1968-670RESOLUTION NO. 68R -670 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO SHOULD BE AMENDED AND THAT THE BOUNDARIES' OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 68 -69 -28 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 29th day of October 19 68 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 68 -69 -28 PARCEL 1: (A portion of Tentative Tract Nos. 4476 and 5593) That portion of Lots 1 and 24 of J. D. Taylor Tract, as shown on a map thereof recorded in book 5, page 16, of Miscellaneous Maps, records of said Orange County and that portion of Glenn Avenue 60.00 feet in width, and that certain unnamed street 30.00 feet in width along the Northeasterly line of said Lot 24, as said streets are shown on said Map, which were abandoned by resolution of the Board of Supervisors of Orange County, California on March 8, 1907, described as follows: Beginning at the intersection of the Southeasterly pro- longation of the Northeasterly line of Lot 1 with the Northerly line of the strip of land described in deed to Santa Ana Valley Irrigation Company, recorded July 18, 1934 in book 685, page 255, Official Records; thence along said prolongation and said Northeasterly line of Lot 1, North 29° 45' 20" West, 1567.00 feet; thence South 60° 14' 40" West 168.00 feet;. thence parallel with said Easterly line of Lot 1 and said prolongation South 29° 45' 20" East 1400.00 feet; thence Southeasterly in a direct line to a point in the Northerly line of land described in deed to Santa Ana Valley Irrigation Company distant Southwesterly thereon 150 feet from the point of beginning; thence along said Northerly line, North 50° 51' 45" East 150.00 feet to the point of beginning. PARCEL 2: (A portion of Tentative Tract Nos. 4476, 5591 and 5593) Lots 1, 2, 23, and 24 of J. D. Taylor Tract, as shown on a map thereof recorded in book 5, page 16, Miscellaneous Maps, records of said Orange County. EXCEPTING THEREFROM that portion of said Lot 1 described in quitclaim deed executed by Charles J. Biddle and Freda W. Biddle, husband and wife, to Orange County Water District, a corporation, recorded August 21, 1947, in book 1532, page 529, Official Records; ALSO EXCEPTING THEREFROM that portion thereof lying Southerly of the Northerly line of the strip of land described in the deed to Santa Ana Valley Irrigation Company, recorded July 18, 1934, in book, 685, page 255, Official Records; ALSO EXCEPTING THEREFROM that portion thereof conveyed to the State of California, by deed recorded September 16, 1954, in book, 2818, page 270, Official Records; ALSO EXCEPTING THEREFROM that portion of Lots 1 and 24 described as follows: Beginning at the intersection of the Southeasterly pro- longation of the Northeasterly line of Lot 1 with the Northerly line of the strip of land described in to Santa Ana Valley Irrigation Company, recorded July 18, 1934 in book 685, page 255, Official Records; thence along said prolongation and said Northeasterly line of Lot 1, North 29° 45' 20" West, 1567.00 feet; thence South 60° 14' 40" West 168.00 feet; thence parallel with said Easterly line of Lot 1 and said prolongation South 29° 45' 20" East 1400.00 feet; thence Southeasterly in a direct line to a point in the Northerly line of land described in deed to Santa Ana Valley Irrigation Company distant Southwesterly thereon 150 feet from the point of beginning; thence along said Northerly line, North 50° 51' 45" East 150.00 feet to the point of beginning. NOTE: A portion of said land is included within the area shown on a map recorded in book 17, page 38, Record of Surveys, in the office of the County Recorder of said Orange County. PARCEL 2A: (A portion of Tentative Tract Nos. 5591 and 5593) That portion of the land allotted to Josefa Montalva de Serrano, administratrix of the Estate of Leandro Serrano, Deceased, as described in the final Decree of Partition of the Rancho Santiago de Santa Ana, a certified copy of which was recorded September 12, 1868, in Book "B page 410, of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: Beginning at a point in the North line of Lot 1 of the J. D. Taylor Tract, as shown on a map thereof, recorded in book 36, pages 58, 59 and 60, Miscellaneous Records of Los Angeles County, California, said point