59R-5635 RESOLUTION NO. 5635 A RESOLUTION OF THE CITY COUNCIL OF THE CiTY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY I~ CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE ~lENDED TO ACCOMPLISH SAID CHANGE OF ZONEo WHEREAS, the City Planning Commission of the City of Anaheim has he~etofo~e duly passed and adopted a ~esolution decla~ing its inten- tion to change the boundaries of the zone or zones he~einafter men- tioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and OnmlCt su~h public hearing to consider said proposed change of zone or 7.ones9 and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the f'inal hearing thereon, the Planning Commission did duly announce by f'ormal resol1)tion its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapte~ 2 of the Anaheim Municipal Code to effect the proposed changes in the brylndaries of the zone hereinafter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 17th day of November, 1959 . as the time and the Conncil Chamber in the City Hall of the<rrty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Muni.cipal Code; and WHEREAS, at the time and place fixed for said public hear= ing. the City Council did duly hold and conduct such public hearing snd did give all persons interested therein an opportunity to be beard and did receive evidence and reports, and did thereupon con- sider the recommendations or the City Planning Commission; and WHEREAS. the City Council does f'ind and determine that the property and area proposed to be changed from the zone in which it is now situated to a different ~one, as hereinafter set forth 9 is ~ore suitable for the zone or zones to which i.t is proposed to "Gange said property and area and that the inclusion of said property Bnd area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci ty of Anaheim that all of the property and a~ea situated in the City of Anaheim9 County of' Orange, State of California, described as follows, to wit: Lots 21 and 22, Block "B", of the Lorelei Tract, as shown on a map recorded in Book 29, Page 24, of Miscellaneous Maps, Records of Orange County, California. =1= F-59-60-37 ..'~~ -..- ......... --'~-- "---""'"'^'--.'-.........., .,.."..-........_-~..~ ,-,-', .~~,,_._.~.... That the owner of subject property place of record standard City of Anaheim R-3, Deed Restrictions, approved by the City Attorney. 2. That all requirements of Ordinance No. 1390 of the City of Anaheim, with reference to R-3, MULTIPLE-FAMILY RESI- DENTIAL ZONES, be met, with the exception of lot widths. 3. (a) That the owner of subject property remove the trees and shrubs and the existing curb and sidewalk along South Rose Street, and replace said curb and sidewalk as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the removal of said trees and shrubs and the removal and replacement of said curb and sidewalk. 4. That the owner of subject property pay to the City of Anaheim the sum of $25 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is granted. 5. That Conditions No.1 and 3(b) above mentioned be com- plied with within a period of 90 days from date hereof, or such further time as the Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper. 17th THE FOREGOING RESOLUTION is signed and approved by me this day 01' November , 19 59 .
