A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No. 68 -69 -32 to consider an amendment to
Title 18 of the Anaheim Municipal Code relating to zoning, and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the pro-
posed amendment be adopted by the City Council and that a
certain zone or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the 3rd day
of npnPilhPr 19 6R as the time, and the C[t y Council
Chambers in the City Hall of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said
property, hereinafter described, from the zone or zones in
which it is now situated and the incorporation thereof in the
zone or zones hereinafter set forth, and did give notice there-
of in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the Planning Commission, its report
of findings and recommendation; and
WHEREAS, the City Council does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County
of Orange, State of California, to wit:
68 -69 -32
PARCEL 1.
That portion of Lot 6 in Block 24 of the Yorba Linda
Tract, in the City of Anaheim, County of Orange, State
of California, as per map recorded in book 5, pages 17
and 18 of Miscellaneous Maps, in the office of the County
Recorder of said county, lying South of the South line of
the right of way of the inlet ditch, as shown on a map
filed in book 3, page 48 of Record of Surveys, in the
office of the County Recorder of said Orange County, and
East of a line between the southeast corner of Lot 4 in
Block 34 of said tract, and the angle point on the South
line of said Lot 6 in Block 24.
EXCEPT that portion conveyed to the State of California,
by deed recorded September 7, 1954 in book 2811 page 283
of Official Records, and by deed recorded March 8, 1962
in book 6032 page 53 of Official Records.
ALSO EXCEPT that portion thereof included within the fol-
lowing described lines: Beginning at the intersection of
the southwesterly line of said Lot 6 with the West line of
the County road, as shown on a map filed in book 3 page
48 of Record of Surveys, in the office of the County
Recorder of said Orange County, said point being on a
curve concave easterly and having a radius of 405.00
feet, a radial point bears North 68° 17' 36" East; thence
along said southwesterly line of Lot 6, North 51° 30' 10"
West 57.34 feet to an angle point; thence North 32° 32'
50" East 23.73 feet to the center line of the A.U.W. Co.
ditch, thence along said center line, North 88° 06' 50"
East 65.00 feet to the beginning of a tangent curve con-
cave northerly and having a radius of 350.00 feet; thence
easterly 42.38 feet along said curve to a point to which a
radial bears South 8° 49' 26" East; thence North 81° 10'
34" East 98.10 feet to the beginning of a curve concave
southerly and having a radius of 580.00 feet; thence
easterly 120.00 feet along said last mentioned curve to
a point to which a radial bears South 3° 01' 50" West; thence
South 12° 39' 00" West 118.00 feet; thence North 82° 45'
43" West 199.52 feet to the East line of said county road;
thence North 84° 02' 12" West 68.20 feet to the point of
beginning.
PARCEL 2.
That portion of the First Class Land allotted to R.
Rivas as described in the final Decree of Partition of the
Rancho Canon de Santa Ana, a certified copy of which was
recorded February 8, 1874 in Book 28, page 158 of Deeds,
Records of Los Angeles County, California, as described in
a deed recorded in Book 7702, Page 921, Official Records
of Orange County, California, which lies Northerly of a line
parallel with and 170.00 feet Southerly from the Southerly
line of the land described in a deed recorded in Book 4244
page 38, Official Records of said Orange County.
EXCEPTING therefrom the Northerly 70.00 feet.
ALSO EXCEPTING therefrom that portion lying Westerly of a
line concentric with and 40.00 feet Easterly from the center-
line of Orchard Drive as said center line is shown on a
map attached to said deed recorded in Book 7702, Page 921,
Official Records of said County.
PARCEL 3.
That portion of the First Class Land allotted to R. Rivas
as described in the Final Decree of Partition of the
Rancho Canon de Santa Ana, a certified copy of which was
recorded February 8, 1874 in Book 28, Page 158 of Deeds,
Records of Los Angeles County, California, as described
in a deed recorded in Book 7702, Page 921, Official
Records of Orange County, California, which lies Northerly
of:a with and 70.00 feet Southerly from
the Southerly line of the land described in a deed recorded
in Book 4244, Page 38, Official Records of said Orange
County.
EXCEPTING THEREFROM that portion lying Westerly of a line
concentric with and 40.00 feet Easterly from the center
line of Orchard Drive as said center line is shown on a
map attached to said deed recorded in Book 7702, Page 921
Official Records of said Orange County.
PARCEL 4.
That portion of the First Class Land allotted to R. Rivas,
as described in the Final Decree of Partition of the
Rancho Canon de Santa Ana, a certified copy of which was
recorded February 8, 1874 in Book 28, Page 158 of Deeds,
Records of Los Angeles County, California, as described
in a deed recorded in Book 7904, Page 804, Official
Records of Orange County, California, which lies Northerly
of a line parallel with and 170.00 feet Southerly from
the southerly line of the land described in a deed recorded
in Book 4244, Page 38, Official Records of said Orange
County.
be excluded from R -A, AGRICULTURAL ZONE, and incorporated in
R -2 -5000, ONE FAMILY ZONE, upon the following condition:
That a final tract map of subject property
shall be submitted to the City Council for
approval and then recorded in the office of
the Orange County Recorder.
BE IT FURT"tER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and submit
to the City Council an ordinance amending Title 18 of the
Anaheim Municipal Code to accomplish the objects herein found
and determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 3rd day of December, 1968.
