59R-5573 RESOLUTION lW" 5573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TPiliT A CHANGE OF ZONE IS ~ECESSARY l~ CERTAI~ AREAS OF THE CITY, AND THAT ARTICLE IX. CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE" WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tIon to change the bOllndaries of the zone or z ones hereinafter men- tioned and described and did fix a time and place for the holding of a plJblic hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code. and did duly hold and .onduct su<~h public hearing to consider said proposed change of zone or 7.ones9 and did receive evidence and reports from persons interested Lherein; and WHEREAS, within a period of forty (40) days following the "inal hearing thereon. the Planning Commission did duly announce by lormal resol'ltion its i'indim,;s of facts and declare its opinions and reasons for recommending an amendment to said Article IX. Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the ~ry]ndaries of the zone hereinai'ter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of t~h8 City Planning Commi ssion, the (;i ty Council did thereupon fix the . 27tA day of Oc~of.er , .1959 . as the time and the Council Chamber in the i y Hall of the"""'lrrty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof' in the manner and as provided in said Article IX9 Chapter 2 of the Anaheim Municipal Code; and WHEREAS" at tne time and place lixed for said public hear- ing, the City Council did duly hold and conduct such public hearing ~nd did give all persons interested therein an opportunity to be reard and did receive evidence and reports, and did thereupon oon- "ider the recommendations of the City Planning Commission; and WHEREAS, the City Council does f'ind and determine that the property and area proposed to be changed from the zone in which it lS now situated to a different ~one. as hereinafter set f'orth9 is ~ore suitable i'or the zone or zones to which it is proposed to (hangs said property and area and that the inclusion of' said property Bnd area in sl1ch new zone or zones will increase the value of' said property and area and will not depreciate the values of property in 8djoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci ty or Anaheim that all of the property and area situated in the City of Anaheim, County of Orange. State of California, described as i'ollows, to wit: That portion of Lot 10 of Miles RanCho, in the City of Anaheim, COlmty of Orange, State of California, as shown on a map thereof recorded in Book 4, Page 7, Miscellaneous Maps, records of said Orange County described as follows: ' ~l~ F-59-60-32 Beginning at a point in the center line of La Palma Avenue distant thereon North890 421 00" East 98 feet from the intersection with the center line of West Street and running thence North 890 42' 00" East along said center line of La Palma Avenue 65 feet; thence North 00 29" 10" West parallel with said center ~ine of West street 160 feet; thence South 890 42' 00" West parallel with said center line of La Palma Avenue 65 feet; thence South 00 29' 10" East 160 feet to the point of beginning. be changed from R.A RESIDENTIAL-AGRICULTURAL ZONE, to C-l, NEIGHBORHOOD-CO~1MERGfAL ZON~, upon the 10110w~ng conal~lons: 1. That the owners or subject property deed to the City of Anaheim a strip or land S3 feet in width, from the center line of the street, along La Palma Avenue for street widening purposes. 2. (a) Ynat all engineering re~lirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. J. That the owners of subject property pay to the City of Anaheim the sum of ~2.00 per front foot for street lighting purposes. 4. That the owners of subject property place of record standard City of Anaheim C-l Deed Restrictions approved by the City Attorney. 5. That all of the above conditions, with the exception of condition No. 2(a) be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
