the point of beginning. PARCEL 4. That parcel of land conveyed to the City of Anaheim, a municipal corporation, described in Parcel 3 of deed recorded November 19, 1964, in Book 7309, pages 776 to 780, inclusive, of Official Records of Orange County, California. EXCEPTING THEREFROM that northerly portion lying within the Santa Ana Valley Irrigation Canal. AND WHEREAS, the City Planning Commission did hold a public hearing at the City. Hall in the City of Anaheim upon said petition on November 18, 1968, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due in- spection, investigation and studies made by itself and in its be- half, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC68 -330, recommending that Variance No. 2026 be granted, subject to the condition therein set forth; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 3rd day of December, 1968, at 1 :30 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the Provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the minimum lot width requirement (Section 18.24.030[4 -a] of the Anaheim Munici- pal Code), to permit the subdivision of the property hereinbefore described with variable lot widths, subject to the following condition: That this variance is granted subject to the completion of Reclassification Proceedings No. 68 -69 -40 now pending. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 3rd day of December, 1968.
