1968-663RESOLUTION NO. 68R -663 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No, 68 69 13 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to con- sider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing, and a recommendation that a certain zone or zones be changed as more particularly set forth in said resolution; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission, the City Council did fix the 29th day of October 19 68 as the time and the City Council Chambers in the City Hoof the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones set forth in said proposed amendment; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hear- ing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit -1- 68 -69 -13 PARCEL A All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: Those portions of Lots 1 State Tract" as shown on 66 and 67, Miscellaneous California, described as and 2 in Block 23 of the "Golden a map recorded in book 4, pages Maps, records of Orange County, follows: Beginning at a point in the east line of said Lot 1, distant along said east line South 7° 19' 33" East 333.18 feet from the North line of Canal Street said point being the southeasterly corner of the land described in final order of condemnation by the State of California, recorded May 12, 1964 in book 7042, page 165, Official Records; thence along the southerly line of said land described in final order of condemnation South 85° 20' 53" West 81.95 feet and South 75 11' 22" West 583.25 feet to a point in the easterly line of Lot 2, said point being the southeast corner of the land conveyed to the State of California by deed recorded in book 7077, page 460, Official Records; thence along the southerly line of the land conveyed to the State of California South 85° 02' 44" West 401.43 feet to a point in the westerly line of the land described in deed recorded October 18, 1946 in book 1457, page 463, Official Records; thence South 7° 19' 33" East along said westerly line 855.93 feet to a point in the northerly line of the southerly 4 1/4 acres of said Lot 2; thence South 82° 40' 27" West along said northerly line 259.39 feet to a point in the westerly line of said lot 2; thence South 7° 19' 33" East along the westerly line of Lot 2, 60.90 feet to the southwesterly line of the "Golden State Tract thence South 60° 34' 53" East along the southwesterly line of the "Golden State Tract" and said Lot 2, 594.41 feet to the most southerly corner thereof; thence North 70° 23' 27" East along the southeasterly lines of Lots 2 and 1, 242.25 feet to the most westerly corner of Block 25 of the "Golden State Tract thence North 45° 28' 27" East along the southeasterly line of said Lot 1 in Block 23, 760.73 feet to the southeasterly corner of said Lot 1; thence North 7° 19' 33" West along the easterly line of said lot 1, 816.82 feet to the point of beginning. That said change of zones shall be made upon the following condi- tions: 1. That a final tract map of subject property shall be submitted to the City Council for approval and then recorded in the office of the Orange County Recorder. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit to be used for park and recreation purposes, said amount to be paid prior to the issuance of a building permit; PROVIDED, HOWEVER, that in the event said sum shall not have been paid by May 1, 1969, there shall be due and payable prior to the issuance of a building permit, the sum of $150.00 per apartment unit. 3. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Super- intendent of Streets, prior to final building and zoning inspection. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
