1968-739RESOLUTION NO. 68R -739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 68_6q_3R to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 3ra day of Deceber 1968 as the time, and the City Council Chambers In the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones,in, which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 68 -69 -38 PARCEL 1. Beginning at a point in the South line of Tract 613, in the City of Anaheim, as shown on a map thereof recorded in Book 19, Page 19, Miscellaneous Maps, Records of Orange County, California, said point being 827.04 feet North 73° 12' East from the Southwest corner of said Tract 613; running thence North 7° 15' West 1208.11 feet to a point in a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7° 15' East from the North- east corner of said Tract 613; running thence South 75 20' West to a point in the Westerly line of said Tract 613; said point being 570.00 feet South 18° 11' West from the most Northwest corner of said Tract 613; thence North 75 20' East 202.59 feet along the said described line to its Eastern terminus; thence South 7° 15' East 1200.44 feet along a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7° 15' East from the Northeast corner of said Tract 613, running thence South 7° 15' East parallel to the Easterly line of said Tract 613, to a point in the Southerly line thereof; thence South 73° 12' West 203.72 feet to the point of beginning. EXCEPTING THLREFROM the southerly 475 feet. PARCEL 2. Beginning at a point in the North line of Tract 613, in the City of Anaheim, as shown on a map thereof recorded in Book 19, Page 19, Miscellaneous Maps, Records of Orange County, California, (said North line being the centerline of Placentia -Yorba Boulevard), said point being 685.30 feet North 87° 19' West from the Northeast corner of said Tract 613; running thence South 87° 19' East 685.30 feet along said North line to the said Northeast corner; thence South 7° 15' East 459.38 feet along Easterly line of said Tract 613; thence North 87° 19' West 685.30 feet to a point in a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7° 15' East from the Northeast corner of said Tract 613, running thence South 7° 15' East parallel to the Easterly line of said Tract 613, to a point in the Southerly line thereof; thence North 7° 15' West 181.04 feet along said described line to its Northern terminus; thence North 7° 15' West 278.34 feet. be excluded from R -A, AGRICULTURAL ZONE, and incorporated in C- 1,GENERAL COMMERCIAL ZONE, upon the following conditions: 1. (a) That all engineering requirements of the City of Anaheim alongCrowther and Kraemer Avenues, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City ATTEST: Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Crowther and Kraemer Avenues, for street lighting purposes. 3. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Crowther and Kraemer Avenues for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to to final building ana zoning inspection. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspection. 6. That all air conditioning facilities shall be properly shielded from view, prior to final building and zoning inspections. 7. That the parking are shall be lighted with down lighting of a maximum height of six (6) feet, said lighting to be directed away from the property lines to protect the residential integrity of the area, and to be installed prior to final building and zoning inspections. 8. That Conditions Nos. 1 (b), 2 and 3, above- mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. 13E. IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
