3961ORDINANCE NO. 3961 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM M17NICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 73R-248 & 74R-209 determining that a change or changes in the zone or zoneshereinaftermentioned and described should he made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to.the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, -amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Those portions of the North half of Section 6, Township 4 South, Range 8 West, San Bernardino Base and Meridian, described as follows: PARCEL 1: Beginning at the most Westerly corner ooft the -and described in Parcel 1 in the deed to David D. Peterson and wife, recorded December 3, 1958, in Book 4502, Page 132, Official Records, in the office of the County Recorder of said Orange County, said point being distant South 29°-.44' 00" West 128.00 feet from the most Westerly corner of that certain 12.745 acre parcel shown on a I•iap of Survey recorded in Book 22, Page 11, Record of Surveys, in the office of the County Recorder of said Orange County, and running thence South 43°.. 25' 40" East, along the Southwesterly line of said land conveyed to Peterson, 168.00 feet; thence -1- ATTY-50 72-73-51(33) South'29° 44' 00" West 154.90 feet; thence North 480 16' 00" West 65.08 feet -to- the beginning of a tangent curve concave Easterly and having a radius of 110.00 feet; thence Northerly along said curve through a central angle of 780 00' 00 an arc dis- tance of 149.75 feet, a radial line through said point bearing South'60* 16' East; thence North'600 16' West 10.00 feet to a point -in the Southeasterly line'of the land described in the deed recorded June'24, 1948, in Book 1658, Page'505, Official Records,- in the office of the County Recorder of said Orange County; thence North 29° 44'. 00" East, along said Southeasterly line,' 82.44 to the point of beginning, now is "RS-A-43,000(SC) RESIDENTIAL/AGRICULTURAL (SCENIC CORRIDOR OVERLAY) ZONE and that it -be changed to and incorporated in "RS-HS-22,000(SC)" RESIDENTIAL, SINGLE-FAMILY HILLSIDE (SCENIC COR- RIDOR) ZONE, subject to the following conditions: 1. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities,, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the office of the City En- gineer, at thetime the property is developed. 2. That -the owrier(s.)- of subject property shall install street lighting on all streets within thearea as -required by the Director of Public Utilities at the time the property is developed. 3. That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the requirements of the Director of Public Utilities. - 4. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient. -grading is required to necessitate'a grading permit, no work on grading will be permitted between October 15th and April 15th unless -all required off-site drainage facilities have been installed and are operative. Positive assurance shall be pro- vided the City that such drainage facilities will -be completed prior to October 15th. Necessary right-of-way for off-site drainage facilities shall be dedicated to the City, or the'City Council shall have initiated condemnation proceedings therefor (the costs -of which shall be borne by the developer) prior to commencement -of grading operations.- The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher prop- erties -through said property to ultimate disposal as -approved by the City Engineer. Said drainage facilities shall be the first -item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to theulti- mate point of disposal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. -2- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which'it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning 2la,p, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation,rinted, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
