59R-5658 RESOLU1ION huc 5658 A RESOLU'rION OF 'rHE CITY COUNCIL OF THE CITY OF ANAHEUl i"'IN:Jll~G AND DETERHINIlKr T:'iA'r A CHANGE OF ZONE IS NECESSARY I~ CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM IVITNICIPAL CODE SHOULD BE AlV;ENDED 'fO ACCOMPLISH SAID CHANGE OF ZOKEo WHEREAS) the City Planning CommissIon of the City of Anaheim nas heretofore duly passed and adopted a resolution declaring its inten= tlon to change the boundaries of the zone or zones hereinafter men- tioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and .onduct su<:h public hearing to consider said proposed change of zone or 7,onesy and did receive evidence and reports from persons interested therein~ and WhEREAS, within a period of forty (40) days following the "insl hearing thereon, the Planning Commission did duly announce by f'ormal resol"tion its findings of facts and declare its opinions and reAsons for recommending an amendment to said Article IX. Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the ho'mdaries of the zone hereinafter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of t,hF City Planning Commission, the ~ity Council did thereupon fix the 1st day of December , 19 59 . as the time and the 'COnnc i 1 Chamber in the City Hall of the -crry of' Anaheim as the place for B public hearing upon said proposed change of zone, and did give n001ce thereof in the manner and as provided in said Article IX. Cn,qptsr 2 of t;he Anaheim Municipal Code; and WHEREAS? at the time and place f'ixed for said public hear- ing, the City Council did duly hold and conduct such public hearing Jnd did give all persons interested therei.n an opportunity to be ~~3rd and did receive evidence and reports. and did thereupon con- sider the recommendations of the C1 ty Planning Commission; and WHEREAS, the City Council does find and determine that the prop8rty and area proposed to be changed from the zone in which it is now situated to a differen~ zone. as hereinafter set f'orth. is ~ore suitable for the zone or zones to which it is proposed to .qnge said property and area and that the inclusion of said property Jnd area in such new zone or zones will increase the value of said prOp8rty and area and will not depreciate the values of property 'n c;dj oj ning zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of' Anaheim that all of the property and area situated in the City of Anaheim, County of Orange. State of California, described as rollows, to wit: That portion of Lot 25 of Anaheim Extension. as shown on a map of survey made by William Hamel and filed in the office of the County Recorder of Los Angeles County, California, a copy of which is recorded in Book 3, at page 163, Miscellaneous Maps, records of said Orange County, entitled Los Angeles County Map" in the office of the County Recorder of Orange County described as foll ows: =1= F-59-6o-43 Beginning at the Southwest corner of said Lot 25, said corner for the purposes of this description being considered to be the intersections of the center lines of Los Angeles Street and Ball Road, and running thence North 150 32' 15" West, along the center line of said Los Angeles Street, 160.35 feet; thence North 740 27' 45" East 278.86 feet; thence South 150 32' 15" East, parallel with said center line of Los Angeles Street, 237.40 feet to said center line of Ball Road; thence South 890 54' 30" West, 289.31 feet to the point of beginning. be changed from P-L P~NG-LANDSCAPING 7nNR And C-2, GENERAL COMMERCIAL ZONE, to C-l, IGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road, and a strip of land 53 feet in width, from the center line of the street, along Los Angeles Street for street widening purposes. 2. (a) That all existing improvements, including signals, on Ball Road and Los Angeles Street be removed and relo- cated as required by the City Engineer; and that all engineering requirements of the City of Anaheim, along both Ball Road and Los Angeles Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer and in accordance with plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements and the removal and replacement of the existing improvements on said streets. 3. That the owners of the property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 4. That all of the above conditions, with the exception of Condition No.2 (a), be complied with within a period of 90 days from date hereof, or such further time as the Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper. 1st THE FOREGOING RESOLUTION is signed and approved by me this day of December , 19 59 .
