1968-694RESOLUTION NO. 68R -694 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1067. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from Maurice Gale Hartman, Zuletta Jane Hartman Collier and Elizabeth Ann Tremble, Yorba Linda, California, to permit the construction of a 22 -unit motel, plus manager's apartment, with a waiver of the minimum side yard setback area (Section 18.38.050 (2 D 1) of the Anaheim Municipal Code), on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1: A portion of the north half of the West half of the Northwest quarter of the North- east quarter of Section 22, Township 4 South, Range 10 West, S. B. B. M. described as follows: Beginning at the Northeast corner of the North half of the West half of the Northwest quarter of the Northeast quarter of said Section 22; thence South 0 14' 30" East along the Easterly line of said North half of the West half of the Northwest quarter of the Northeast quarter, 156.00 feet; thence South 89 55' 35" West along a line parallel to the Northerly line of said North half of the West half of the Northwest quarter of the Northeast quarter of Section 22, 100.00 feet; thence North 0° 14' 30" West along a line parallel to the said Easterly line 156.00 feet to the said Northerly line of the North half of the West half of the Northwest quarter of the Northeast quarter of Section 22; thence North 89° 55' 35" East along the said Northerly line 100.00 feet to the point of beginning. Excepting therefrom the Northerly 50.00 feet thereof, said exception being the Southerly half of Bali Road. PARCEL 2: That portion of the North half of the West half of the Northwest quarter of the Northeast quarter of Section 22, Township 4 South, Range 10 West, S. B. B. M., more particularly described as follows: Beginning at a point in the Easterly line of the North half of the West half of the Northwest quarter of the Northeast quarter of Section 22, 156.00 feet Southerly of the Northeast corner thereof; thence South 0° 14' 30" East along the said Easterly line 90.76 feet to a point in the curve concave Northerly having a radius of 245.00 feet, the radial line of said curve at said point bears North 18° 04' 03" West, said point being also the North- east corner of Lot "A" of Tract No. 1758, as shown on a Map recorded in Book 53, pages 19 and 20 of Miscellaneous Maps, records of Orange County, California; thence Westerly along the Northerly line of said Lot "A" and said curve through an angle of 17 49' 33" a distance of 76.22 feet to a line tangent, said line tangent being at right angles to the said Easterly line of the North half of the West half of the Northwest quarter of the Northeast quarter of Section 22; thence South 89° 45' 30" West along said line tangent 20.00 feet to the beginning of a curve con- cave Northeasterly having a radius of 270.00 feet; thence Northwesterly along said curve through an angle of 1° 03' 40 a distance of 5.00 feet; thence North 0° 14' 30" West along a line parallel with the said Easterly line of the North half of the West half of the Northwest quarter of the Northeast quarter of Section 22, 102.77 feet; thence North 89° 55' 35_" East along a line parallel with the Northerly line of the North half of the Northeast quarter of said Section 22, 100.00 feet to the point of beginning. PARCEL 3: That portion of Lot "A" of Tract No. 1758, as shown on a Map recorded in Book 53, pages 19 and 20 of Miscellaneous Maps, records of Orange County, California, lying Easterly of the following described line: Beginning at the Southwesterly corner of the land described in the deed from J. Ralph Caldwell and wife to Robert W. Coray and Martha R. Coray, husband and wife, dated October 23, 1953, and thence South 0° 14' 30" East to a point in the Southerly line of said Lot "A PARCEL 4: All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: The Easterly 10' of the following described property: That portion of the Northwest quarter of the Northeast quarter of Section 22, Township 4 South, Range 10 West, S. B. B. M., described as follows: Commencing at a point on the North line of said Section 22 that is North 89° 55' 35" East 416.68 feet from the intersection of the center lines of Harbor Boulevard and Ball Road as shown on a Map of Tract No. 1758, recorded in Book 53, pages 19 and 20 of Miscellaneous Maps, records of Orange County, California; thence South 0° 14' 30" East 215.31 feet along the Easterly line of Lots 70 and 71 of said Tract No. 1758 and its Northerly prolongation to the most Northwesterly corner of Lot "A" of said Tract No. 1758; thence South 62° 17' 55" East 26.57 feet to the beginning of a tangent curve concave Northeasterly having a radius of 270.00 feet and a central angle of 26° 52' 55 thence Southeasterly along said arc a distance of 126.68 feet to the Southwest corner of land described in deed to Robert W. Coray and wife, recorded January 21, 1954 in Book 2654, page 385 of Official Records of Orange County, California; thence North 0° 14' 30" West 102.77 feet to the Northwest corner of said land of Robert W. Coray; thence North 0° 14' 30" West 156.00 feet along the Westerly line of land described in deed to Frank M. Trujillo and wife recorded May 6, 1954 in Book 2722, page 391 of Official Records of Orange County, and its Northerly prolongation to the North line of said Section 22; thence South 89° 55' 35" West 145 feet to the true point of beginning. Excepting therefrom the North 50 feet included in Ball Road. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on October 21, 1968, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC68 315, denying Conditional Use Permit No. 1067; and WHEREAS, thereafter, within twenty two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said Conditional Use Permit and said appeal was set for public hearing on the 12th day of November, 1968, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying said Conditional Use Permit be, and the same is hereby disapproved, and that Conditional Use Permit No. 1067 be, and the same is hereby granted permitting the construction of a 22 -unit motel plus manager's apartment, on the property hereinbefore described, with a waiver of the minimum side yard setback area (Section 18.38.050 (2 -D -1) of the Anaheim Municipal Code), subject to the following conditions: 1. That a block wall, six feet in height, shall be constructed on the Berry Avenue frontage of subject property. 2. That this Conditional Use Permit is granted subject to the completion of Reclassification Proceedings No. 67 -68 -39 now pending. 3. That a parcel map to record the approved division of subject property shall be submitted to the City of Anaheim for approval and then recorded in the Office of the Orange County Recorder. 4. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 5. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 6. That all air conditioning facilities shall be properly shielded from view and in architectural conformance with the buildings, and the sound shall be buffered from adjacent residential homes. 7. That the parking areas shall be lighted with down- lighting of a maximum height of six feet, and said lighting shall be directed away from the property lines to protect the residential integrity of the area. 8. That Condition No. 3, above- mentioned, shall be complied with prior to the issuance of a building permit or within a period of 180 days from date hereof, whichever occurs first, or such further time as the City Council may grant. 9. That Conditions Nos. 1, 4, 5, 6 and 7, above mentioned, shall be complied with prior to final building and zoning inspections. 10. That subject property shall be developed sub- stantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3 and 4; and, in addition, tree screen landscaping, on 20 -foot centers, shall be planted along the entire Berry Avenue setback frontage. The City Council hereby reserves such conditional use permit for good cause owners, their heirs, successors or assigns the Anaheim Municipal Code and regulations herein.
