59R-5671 RESOLUTION NOo 5671 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANMIEIM GRANTING A VARIANCE (NO. 1170). "* WHEREAS. the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the prop- erty owner and/or purchaser of certain real prop- erty situated in the City of Anaheim. County of Orange, State of California. described as follows: Lots 4 to 8, both inc1usiv~. of Block G of the New Subdivision of Vineyard Lot D-5. in the City of Anaheim, County of Orange, State of California, as shown on a map filed in Book 17, Page 72 of Misce1- 1 aneous Records of Los Ange 1 e s County, Ca1 !forn ia. AND WHEREAS. the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on November 16. 19'59 , notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS. said Commission. after due inspection. investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution Noo 112 . recommending to the City Coun- cil of the City of Anaheim that Variance No. -1170 be granted upon t'c1e conditions stated in said resolution; and WHEREAS. the City Council does find that: 10 There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zoneo 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in questIon. 3. That t'c1e granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan 0 NOW TFffiREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to THE PACIFIC TELEPHONE AND TELEGRAPH COMPANY 112S Ninth Avenue, San Diego 1, California, to construct an additionai building west of U:e existing central office building at 217 North Lemon Street, with off-street parl{ing as required by the Anaheim -1- --~"----'~'",-----, ----.".,,~ '""-"-"'"--~~----"-,"""...,-"....,."._",..,...,~~ IVlur.icipal Code, on the property hereinabove described, subject tc the followinr condltions: 1. That the stipulations with reference to parking set forth in a letter from The Pacific Telephone and Telegraph Company to the Honorable City Council, City of Anaheim, dated December 3, 19S9, which lett~r and attachments mentioned tlJ,~r8in are on file with the City of Anaheim, be inc~rporat8d her2in and made a part hereof, by refer- ence, the same as if set forth in full herein, and that all voluntary agreements to be performed by the appli- cant as contained therein are hereby made conditions to the ~1ranting of this variance to be performed in con- nection herewith. The City Council hereby reserves the right to revol{e s1.1ch var'iance permit for good cause or failure of said owner, its success)!'s or assigns, to comply with the Anaheim JVJunicipal Code and regulations and the conditions herein.
