1968-691A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE SETTLEMENT OF CERTAIN
EMINENT DOMAIN LITIGATION AND DIRECTING THE PAY-
MENT OF CERTAIN SUMS IN. CONNECTION. THEREWITH.
WHEREAS, heretofore, on the llth day of July, 1967,
the City Council of the City of Anaheim did direct the taking
of certain property for an easement for sewer and public utility
purposes, which resulted in the filing of .Superior Court action
No. 154849, being entitled, "City of Anaheim vs Newport Con-
struction Co. etc. et al. and
WHEREAS, a settlement thereof has been made resulting
in a stipulated judgment in the amount of $6,568.48; and
WHEREAS, the City Council of the City of Anaheim
finds that said settlement in said amount is fair and reason-
able and in the best interests of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City Attorney be, and he is
hereby authorized to settle said litigation in consideration
of the sum above set forth, and that he be, and he is hereby,
authorized and directed to cause judgment in Condemnation and
Final Order of Condemnation to be entered in said matter.
AND BE IT FURTHER RESOLVED that the Director of
Finance, be, and he is hereby authorized and directed to draw
a warrant in the amount of $6,568.48 in favor of DONALD L.
BREN COMPANY, the successor in interest to said Newport Construc-
tion Co., and deliver said warrant to the Office of the City
Attorney for transmittal to said defendant in satisfaction of
said Judgment in Condemnation.
