1968-719A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RE- SPONSIBLE BIDDER FOR THE FURNISHING TO THE CITY OF ANAHEIM OF CAST IRON WATER PIPE AND FITTINGS. WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on October 31st and November 7th, 1968, a notice inviting sealed proposals for the furnishing to the City of Anaheim, in approximate quantities, of the fol- lowing cast iron water pipe and fittings: ITEM I ITEM II ITEM III ITEM IV ITEM V ITEM VI ITEM VII RESOLUTION NO. 68R -719 1,000 3,000 6,000 7,000 7,000 30,000 feet feet feet feet feet pounds of Tyton Joint Fittings 20,000 pounds of regular fittings, caulk type AND WHEREAS, said notice did provide that said pipe and fittings shall be in accordance with "Specifications for Cast Iron Water Pipe, Series of 1968 City of Anaheim and WHEREAS, such notice inviting proposals for said cast iron water pipe and fittings did provide that said sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of said City up to the hour of 2:00 o'clock P.M. on November 14, 1968, for the furnishing to said City of said water pipe and fittings; and WHEREAS, the City Clerk of the City of Anaheim did receive sealed proposals prior to 2:00 o'clock P.M. on November 14, 1968, for the furnishing of said cast iron water pipe and fittings, which proposals were opened on said date in public, in the City Council Chambers in the City Hall, in the City of Anaheim, by the City Clerk and the Purchasing Agent, and duly tabulated by the Purchasing Agent and the result thereof reported to the City Council at its next regular meeting, for action thereon by said City Council. That sealed proposals were re- ceived from the following persons, firms or corporations in the amounts set forth: of 4 inch cast iron pipe of 6 inch cast iron pipe of 8 inch cast iron pipe of 10 inch cast iron pipe of 12 inch cast iron pipe NAME PACIFIC STATES CAST IRON PIPE CO. (TAX INCLUDED) UNITED STATES PIPE I 1,450.00 AND FOUNDRY COMPANY II 6,300.00 III 17,880.00 IV 27,510.00 V 34,790.00 VI 8,865.00 VII 4,230.00 Total Amount of Proposal, tax included $101,025.00 AND, WHEREAS, the City Council does find that the sealed proposal of the PACIFIC STATES CAST IRON PIPE CO., 6399 Wilshire Boulevard, Room 201, Los Angeles, California, 90048, is the lowest responsible bid for the furnishing of cast iron water pipe and fittings specified in Items I, II, III, IV, V, VI and VII of the notice inviting sealed proposals and in accord- ance with the specifications set forth in said notice inviting sealed proposals, and that said proposal of Pacific States Cast Iron Pipe Co. should be accepted and a contract awarded to said company for furnishing said pipe and fittings to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said proposal submitted by the Pacific States Cast Iron Pipe Co. for the furnishing of cast iron water pipe and fittings, as specified in the notice inviting sealed proposals therefor and in accordance with and conformity to "Specifications for Cast Iron Water Pipe, Series of 1968 City of Anaheim," be, and the same is hereby, accepted and that a contract for the furnishing of said water pipe and fittings be, and the same is hereby, awarded to said Pacific States Cast Iron Pipe Co., and; BE IT FURTHER RESOLVED that the award of a contract to said Pacific States Cast Iron Pipe Co. is declared to be for the approximate quantities set forth in the notice inviting sealed proposals and that the actual amounts required by the City may be substantially more or less than these amounts; and BE IT FURTHER RESOLVED that said Pacific States Cast Iron Pipe Co., be, and it is hereby required to execute a con- tract, in required form satisfactory to the City of Anaheim and upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by it, and in accord- ance with the specifications for cast iron water pipe and fittings as set forth in said notice inviting sealed proposals for the furnishing of said cast iron water pipe and fittings hereinabove more particularly set forth, in all required lengths, at the prices as follows: ITEM QUANTITY I 1,000 ft. ANAHEIM, Tax included 97,333.00 AND BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that said bid be, and the same is hereby accepted and said contract awarded for the above prices for said cast iron pipe and fittings, F.O.B. Anaheim, sales tax included, said pipe and fittings to be delivered as required by the City of Anaheim during a period not exceeding 12 months from date of contract. BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to execute for and on behalf of the City of Anaheim with said Pacific States Cast Iron Pipe Co., a written contract for the furnishing of said cast iron water pipe and fittings hereinabove set forth and in accordance with the "Specifications for Cast Iron Water Pipe, Series of 1968 City of Anaheim," the notice inviting sealed proposals and the terms of this resolu- tion, and the contract approved by the City Attorney of the City of Anaheim; and BE IT FURTHER RESOLVED that said contract shall con- tain a provision that should said Pacific States Cast Iron Pipe Co. fail or neglect to furnish said cast iron pipe and /or fittings in accordance with said specifications and the sealed proposal submitted by it and accepted by the City as herein specified, it shall, in addition to any other penalties provided in the contract documents, be liable to the City of Anaheim for all loss or damages that the latter may suffer on account thereof.
