59R-5575 RESOLUTION NO, 5575 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE NO.. 1144 WHEREASg the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the prop- erty owner ~ of certain real prop- erty situated in the City of Anaheim, County of Orange, State of California. described as follows: Lots 3 and 4 in Block "A" of Tract No. 13, as shown on a map recorded in Book 9, Page 12, of Miscellaneous Maps, records of Orange County, California. Excepting therefrom the North 216 feet of the West 404.62 feet (said distances being measured to the center line of the streets adjoining on the North and on the West). (Said property is located at 218 Brookhurst Street, Anaheim, California.) A1~ WHEREAS. the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on September 8. 1959, notices of which said public hearing were duly given as required by law and the provisions of Section 9200017 of the Anaheim Municipal Code; and WHEREAS. said Commission. after due inspection. investiga- tion and studies made by itself and in its behalf and after due considerati.on of all evidence and reports offered at said hearing, did adopt its Resolution No. 4,7. recommending to the City Coun- cil of the City of Anaheim that Variance No. 114.4 be granted upon the conditions stated in said resolution; and WHEREAS. the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply zenerally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in quest1.on. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4" That the granting of such variance will not ad- versely affect the comprehensive general zoning plan 0 NOW 'fHEREFORE, BE IT RESOLVED by the City Counci 1 of the City of Anaheim that a conditional zonin:; variance be, and the same is hereby granted to DOWIS ACREAGE, a limited partnership, 1160 South Street, Long Beach 5, California, to install two electric signs on the property hereinabove described, one to be installed along Brookhurst Street and one along Lincoln Avenue, subject to the following conditions: ~l- BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owners of said real property, out of General nlnds of the City of Anaheim, the sum of One Dollar ($1.00), THE FOREGOING RESOLUTION is approved and signed by me this day of October , 19.2L- 27th ATTEST: MAYOR~iTY ~~ZZ1i. That said signs shall be set back a minimum of 60 feet from the center line of the street. 2. That the signs shall be erected in conformity with the plans presented to the City Oouncil and on file with the Oi ty of Anaheim, and shall have a ground clearance of 12 feet and an over-all height of 20 feet and 3 inches. 3. That the lights on the lCU'ge sign now located on said property shall be turned off each evening not later than 9:00 o'clock P. M., and said large sign shall be removed from the property when the new market is constructed. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner____, its ~P8. successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
