86R-042 RESOLUTION NO. 86R-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 3524. WHEREAS, after a request for variance by AHMED JAHANPANAH, et al., 520 North Rexford Drive, Beverly Hills, California 90210, owner, and MAGDY HANNA, 4000 MacArthur Boulevard, #680, Newport Beach, California 92660, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3524 was denied covering the following described property: A PORTION OF LOT 7 IN BLOCK 17 OF A SUBDIVISION OF THE SOUTH HALF OF SECTION 21, IN TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO LOS BOLSAS, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 51 PAGE 7 AND FOLLOWING MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID ORANGE COUNTY, AND AS SHOWN ON A MAP RECORDED IN BOOK 1 PAGE 33 OF MISCELLANEOUS RECORDS OF LOS ANGELES COUNTY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT 7; THENCE NORTH 00 49' 20" EAST 669.60 FEET ALONG THE WEST LINE OF SAID LOT TO THE NORTHWEST CORNER THEREOF; THENCE SOUTH 890 43' 50" EAST 339.00 FEET ALONG THE NORTH LINE OF SAID LOT; THENCE SOUTH 00 33' 10" WEST 668.87 FEET TO THE SOUTH LINE OF SAID LOT 7; THENCE NORTH 890 51' 10" WEST 340.40 FEET ALONG SAID SOUTH LINE TO THE POINT OF BEGINNING. EXCEPT THE WEST 150.00 FEET THEREOF. ALSO EXCEPT THE NORTH 300.00 FEET THEREOF. ALSO EXCEPT THEREFROM AN UNDIVIDED 4/5THS INTEREST IN THE SOUTH 50.00 FEET OF THE EAST 12.5 FEET OF SAID LAND; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there no special circumstances applicable to the property which do not apply to other property in the same vicinity and zone. 2. That strict application of the zoning code does not deprive the property of privileges enjoyed by other property in the same vicinity and zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said Variance be, and the same is hereby, denied. BE IT FURTHER RESOLVED that the time within which rehearings must be sought is governed by the provisions of Section 1.12.100 of the Anaheim Municipal Code and the time within which judicial review of final decisions must be sought is governed by Section 1094.6 of the Code of Civil Procedure and Anaheim City Council Resolution No. 79R-524. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 28th day of January, 1986.
