3967ORDINANCE NO. 3967 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 78R-709 determining that a change or changes in the zone or zonesiFereinafter mentioned and described should he made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the southwest quarter of the southwest quarter of Section 8, Township 4 South, Range 10 West, in the Rancho San Cajon de Santa Ana, described as follows: PARCEL 1 (For multiple -residence purposes) - Beginning at the southwest corner of Lot 1, Tract No. 1642, as shown on map recorded in Book 49, page 4, Miscellaneous Pups, Records of Orange County, and running thence North, along the west line of said Tract No. 1642, 518.28 feet to the southeast corner of Lot 8 of Tract No. 2878, as shown on a map recorded in Book 92, page 34, PTis- cellaneous Maps, Records of Orange County; thence North 890 31' 00" West along the south line of said Tract No. 2878, 657.53 feet to the point -1- ATTY-50 78-79-4 where the south line of said Tract No. 2878 inter- sects the east line of Lot 58, Tract No. 1851, as said tract is shown on a map recorded in Book 80, page 41, Miscellaneous Maps, Records of Orange County; thence South'000 16' 39" East, along the -- east line of said Tract No. 1851, 118.00 feet; thence South 890 31' 00" East 26.4.19 feet; thence South 000 11' 09" East 302.13 feet; thence South 890 32'. 53" East 96.00 feet; thence South'131.93 feet to a point that is 180.00 feet north of the northerly line of Lincoln Avenue; thence South 890 31' 00" East, parallel -to and 180.00 feet north of the northerly line of Lincoln Avenue 246.29 feet; thence South 180.00 feet to the north line of Lincoln Avenue; thence South 890 31' 00" East, along the north line of Lincoln Avenue, 49.50 feet to the southwest corner of that parcel shown as "not a part of this subdivision" on the map of said Tract No. 1642; thence North; along the west line of said parcel, 98.04 feet; thence South 890 31' 00." East 23.30 feet; thence North 000 01' 29" West 56.00 feet; thence North 890 31' 00" West 16.80 feet; thence North 000.01' 29" West 41.00 feet; thence South 890 31' 00" East -12.00 feet; thence North 000 01' 29" West 18.70.feet; thence North 890 31' 00" West 23.24 feet to the point of beginning. PARCEL 2 (For commercial purposes) - Beginning at the southwest corner of that parcel shown as "not a part of this subdivision" on said map of Tract No. 1642 and running thence North 890 31' 00" West 49.50 feet along the north line of Lincoln Avenue to, the TRUE POI14T OF BEGINNING; thence North 180.00 feet; thence North 890 31' 00" West, parallel to the north line of Lincoln Avenue, 246.29 feet; thence South 180.00 feet to the north line of Lincoln Avenue; thence South 890 31' 00" East, along the north line of Lincoln Avenue, 246.29 feet to the true point of beginning, now is "PD -C" PARKING DISTRICT -COMMERCIAL, "CL" COMMERCIAL LIIdITED and "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONES and that it be changed to and incorporated in "RS -1200" RESIDENTIAL, MULTIPLE - FAMILY 'LONE, subject to the following conditions: Il. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 2. That the owner(s)-of subject property shall pay the traf- fic signal assessment fee (Council Policy No. 214) amount to $36.00 per each new dwelling unit prior to the issuance of a building permit -2- 3. That prior to the issuance of a building permit, specific landscaping plans for the ten (10) foot setback area between the seven (7) foot block wall along the north, east, and west property lines and the six (6) foot wooden fence enclosing the private patios shall be submitted to the Planning Department for review and ap- proval; that said landscaping shall provide a dense and visually effective plant buffer within two (2) years of planting, and that said landscaping buffer shall minimally consist of broad -headed trees planted twenty (20) feet on centers and interspersed with bushes. 4. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 5. That no driveway onto Lincoln Avenue shall be located closer than 25 feet to the east property line and that the precise location shall be subject to the approval of the City Traffic Engineer. 6. That a seven (7) foot high masonry wall shall be construc- ted along the north property line and those portions of the east and west property lines which abut RS -7200 and RS -A-43,000 zoning. 7. That the twenty (20.) foot wide structural setback between the proposed apartment project and the adjacent RS -7200 and RS -A-43,000 zoning to the north, east, and west shall consist of (a) a ten (10) foot wide densely landscaped area adjacent to the residential zoning and (b) enclosed ten (10) foot deep private patios adjacent to the apartments; that the private patios shall be fully enclosed by six (6) foot high wooden fences; that access to the landscaped area shall be prohibited except for purposes of mainten- ance; and that locked gates to the landscaped area shall be instal- led only where necessary to provide access for maintenance purposes. 8. That sidewalks shall be installed along Lincoln Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. g. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Pub- lic Works. 10.. That subject property shall be served by underground utilities. 11. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 12. That subject property shall be developed precisely in accordance with plans and specifications on file with the City of Anaheim marked Revision Ivo. 2 of Exhibit No. 1 and Revision No. 1 of Exhibit Nos. 2 and 3; provided, however, that all dwelling units located adjacent to the north and east property lines shall be one - bedroom units only. -3- 13. That Condition Nos. 5,'6, 7, 8, 9, 10, 11 and 12, above- mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
