RESOLUTION NO. 5668
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF A.NAHEII"l AUTHORIZING THE GRANTING OF A PER-
PETUAL EASEMENT AND RIGHT OF WAY TO ORANGE
COUNTY FLOOD CONTROL DISTRICT FOR FLOOD CON-
TROL PURPOSES; AND AUTHORIZING THE EXECUTION
OF SAID GRANT OF EASEMENT.
WHEREAS, the Orange County Flood Control District, a
body corporate and politic, has re~lested a perpetual easement
and right or way ror rlood control purposes in, over, and across
the real property hereinarter described; and
WHEREAS, the City Council finds that the granting or
such perpetual easement and right of way in, over, and across
said real property hereinarter described ror the purposes above
set rorth will not interrere with any other contemplated municipal
use of said property.
NOW, TrffiREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that there be, and there is hereby, granted
to the ORANGE COUNTY FLOOD CONTROL DISTRICT, a body corporate and
politic, a perpetual easement and right or way for flood control
purposes in, over, and across the real property situated in the
City of Anaheim, County of Orange, State of California, described
as follows, to wit:
Being a portion or Lot 2 in Block 13 or Fairview
Colony Tracts as per map recorded in Book 1, Page
33 of MisceEaneous Record Maps, records of said
County described as follows:
Beginning at center of Section 21, Township Four
South, Range Ten west, S.B.3. & M., said point
being also the intersection of the centerline of
Cerritos Avenue, )+0 feet wide and Ninth Street,
60 feet wide; thence South 00 33' 10" West 490.38
feet along said centerline or Ninth Street; thence
North 140 47' 01" East 150.65 feet to the begin-
ning of a tangent curve concave Westerly with a
radius of 1400 feet; thence Northerly 347.64 feet
more or less along the arc of said curve to the
centerline or Cerritos Avenue; thence North
890 15' 53" West 80.00 feet, more or less along
said centerline to the point of beginning.
EXCEPTING THEREFROM that portion lying within the
Right or Way of the Southern Pacific Railroad.
Subject to all matters of record.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk
be and they are hereby authorized to execute an Easement Deed to
carry out the purposes of this resolution and to complete the grant-
ing of said easement to the Orange County Flood Control District.
