3924ORDINANCE NO. 3924 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM M17NICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 73R-248 & 74R-20.9 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Those portions of Section 6, Township 4 South, Range 8 West, San Bernardino Base and Meridian, described as follows: PARCEL 1: Commencing at a point in that certain curve in the centerline of that certain road ease- ment, now known as Mohler Drive, shown on a map recorded in Book 14, Page 14 of Surveys, records of said Orange County, shown as having a "radius of 902.75 feet", a "central angle of 120 45' 00" and an "arc length of 200.89 feet"; said point being Northwesterly along said centerline 175.47 feet from the Southeasterly terminus of said curve; thence North 650 13' 40" East 264.15 feet to Point "A"; thence North 430 03' 51" West 36.53 feet to the true point of beginning of the boundary of the land herein described; thence continuing North'430 03' 51" West 438.6 feet to the.general Easterly line of'said Mohler Drive; thence at right angles to said centerline North 590 40' 00" West 20.00 feet to the Northeasterly terminus of the course ATTY-50 -1- 72-73-51(31) in said centerline shown as 115301 20.1 West 117.68 feet"; thence along said centerline and the bound- ary of the 1115.969/acre parcel" shown on said survey the following courses and distances; Northerly along a curve concave Westerly having a radius of 391.00 �.., feet, through a central angle. of 400 421 0011, an arc distance of 277.75 feet; thence South 420 191 00" East 178.60 feet; thence South 210 481 0011 East 103.62 feet; thence South 320 53`0011 East 85.27 feet; thence South 510 371 00t1 East 151.78 feet; thence South '14° 541 4611 West 211.36 feet to the true point of beginning, now is "RS-HS-43,000(SC)" RESIDENTIAL, SINGLE-FAMILY HILLSIDE (SCENIC CORRIDOR OVERLAY) ZONE and that .it be changed to and in- corporated in 'IRS-HS-22,00.0(SC)" RESIDENTIAL, SINGLE-FAMILY HILL- SIDE (SCENIC CORRIDOR OVERLAY) ZONE, subject to the following conditions: 1. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the office of the City En- gineer, .at the time the property is developed. 2. That the owner(s) of subject property shall install street lighting on all streets within the area as required by the Director of Public Utilities at the time the property is developed. 3. That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the requirements of the Director of Public Utilities. 4. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient .grading is required to necessitate a grading permit, no work on grading will be permitted between October 15th and April 15th unless all required off-site drainage facilities have been installed and are operative. Positive assurance shall be pro- vided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off-site drainage facilities shall be dedicated'to the City, or the City Council shall have initiated condemnation proceedings therefor (the costs of which shall be borne by the developer) prior to commencement .of grading operations. The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher prop- erties through said property to ultimate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ulti- mate point of disposal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property. upon their request. -2- SECTION 2.. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from th-e zone in which 'it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same 'to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin,. a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect .and be in full force.
