WIiidiEAS, the City Planning Co~rrnission of the City of Anaheim did receive a petition for zoning variance from the O~TJer of certain real property situated in the City of Anaheinl, County of Oran~e, State of California, described as f'ollows: PAECEL 1: That portion of Lot 26 of Analleim Extension, in the City of Anaheim, County of Orange, State of California, as sho,m on a map of survey made by William Hamel and 1'iled in the 01'fice of the County Recorder of Los Angeles County, California, a copy of which is sho"m in 300k 3, pa#es 163 et seq, entitled "Los Angeles County Maps , in the off'ice of the County Recorder of said Orange County, described as 1'ollows: Beginning at a point on the northeasterly line of' said Lot 26, 323.19 feet North 150 321 15" West from the southeast corner of said Lot 26, said southeast corner being the intersection 01' the center line of Los Angeles Street with the center line of Ball Road as sho}m on said map; thence North 150 32' 15" West along the northeasterly line of said Lot 26 to a point 120.00 feet southeasterly of the northwesterly line of that certain parcel of land described in deed recorded :i:Jovember H, 1946 in Book 1456, page 555 of Offic~al Records of said Orange County; thence South 74 20' 15" West, parallel with said northwesterly line, 200.00 feet; thence South 150 32' 1511 East, parallel with the northeasterly line 01' said Lot, 60.00 feet; thence North 740 20' 15" East 200.00 1'eet to the point 01' beginning. Stoll and wife; thence North 150 32' 15" West along the northeasterly line or said Lot 26, 110.00 feet to the point of beginning, AND WHEREAS, the City Pl8nning Commission did hold a public hearing at the City Hall in the City or Anaheim upon said petition on September 21, 1959, notices of which said public hearing wer'e duly given as required by law and the pro- v:!sions of Section 9200.17 or the Anaheim IvIunicipal Code; and WHEhEAS, said Commission, arter due inspection, investigation and studies made by itself and in its behalr and after due consideration of all evidence and reports orrered at said hearing, did adopt its Resolution No. 60, recommending to the City Council of the City of Anaheim that Variance No. 1149 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does rind that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the prop- erty involved or to the intended use or the property that do not apply generally to the property or class or use in the same vicinity and zone. 2. That such a variance is necessary ror the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. 'rhat the granting of. such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of' such variance will not adversely affect the comprehensive general zoning plan. NOW,THEBEFORE, BE IT RESOLVlID by the City Council or the City or Anaheim that a conditional zoning variance be, and the same is hereby granted to J. DTI~1EL, 4118 Guinida Lane, Anaheim, California to operate a new and used retail automobile -2- sales and service on the property hereinabove described, Tor a period of three (3) years from date hereof, subject to review at the end of said three-year period in the event permanent buildings have not been constructed and development completed in accordance with the plans presented to the City Council and on file Hith the City of Anaheim, and subject also to the followin conditions: 1. That the owner of the pr>operty deed to the C:Tty of Anaheim a strip of land 53 feet in width, from the center line of the street, along So. Los Angeles Street for street widening purposes. 2. That the P-L, PARKING-LANDSCAPING ZONE, along Los Angeles Street be waived. 3. That sidewalks be installed as required by the City Engineer and in accordance with plans and specifications on file in the office of the Ci ty Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said sidewalks. 1;.. That the property be developed in accordance with the plans this day submitted to the City Council and on file with the City of Anaheim. 5. That the owner of the property pay to the City of Anaheim the sum of 'y2.00 per front foot for street lightin~ purposes. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns, to comply with the Anaheim l:unicipal Code and regulations and the conditions herein. Said vax'iance is granted for a parioe. of three (J) years from date hereof subject to review at the end of said three-year period in the event permanent buildings have not been constructed and development completed in accordance with the plans presented to the City Council and on file with the City of Anaheim as hereinabove mentioned.
