A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAliEIM FIrmING AND DETERMINIllG THAT AN
AMBIGUITY EXISTS AS TO CERTAIN USES AFFECTED
BY .ARTICLE IX, CHA.PTER 2, OF THE ANAHEIM
MUNICIPAL CODE AND REQUESTING THE PLANNING
COMMISSION TO ASCERTAIN ALL PERTINENT FACTS,
AND BY RESOLU'rIO.rl TO SRI' FOH'l'H ITS FINDINGS
A~D RECOMMENDATIONS PURSUANT TO SECTION
9200.14 OF THE ANAHEIM MUNICIPAL CODE.
WHEREAS, an ambiguity has arisen as to whether or not
certain temporary uses, to wit: the sale of fireworks within a
period of thirty days prior to the Fourth of July and the sale
of Christmas trees within a period of thirty days prior to
Christmas and the installation and operation of amusement
devices, facilities and advertising signs and devices not ex-
oeeding a period of thirty days prior to Christmas and/or New
Years where done for the purposes of obtaining Christmas trade,
are uses intended to be regulated by Article IX, Chapter 2, of
the Anaheim Municipal Code as to location or otherwise; and
WHEREAS, the City Council does hereby request the City
Planning Commission to ascertain all pertinent facts relating to
said above mentioned temporary uses and to ascertain whether or
not Article IX, Chapter 2, of the Anaheim Municipal Code should
be interpreted and construed to include and regulate said
temporary uses as a matter of zoning and to make findings and
by resolution report such findings and a recommendation to the
City Council.
THE FOREGOING RESOLUTION is signed and approved by me
this 17~r day of November, 1959.
