RESOLUTION NO. 86R-83
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT DEED CONVEY-
ING TO THE CITY OF ANAHEIM CERTAIN REAL PROP-
ERTY FOR AN EASEMENT FOR ROAD AND PUBLIC
UTILITY PURPOSES. (R/W H3292-5A)
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property for
municipal purposes, to wit: An easement for road and public
utility purposes; and
WHEREAS, the owners of said property have offered to sell
and convey the same to the City; and
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of Anaheim
to accept said offer and purchase said real property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the offer of ESIQUIO V. LUNA and LARRY FOX to
sell to the City of Anaheim the following described real property
situated in the City of Anaheim, County of Orange, State of
California, to be used for an easement for road and public utility
purposes, and more particularly described as follows:
Grantor hereby grants a Temporary Construction Easement
together with all reasonable rights of ingress and
egress over the northerly 15.00 feet of the southerly
25.00 feet of Lot 4 as shown on a Record of Survey as
per map filed in Book 82, page 26 of Record of Surveys,
in the office of the County Recorder of said Orange
County for the purpose of the construction and
installation of sanitary sewer facilities over the
southerly 10.00 feet of the above described said Lot 4,
previously dedicated for Sanitary Sewer purposes. Said
Temporary Construction Easement to terminate and shall
become null and void and cease to exist upon completion
of the construction of said sewer facilities,
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a conveyance
of said property; provided, however, that nothing herein shall be
construed to be an acceptance of any parcel or property into the
City street system (Section 1806, Streets and Highways Code).
BE IT FURTHER RESOLVED that the Accounting Officer of
the City of Anaheim be, and he is hereby, authorized to issue a
warrant and pay to the owners of said real property, out of
General Funds of the City of Anaheim and charged to Account No.
ll-790-7l0l-EOsOO the sum of One Hundred Dollars ($100.00) payable
to ESIQUIO LUNA.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 4th day of March, 1986.
