59R-5572 RESOLUTION NOo 5572 A RESOLU'I'ION OF l'HE CITY COUNCIL OF THE C1TY OF A1AHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE ~,ENDED TO ACCOMPLISH SAID CHANGE OF ZONE" WHEREAS, the City Planning CommissIon of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tion to change the boundaries of the zone or zones hereinafter men- tioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and onduct su<~h public hearing to consider said proposed change of zone or ~ones, and did receive evidence and reports from persons interested therein~ and WHEREAS, within a period of forty (40) days following the nlnal hearing thereon, the Planning Commission did duly announce by romal resobtion its findings of facts and declare its opinions and reRsons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the ~oundaries of the zone hereinafter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of ~he City Planning Commission, the City Council did thereupon fix the . 27th day of October . 1959 . as the time and the Conneil Chamber in the City Hall of thec;rry of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX9 Chapter 2 of the Anaheim Municipal Code; and WHEREAS. at the time and place fixed for said public hear~ :ng, the City Council did duly hold and conduct such public hearing ~nd did give all persons interested therein an opportunity to be beard and did receive evidence and reports. and did thereupon con- sider the recommendations of the City Planning Commission; and a portirn of WHEREAS. the City Council does find and determine that/the property and area proposed to be changed from the zone in which it is now situated to a different zone. as hereinafter set forth. is Fore suitable for the zone or zones to which it is proposed to (';ange sai d proper"ty and area and that the inclusion of said property And area in such new zone or zones will increase the value of said property and area and will not depreciate the values or property in adjoining zones. NOW, rHEREFORE, BE IT RESOLVED by the City Council of the City of' Anaheim that all of the property and area situated in the City of Anaheim. County of Orange. State of California. described as follows, to wit: The West 480 feet of that portion of Section Twenty, Township 4 South, Range 10 West, S.B.B. & M., described as follo\Ojs: Connnencing at a point in the West boundary line of said Section 20, said point being 952.6 feet South of the Northwest corner of said Section 20; thence East 1331.6 feet; thence South 472.8 feet; thence West 1330.9 feet to the Section line; thence North along the Section line 472.8 feet to the point of beginning. ~1"", F-59-60-3l remain in R-A, RESIDENTIAL AGRICULTURAL ZONE, in which it is now incorporated, with the EXCEPTION of the West 150 feet there- of, and that the West 150 feet of said property, measured from the easterly right of way line of Brookhurst Street, be changed to C-l, NEIGHBORHOOD-C~~ERCIAL ZONE, upon the following con- ditions: 1. That the owner of subject property place of record standard City of Anaheim C-l Deed RestrJction-s, approved by the Ci ty Attorney, which re'strictions shall limit the uses of the property to Banks, f,edical and Dental Offices, PharmaCies, Professional Offices, Non-Retail Service Businesses, and any uses except Restaurants, which may hereafter be authorized and permitted under future zoning of the City of Jmaheim in the proposed C-7, Business and Pro- fessional Office Zones. 2. That the owner of subject property deed to the City of Anaheim a strip of land 60 feet in width, from the center line of the street, along Brookhurst Street for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that 8 bond in an amount and fonn sat! sfactory to thE: Cit:y of Anaheim be posted with the C1 ty to guarantee the installat ion of said enGineering requirements. 4. That the owner of subject property pay to the City of Anaheim He SUf:1 of $2.00 per front foot for street lighting purposes. 5. That all of the above conditions, with the exception of Condition No. 3(a), be complied with within a period of 90 days from date hereof, or such further time 85 the Council may grant. BE IT FURTHER EESOLVED Uat the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to ArticlE IX, Chapter 2 of the Anahein l",unicipal Code to amend said Anaheim Iv;unicipal Code to. accon:plish the object herein found and determined to be necessary and proper.
