59R-5554 RESOLUTION NO, SSS4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM r'INDING AND DETERI'lINING I'HAT A CHANGE OF ZONE IS NECESSARY I~ CERTAIN AREAS OF THE CITY. AND THAT ARTICLE IX. CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AY1ENDED TO ACCOMPLISH SAID CHANGE OF ZONK WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tion to change the boundaries of the zone or zones hereinafter men- tioned and described and did fix a time and place for the holding of a p1Jblic hearing thereon in the manner and as prescribed in Article IX. Chapter 2 of the Anaheim Municipal Code. and did duly hold and ."onduct such public hearing to consider said proposed change of zone or 7,ones9 and did receive evidence and reports from persons interested therein~ and WHEREAS, within a period of forty (40) days following the rinel hearing thereon. the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reAsons for recommending an amendment to said Article IX. Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the houndaries of the zone hereinafter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the "11th day of October . 1959 , as the time and the Council Chamber in the City Hall of the<rrty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX.. Chapter 2 of the Anaheim Municipal Code; and WHEREAS. at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing qnd did give all persons interested therein an opportunity to be r~ard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth. is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property '1nd area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property 'n sdjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, ~o wit: PARCEL l: That portion of Lot 7 of Anaheim Extension, as shown on a map of survey by Willia~ Hamel acknowledged by Alfred Robinson, trustee, recorded in Los Angeles County, Cali- fornia, described as follows: Beginning at a bolt in the pavement marking the Southeast corner of said Lot 7. and running thence South 740 37' 30" West 293.55 feet along the South line of said Lot 7 to a =1= F-59-60-l9 ,,-..".,;~,.,.,",_____......._, ,."'^_~.. That the owners of subject property place of record standard City of Anaheim C-3 Deed Restrictions, approved by the City Attorney. which restrictions shall limit the C-3 uses of said property to a Motel or to any C-l uses. 2. That the property shall be developed in conformity with the plans submitted to the City Council and on file with tte City of Anaheim. dated October 13. 1959 and signed by Mr. G. L. Hodge. j. That the owners of tfJe property deed to the City of Anaheim a strip of land 53 feet in width. from the center line of the street. along Center Street, for street widening purposes. L~. That the owners of the property pay to the City of .t...naheim the sum of $2.00 per front foot. for street lighting purposes. 5. (a) That sidewalks be installed along Center Street as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City -2- of Anaheim be posted with the City to guarantee the installation of said sidewalks. ~.