being South 57 13' West 83.85 feet and South 50° 47' West 147.50 feet from the Northeasterly corner of said Lot 1; thence from said point of beginning along the Northerly line of Lots 1 and 2 of said J. D. Taylor Tract, South 50 47' West 177.50 feet, South 40° 15' West 200.00 feet, South 67 49' West 264.22 feet to the Northwest corner of said Lot 2; thence North 16 48' 50" West 125.37 feet along the Northerly extension of the West line of said Lot 2 to its intersection with the Northerly line of that certain parcel of land conveyed to the Orange County Water District by Lenna M. Bonner as per deed thereof recorded in book 1086, page 214, Official Records; thence North 66° 47' 10" East 595.20 feet to the point of beginning. PARCEL 3: (A portion of Tentative Tract Nos. 4476 and 5591) That portion of Lots 3 and 22 of the J. D. Taylor Tract as shown on a map thereof recorded in book 36, pages 58, 59 and 60, Miscellaneous Records of Los Angeles County, California, described as follows: Commencing at the intersection of the center line of Jefferson Street, shown as Cross Street on said map, with the center line of Glen Avenue (abandoned by Resolution of the Board of Supervisors of said Orange County), and running thence along said center line of Glen Avenue, North 75° 22' 04" East 1102.67 feet to its intersection with the Northerly prolongation of the Westerly line of said Lot 22, said point of intersection being the true point of beginning of the boundary of the land herein described; thence along said prolongation, and the Westerly line of said Lot 3, North 16° 09' 30" West 55.74 feet; thence North 60° 51' 50" East 564.26 feet to the Easterly line of said Lot 3; thence along said Easterly line and its prolongation, and along the Easterly line of said Lot 22, South 16° 10' 19" East 899.70 feet to an angle point in the boundary line of the land conveyed to the State of California by deed recorded April 7, 1955, in book 3022, page 464, Official Records, said angle point being the Northeasterly terminus of the course in said deed designated North 40° 36' 20" East 106.23 feet; thence along the boundary of the land described in said deed, the following courses and distances: South 40° 36' 20" West 106.23 feet to the beginning of a curve concave Northeasterly and having a radius of 952.00 feet, a radial line at said point bearing North 21 11' 24" East; Northwesterly along said curve through a central angle to 21° 43' 06 an arc distance of 360.86 feet to a line tangent; along said tangent line and along the Northeasterly line of the land described in the deed to the State of California, recorded August 25, 1954, in book, 2800, page 60, Official Records, North 47° 05' 30" West 432.17 feet to its intersection with the Westerly line of said Lot 22; thence along said Westerly line and its Northerly prolongation, North 16° 09' 30" West 137.35 feet to the true point of beginning; EXCEPTING THEREFROM that portion thereof described as follows: Beginning at a point on the West line of said Lot 22, distant along said West line, South 16 02' 35" East, 117.77 feet from the center line of said Glen Avenue, said point being also the Northwest corner of that certain parcel of land described in deed to said state, recorded in book 2800, page 60, Official Records; thence along said West line and its Northerly prolongation, North 16° 02' 35" West, 196.72 feet; thence South 58° 02' 18" East, 327.59 feet; thence South 48° 04' 42" East, 258.05 feet; thence South 26° 12' 53" East, 341.78 feet to the general Northeasterly line of that certain parcel as described in deed to said state recorded in book 3022, page 464, of Official Records; thence Northwesterly, along said general Northeasterly line to the point of beginning. That a final tract map of subject property shall be submitted to the City Council for approval and then recorded in the Office of the Orange County Recorder. 2. That ordinances reclassifying subject property shall be adopted at such time as the owner of each parcel has complied with Condition No. 1 hereof; provided, however, that the word "parcel" shall mean presently existing parcels of record, and any parcel or parcels approved by the City Council for a lot split. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
