RESOLUTION NO. 86R-63
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT.
(85-4A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 18th day of February, 1986, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of a public
utility easement, more specifically described as follows:
THE SOUTHERLY THREE FEET AND THE WESTERLY THREE FEET
OF THAT PORTION OF LOT 3 OF ANAHEIM EXTENSION AS
SHOWN ON A MAP OF SURVEY MADE BY WILLIAM HAMEL AND
FILED IN THE OFFICE OF THE COUNTY RECORDER OF LOS
ANGELES COUNTY, A COpy OF WHICH IS RECORDED IN BOOK
3, PAGE 163 AND FOLLOWING, ENTITLED "LOS ANGELES
COUNTY MAPS" IN THE OFFICE OF THE COUNTY RECORDER OF
SAID ORANGE COUNTY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 3,
BEING THE POINT OF INTERSECTION OF THE CENTER LINE OF
LA PALMA AVENUE (FORMERLY NORTH STREET) WITH THE
CENTER LINE OF PLACENTIA AVENUE, AS SHOWN ON SAID
MAP; THENCE S 00 DEGREES 07' 30" W ALONG THE CENTER
LINE OF SAID PLACENTIA AVENUE, 200.00 FEET TO THE
NORTHEAST CORNER OF THE LAND DESCRIBED IN THE DEED TO
ANAHEIM COMMUNITY CONGREGATIONAL CHURCH, A
CORPORATION, RECORDED JUNE 9, 1959 IN BOOK 4759,
PAGE 96 OF OFFICIAL RECORDS, THENCE N 89 DEGREES 51'
30" W ALONG THE NORTH LINE OF SAID CHURCH LAND,
203.00 FEET; THENCE N 00 DEGREES 07' 30" E PARALLEL
TO THE CENTER LINE OF SAID PLACENTIA AVENUE 200.00
FEET TO THE CENTER LINE OF SAID LA PALMA AVENUE;
THENCE THENCE S 89 DEGREES 51' 30" E, 203.00 FEET TO
THE POINT OF BEGINNING.
EXCEPT THE SOUTHERLY 3 FEET OF THE WESTERLY 3 FEET
THEREOF.
ALSO EXCEPTING FROM SAID WESTERLY 3 FEET TO BE
ABANDONED THE NORTHERLY 12.00 FEET OF THE SOUTHERLY
54.16 FEET OF THAT PORTION CONTAINED WITHIN THE
UNDERGROUND PUBLIC UTILITY EASEMENT RECORDED JULY 18,
1977 IN BOOK 12294, PAGES 1422 AND 1423 OF OFFICIAL
RECORDS.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 18th day of February~
1986 .
