A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF A SUPPLEMENTAL AGREEMENT
BETWEEN THE ATCHISON, TOPEKA AND SANTA FE
RAILWAY COMPANY AND THE CITY OF ANA1EIN
ME
ANDING THAT CERTAIN CONTRACT DATE
NOVEMBER 24, 1953 AND DESIGNATED AS SANTA
FE'S CONTRACT "SECRETARY'S NO. 58261,"
RELATING TO SPUR TRACK NO. 12.
WHEREAS, -The Atchison; Topeka and Santa Fe Railway
Company and Gelvatex Coatings Corporation entered into an
agreement dated November 24, 1953, designated in the records
of The Atchison, Topeka and Santa Fe Railway Company as Contract,
"Secretary's No. 58261," relating to the construction, operation
and maintenance of approximately 596.8 feet of track to serve
facilities of Gelvatex Coatings Corporation at or near the
station of Anaheim, Orange County, California, as shown on a
print of Division Engineer's Drawing No. L -3- 201206, dated
June 23, 1954, thereto attached, marked "Exhibit A" and by
reference made a part thereof; and
WHEREAS, the City of Anaheim is the successor and
has acquired all of the interests of Gelvatex Coatings Corpora-
tion in said agreement dated November 24, 1953 and desires to
become a party to said agreement in the place and stead of
Gelvatex Coatings Corporation; and
WHEREAS, The Atchison, Topeka and Santa Fe Railway
Company is agreeable to the City's becoming a party to said
contract in place of said Gelvatex Coatings Corporation, upon
the terms and conditions set forth in a Supplemental Agreement,
dated June 21, 1967, this day submitted to the City Council to
be made and entered into between the City and said Railway
Company; and
WHEREAS, the City Council finds that the terms and
conditions of said Supplemental Agreement are satisfactory and
that the same should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Supplemental Agreement, dated
June 21, 1967, this day submitted to the City Council to be
made and entered into between the City of Anaheim and The
Atchison, Topeka and Santa Fe Railway Company, amending that
certain contract dated November 24, 1953,designated as said
Railway Company's Contract "Secretary's No. 58261," by substi-
tuting the City of Anaheim for Gelvatex Coatings Corporation
in said agreement, upon the terms and conditions therein set
forth, be and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk be and they are hereby authorized to execute said Supple-
mental Agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 22nd day of October, 1968.
