3931ORDINANCE NO. 3931 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SECTION 18.01.190 OF CHAPTER 18.01 AND SUBSECTION 18.06.060.0233 OF CHAPTER 18.06, AND ADDING NEW SECTION 18.06.090 TO CHAPTER 18.06, TITLE 18, OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 18.01.190 of Chapter 18.01, Title 18, of the Anaheim Municipal Code be,. and the same is hereby, amended by the .addition of definitions of "drive-through restaurant" and "fast food restaurant" thereto, to read as follows: "Restaurant, Drive -Through. Any establishment which is engaged in the business of preparing and purveying food where provision is made for serving of food to patrons in vehicles for consumption at a separate location either on or off the premises." "Restaurant, Fast .Food. Any establishment which is engaged in the business of preparing and purveying food where said food is customarily ordered by patrons while standing at a window or counter located inside the building regardless of the manner in which said food is thereafter served or whether said food is consumed on the premises." SECTION 2. That .Subsection 18.06.060.0233 of Chapter 18.06, Title 18, of the Anaheim Municipal Code be, and the same is hereby., amended to read as follows: 11'.0233 Restaurants --Walk up, Drive-in, Drive- through, Fast Food: One (1) space per each sixty (6.0). square feet of building gross floor area." SECTION 3. That new Section 18.06.090 be, and the same is hereby, added to Chapter 18.065 Title 18, of the Anaheim Municipal Code, to read as follows: -1- 1118.06..090. DRIVE-THROUGH RESTAURANT LANE REQUIREMENTS. All drive -.through lanes in any restaurant with a drive-through window shall comply with the "^ provisions hereinafter specified. The .term "drive- through lane" as used in this section shall mean any lane,. route 'or path to which vehicles are directed expressly for the purpose .of serving food to patrons while in said vehicles for consumption at -a separate location either on or off the .premises.. .010. Each drive-through lane shall be 'a separate lane from the .circulation routes: -and lanes necessary for ingress to, or egress from, the property or access to any off-street parking spaces. Each such lane shall be striped, marked or otherwise distinctively delineated. .020 Each drive-through lane which utilizes a separately located ordering device shall have a minimum distance of 60.feet between the .start of said lane and such ordering service .and an addi- tional minimum distance. of 10G.feet between such ordering device and the service window or area. Said distances shall be measured along the centerline of the :prescribed vehicular path.' .030 Each drive-through lane which does -not utilize a separately located ordering device shall have a minimum distance of 140 feet. between the start .of said lane and the :service window or area. Said distance shall be. measured along the centerline of the prescribed vehicular path." SECTION -4. SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph,' sentence .or word of this chapter of the .Code hereby adopted be declared for any reason to be.Invalid, it is the .intent of the Council that it would have passed all other portions of thus chapter independent of the .elimination herefrom of any .such portion as may bedeclared invalid. SECTION 5. The City Clerk shall certify to the passage of this ordinance and shall cause the sameto be printed once within fifteen (1.5) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after. its final passage, it -shall take effect and be in full force. -2- THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 31s't day of October _ , 1978.
