3974ORDINANCE NO. 3974 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 1, CHAPTER 1.04, CHAPTER 1.05, CHAPTER 1.16; AND TITLE 13, CHAPTER 13.04 BY ADDING 1001-- NEW SECTIONS 1.04.110, 1.04.1202 1.04.1309 1.04.160, 1.04.2109 1.04.3909 1.05.015 1.05.0209 1.05.0309 1.05.0409 1.05.0509 1.16.010, 13.04. 0309 13.04.040 AND 13.04.050 TO THE ANAHEIM MUNICIPAL CODE RELATING TO THE DEPARTMENTAL ORGANIZATION OF THE CITY OF ANAHEIM. FOLLOWS: THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That new Sections 1.04.110, 1.04.120, 1.04.130, 1.04.160, 1.04.210 and 1.04.390 of Title 1, Chapter 1.04 of the Anaheim Municipal Code be, and they are hereby, added to read as follows: "1.04.110 CITY DEPARTMENTS CREATED. There are hereby created for the govern- ment of the City the following departments: Police Department Fire Department Public Utilities Department Public Works Department Planning Department Parks, Recreation and Community Services Department Finance Department Legal Department Human Resources Department City Clerk Department Library Department Community Development Department Convention Center, Stadium and Golf Department Data Processing Department." 111.04.120 PUBLIC WORKS DEPARTMENT. .010 The Public Works Department shall be under the supervision of the Public Works Executive Director and Superintendent of Streets, which office is created. The Public Works Executive Director and Superintendent of. Streets shall have supervision of the Planning Department." -1- .020 The Public Works Executive Director and Superintendent of Streets shall exercise supervision and control over all City -owned property and equipment, and the maintenance and repair thereof, including all mechanical and mobile equipment, welding, building, fab- rication of metal parts, maintenance of domestic sewers, street cleaning, refuse collection, maintenance of City streets, maintenance of street trees, maintenance of curbs and sidewalks, maintenance of safety devices, maintenance of minor structures, drains and culverts, and other property, except such City -owned properties or equipment as are, by the provisions of this Code, declared to be under the supervision and control of the head of some other City departments. .030 Any and all.engineering functions, as defined by Section 6731 of the Business and Professions Code of the State of California, necessary or required to be performed in connection with any of the above- mentioned public works or properties, shall be done and performed by the City Engineer of the City of Anaheim, or such other registered engineer as may be authorized." 111.04.130 PUBLIC UTILITIES DEPARTMENT. The Public Utilities Department shall be under the supervision of the Public Utilities General Manager, which office is created. The Public Utilities General Manager shall have the supervision of the main- tenance, operation and upkeep of the electrical distri- bution system and the water distribution system of the City." 111.04.160 PLANNING DEPARTMENT - OFFICE OF PLANNING DIRECTOR - CREATED. The Planning Department shall be under the supervision of a Planning Director, which office is created. The Building Division/Center under the supervision of the Planning Department Director shall be headed by the Chief Building Inspector, which office is created. It shall be the duty of the Chief Building Inspector, under the supervision of the Planning Depart- ment Director, to perform all duties required by the Chief Building Inspector in the Building Code of the City (Chapter 15.04 of this Code) and to perform all duties required as Chief Building Inspector under the ordinances of the City." -2- 111.04.210 DEPUTY CITY MANAGER. There is hereby created for the govern- ment of the City the office of Deputy City Manager who shall function as the City Manager of the City in case of absence, death or incapacity of both the City Manager and Assistant City Manager. The Deputy City Manager shall hold the position of a Department Head in the City." "1.04.390 BONDS REQUIRED OF CITY OFFICERS AND EMPLOYEES. .010 Before entering upon the duties of their respective offices, the Finance Director and the City Treasurer of the City of Anaheim shall execute faithful performance bonds to the City in amounts which may, from time to time, be set by the City Council. .020 The following employees shall be bonded under a public employees' faithful performance blanket bond in amounts which may, from time to time, be set by the City Council: City Manager/Acting City Manager Assistant City Manager Deputy City Manager City Attorney City Clerk Public Works Executive Director Chief of Police City Engineer Box Office Manager Collection Officer Assistant Finance Director - Accounting Convention Center/Stadium/Golf