66-270WHEREAS the City Council of the City of Anaheim is desirous of estab a right of way for street and public utility purposes over certain described real property, said right of way to be designated "Pacifico Avenue and WHEREAS, said right of way is necessary in order to provide proper traffic circulation and utility services because of the industrial development in the area as well as the con- struction of a major multi- purpose sports stadium in said area; and RESOLUTION NO. 66R- 27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM BY WHICH THE CITY AGREES TO INSTALL CERTAIN STREET AND OTHER PUBLIC IMPROVEMENTS IN CONSIDERATION FOR THE DEDICATION BY CERTAIN LANDOWNERS OF A CERTAIN DESCRIBED RIGHT OF WAY FOR STREET AND PUBLIC UTILITY PURPOSES. WHEREAS, the aforementioned proposed right of way, designated "Pacifico Avenue," has been approved as a proposed right of way for street and public utility purposes and has been heretofore adopted by the City of Anaheim as a part of the Circulation Element of the General Plan of the City of Anaheim; and WHEREAS, the aforementioned right of way, designated "Pacifico Avenue," is proposed to extend from Anaheim Boulevard on the west to State College Boulevard on the east, over, under, across and through that area of real property located between Katella Avenue on the north and Orangewood Avenue on the south, the location of which is as more specifically set forth on the Circulation Element of the General Plan; and WHEREAS, the City Council finds and determines that it is necessary that "Pacifico Avenue" be improved to its ultimate width and length as designated on said General Plan as soon as it is possible to accomplish said improvement. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that in consideration for the dedication by owners in fee of an easement for street and public utility purposes to be known as "Pacifico Avenue," the City of Anaheim agrees to install the following improvements and perform the following work: 1. Perform all engineering drawings; 2. Perform all necessary grading; 3. Construct all necessary paving; 4. Install all necessary curbs and gutters. BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that said City shall not be obligated to perform the improvement work described herein until such time as the City has received dedication of the aforementioned easement, to be known as "Pacifico Avenue," for the full width and length as set forth on the Circulation Element of the General Plan of the City of Anaheim and until such time as said City has obtained a right to cross any railroad right of way by said "Pacifico Avenue" in a manner satisfactory to said City. BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that nothing contained herein shall be con- strued to relieve any person of any obligation for the payment of any sewer or utility charges or fees heretofore or hereafter imposed by the City Council of the City of Anaheim.
