RESOLUTION NO. 66R-l88
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING RESOLUTION
NO. 62R-972 IN RECL~SSIFlCATION PROCEED-
INGS NO. 62-63-28.
WHEREAS, the City Council did heretofore, to wit,
on October 30, 1962, adopt Resolution No. 62R-972 in Reclassi-
fication Proceedings No. 62-63-28 finding and determining
that the property and area therein described should be changed
from R-A, Residential-Agricultural Zone, to C-l, Neighborhood-
Commercial Zone, subject to certain conditions set forth in said
resolution; and
WHEREAS, the owner of subject property has submitted
plans for the construction of a supplementary building for a
tire sales facility on subject property, and has requested that
certain of the conditions in said Resolution No. 62R-972 be
waived; and
WHEREAS, after careful consideration of the matter, the
City Council finds that due to changes in policy, etc. since the
adoption of said resolution on October 30, 1962, Resolution
No. 62R-972 should be amended as hereinafter provided; and
WHEREAS, the City Council does further find that an
ordinance has never been adopted directing said change of zone
and completing said reclassification proceedings.
NOW THEREFORE BE IT RESOLVED by the City Council
of the City o! Anaheim t~t Resolution No. 62R-972 in Reclassi-
fication Proceedings No. 62-63-28 be, and the same is hereby,
amended as follows:
That Conditions Nos. 5 and 6 be, and the same are
hereby, deleted from said resolution.
That Condition No. 4 of said resolution be, and the
same is hereby, amended to read:
"4. That tree wells shall be installed in the parkway
portion of the Lincoln Avenue right of way abut-
ting subject property; and that plans for said
landscaping shall be submitted to and approved
by the Superintendent of Parkway Maintenance."
That an additional condition be, and is hereby, added
to said resolution, reading as follows:
"That a bond in an amount and form satisfactory to
the City of Anaheim shall be posted with the City to
guarantee the installation of the sidewalks along
Lincoln Avenue, as required in Condition No. 1 hereof,
to guarantee the installation of the tree wells mentioned
in Condition No. 4 hereof, and to guarantee payment of
the fees for street tree planting, said work to be
accomplished and said fees paid at such time as side-
walks are installed either to the east or to the west
of subject property."
BE IT FURTHER RESOLVED that in all other respects said
Resolution No. 62R-972 be, and remain, in full force and effect.