General Manager Purchasing Agent. .030 All of the employees not specifically set forth above shall be bonded by a public employees' blanket honesty bond in amounts which may, from time to time, be set by the City Council. .040 Nothing contained in this section shall prohibit the City Council from requiring such other additional bonds for officers and employees as it shall in its discretion deem necessary or desirable." SECTION 2. That new Sections 1.05.015, 1.05.020, 1.05.030, 1.05.040, and 1.05.050 of Title 1, Chapter 1.05 of the Anaheim Municipal Code be, and they are hereby, added to read as follows: -3- "1.05.015 HUMAN RESOURCES DEPARTMENT AND HUMAN RESOURCES DIRECTOR - TITLES AMENDED. Any reference in the Anaheim Municipal Code or the ordinances of the City of Anaheim to Personnel Department and Personnel Director used to describe the Department and Director is hereby amended to 'Human Resources Department' and 'Human Resources Director."' "1.05.020 ADMINISTRATION OF PERSONNEL SYSTEM. .010 The personnel system established by this chapter shall be administered by a Human Resources Director appointed by the City Council. The Human Resources Director, under the direction of the City Manager, shall: .0101 Administer all the provisions of this chapter and of the personnel rules. .0102 Prepare and recommend revisions and amendments to the personnel rules. Such revisions and amendments shall be submitted to the City Council for adoption. .0103 Maintain and administer a position classification plan and a plan of compensation. Positions having similar duties and responsibilities shall be classified and compensated on a uniform basis. .020 The City Council, upon recommendation of the Human Resources Director and the City Manager, may contract with any qualified person or agency for the performance of such technical services as may be necessary for the effective operation of the person- nel system." "1.05.030 SCOPE. .010 All officers and positions of the City are divided into the classified service and the exempt service. The exempt service shall include the following: .0101 All elected officials and members of boards and commissions. .0102 The City Manager, the Assistant City Manager, the Deputy City Manager, the City Attorney, the City Clerk and City Treasurer. -4- .0103 Volunteer personnel and personnel ap- pointed to serve without pay. .0104 Architects, consultants, counsel, and others rendering temporary professional service. .0105 Such positions involving seasonal or part-time employment as may be s:-ecifically placed in the exempt service by the Human Resources Director. .020 The classified service shall include all other positions that are not specifically placed in the exempt service by this chapter. .030 The provisions of this chapter and of the personnel rules shall apply only to the classified service unless otherwise specifically provided." "1.05.040 ADOPTION OF RULES. Personnel rules, prepared by the Human Resources Director (under the direction of the City Manager) subject to this chapter and to revision by the City Council, shall be adopted and may be amended, from time to time, by resolution of the City Council. The rules shall establish specific procedures and regu- lations governing the operation of the personnel system." "1.05.050 APPOINTMENTS. Appointments to vacant positions in the classified service shall be made in accordance with the personnel rules. Appointments and promotions shall be based on merit and fitness to be ascertained so far as practicable by competitive examinations. Examinations shall be used and conducted to aid in the selection of qualified employees, and shall consist of recognized selection techniques which will, in the opinion of the Human Resources Director, test fairly the qualifica- tions of candidates." SECTION 3. That new Section 1.16.010 of Title 1, Chapter 1.16 of the Anaheim Municipal Code be, and it is hereby, added to read as follows: -5- 111.16.010 MANAGEMENT AND SUPERVISION. There shall be established within the City a special division to be known as 'Golfing Division/Center.' This division shall manage, super- vise and control all City golf courses including, with- out limitation, the municipal golf course presently owned by the City (now known as the Anaheim Municipal Course) and all City golf courses later acquired and/or constructed." SECTION 4. That new Sections 13.04.030, 13.04.0409 13.04.050 and 13.04.070 of Title 13, Chapter 13.04 of the Anaheim Municipal Code be, and they are hereby, added to read as follows: "13.04.030 DUTIES OF COMMISSION. .010 Act in an advisory capacity to the City Council, the Boards of Trustees of the School Districts and the Department Head in all matters pertaining to