66-381RESOLUTION NO, 66R -381 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1779 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from 0 L DGER T. SMITH owner of certain real property situated in the. City of Anaheim, County of Orange, State of California, described as follows> That portion of the land allotted to A. S. Van de Graaf in Decree of Partition of the Rancho Santiago de Santa Ana, rendered in Case No. 1192 and entered September 12, 1868 in book "B" page 410 of Judgments of the 17th Judicial District Court of California, in the City of Anaheim, County of Orange, State of California, together with that portion of Lot 6 of the Travis Tract in said City, as per map recorded in book 5 page 120 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California, described as a whole as follows: Beginning at the northeast terminus of that certain course in the center line of Katella Avenue described as having a length of 767.98 feet in Parcel A of the deed to the County of Orange recorded in book 3906 page 231 of Offi- cial Records, in the office of the County Recorder of said Orange County; thence at right angle to said certain course, North 40° 13' 41" West 60.00 feet to a point on a non- tangent curve concave southeasterly having a radius of 1060.00 feet, a radial line to said curve at said point bears South 40° 13' 41" East; thence northeasterly 53.14 feet along said curve through a central angle of 2° 52' 20 thence North 21 30' 22" East 31.23 feet; thence North 36° 03' 15" West to a line parallel with and northwesterly 210.00 feet from said course described as having a length of 767.98 feet; thence South 49° 46' 19" West to a line parallel with and southwesterly 150.00 feet from the course described above as having a bearing of North 36° 03' 15" West; thence South 36° 03' 15" East to a line bearing South 49° 46' 19" West from the point of beginning; thence North 49° 46' 19" East to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on A ril 11, 1966 notice of which said public hearing was duly given as required by law and the provi- sions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1997, Series 19 65 -66 recommending that Variance No, 1779 be denied ;and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denvina said variance, and said appeal was set for public hearing on May 24 1966 at 7 :00 o'clock P.M. at the City ell In the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 14.76 of the Anaheim Municipal Cade; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. That the granting of such variance will not be materially detrimental to the public welfare .or injurious to the property or improvements in such vicinity and zone in which the property is located. 14. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, end the same is hereby granted permitting waivers of the following Anaheim Municipal Code limitations: (a) The number of free standing signs (Section 18.62.090(b -1)); (b) The location of free standing signs (Section 18.62.090(5)); and (c) The maximum area of a free standing sign (Section 18.62.100(b -1)); on the property hereinbefore described, subject to the following conditions: 1. That the proposed additional sign shall be located 32 feet northerly of the location noted on Exhibit No. 1 on file with the City of Anaheim. 2. That a letter of approval shall be obtained from the adjacent property owner. 3. That adequate clearance of existing electrical lines shall be provided as required by the Electrical Division of the Utilities Department and the State of California G.O. 95. 4. That subject property shall be developed sub- stantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner hi heirs, successors or assigns, to comply with the Ana Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
