59R-5570 RESOLUTION NO~ 5570 A RESOLUnON OF ThE CI'rY COUNCIL OF THE CITY OF ANAHEU'1 1<'INDIhG AND DETERHINING 'I'HAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM IVlUNICIPAL CODE SHOULD BE AJII1ENDED TO ACCONPLISH SAID CHANGE OF ZO~Eo WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tion to change the boundaries of the zone or zones hereinafter men- tioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code. and did duly hold and _onduct sli'~h public hearing to consider said proposed change of zone or ~ones9 and did receive evidence and reports from persons interested t-herein, and WHEREAS, within a period of forty (40) days following the f'jnal hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX. Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the "o1mdaries of the zone hereinafter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of th8 City Planning Commission, the City Council did thereupon fix the 27th day of October , 19 59 , as the time and the Council Chamber in the City Hall of the""lITty of' Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX. Chapter 2 of the Anaheim Municipal Code; and WHEREAS 9 at tne time and place f'ixed ror said public hear- ing, the City Council did duly hold and conduct such public hearing 8nd did give all persons interested therein an opportunity to be ~eard and did receive evidence and reports. and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed rrom the zone in which it 1s now situated to a different zone. as hereinafter set forth. is more suitable for the zone or zones to which it is proposed to ~hange said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The South 70 feet of the following described land: Beginning at a point on the east line of Section 18, Township L~ South, Hange 10 ',.{est, San Bernardino Base and Meridian, 5C chains North of the southeast corner of said section, and running thence West 8.77 chains; thence North 11.41 chains; thence East 8.77 chains; thence South 11.41 chains to the point of beginning. EXCEPTING THEREFROf.j that portion of said land included =1= F-59-60-29 within Tract 2928, as shown on a map thereof recorded in 8001, 95, Pages 13, ILi and 15 of Hisce11aneous Maps, ~ecords of Orange County, California. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to C-l, NEIGHBORHOOD-CO~~1ERCJAL ZONE, upon the following conditions: 1. That the owners of subject property place of record standard City of Anaheim C-l Deed Restrictions, approved by the City Attorney. ~. That the owners of subject property deed to the City of Anaheim a strip of land 60 feet in width, from the center line of the street, along Brookhurst Street, for street widening purposes. 3. (a) That sidewalks be installed as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted \-lith the City to guarantee the installation of said sidewalks. 4. That the buildings to be erected on subject property shall be constructed in conformity with the plot plans this day submitted to the City Council, made a part of this reclassification, and on file with the City of Anaheim. ~ ". Tl:at the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 6. That all of the above conditions, with the exception of Conditions Nos. 3(a) and 4, shall be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER HE SOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the .~aheim Municipal Code to amend said Anaheim Hunicipal Code to accomplish the object herein found and determined to be necessary and proper.