parks and recreation, and to cooperate with other governmental agencies and civic groups in the advancement of sound park and recreation plan- ning and programming. .020 Recommend policies on recreation service for approval of the City Council. .030 Advise with the Department Head on problems of development of recreation areas, facili- ties, programs and improved recreation services. .040 Recommend the adoption of standards on areas, facilities, program and financial support. .050 Have periodic inventories made of rec- reation services that exist or may be needed, and interpret the needs of the public to the City Council, the Boards of Trustees of the School Districts and to the Department Head. .060 Aid in coordinating the recreation service with the programs of other governmental agen- cies and voluntary organizations. .070 Review the effectiveness of the Park and Recreation Program with the Department Head and City Manager. Q:� .080 Interpret the policies and functions of the Parks, Recreation and Community Services De- partment to the public. .O90 Review the annual budget of the Parks, Recreation and Community Services Department before presentation to the City Manager and City Council, and advise the Department Head on the development of the long-range capital improvement program." "13.04.040 PARKS, RECREATION AND COMMUNITY SERVICES DEPARTMENT - CREATED - DUTIES. .010 The Parks, Recreation and Community Services Department is hereby established for the City of Anaheim. .020 The functions of this Department are to provide opportunities for wholesome year-round recrea- tion services for each age group and to develop and maintain, in an attractive manner, the park and recrea- tion areas and facilities of the City of Anaheim, and to insure that such facilities are suitable for a wide variety of recreation purposes." 1113.04.050 DEPARTMENT HEAD - APPOINTMENT - DUTIES. .010 The City Manager shall appoint, subject to the prior review and approval of the City Council, a Department Head to administer the park and recreation program. .020 The Department Head shall attend meetings of the Commission and shall serve as Secretary to the Commission without vote and shall make such reports to the Commission or to the City Council or to the Board of Trustees of the School Districts as shall be required. .030 The Department Head shall: .0301 Be responsible for the administration and operation of the Parks, Recreation and Community Services Department, in accordance with the policies recommended by the Park and Recreation Commission as approved by the �-� City Manager and the City Council, and shall perform the following specific functions within the budgetary limits as approved annually by the City Council and other taxing agencies furnishing money to the Recreation Fund, and provided that all expenditures shall be approved by the City Manager and/or the City Council. -7- .0302 Pecommend for employment required person- nel according; to the standard procedures as set forth by the City of Anaheim and, upon employment, shall supervise them in the performance of their various duties. .0301 Administer, operate, and maintain existing park and recreation areas and facilities and plan for the acquisition, development and operation of proposed facili- ties in accordance with the policies recommended by the Park and Recreation Commission and as approved by the City r4anager and the City Council. .03014 Inform the general public of the services and facilities being provided by the Parks, Recreation and Community Services Department. .0305 Solicit suggestions from the general public to improve or increase the effectiveness of the services. .0306 Cooperate with governmental and voluntary organizations and agencies in the furtherance of recrea- tion opportunities. .0307 Prepare manuals, bulletins and reviews on parks and recreation problems. .0303 Provide upon request assistance of techni- cal nature to community agencies and organizations having problems relating: to park and recreation areas, facilities and programs. .0309 Counsel with officials of public and pri- vate organizations and other interested groups concerning community recreation and leisure activities and assist them in promotion of recreation services. .0310 Conduct studies of local conditions and needs for nark and recreational services and assist with recruitment and training; of recreational personnel. .0311 Prepare a. budget request for the review of the Park and Recreation Commission and present this request to the City manager and the City Council. Said budget shall provide for recreation services and operat- ing costs for the ensuing fiscal year." SECTION 5. The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
