A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA-
HEIR ACCEPTING A SEALED PROPOSAL AND AWARDING A CON-
TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE
FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS
AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL
WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW-
ING PUBLIC IMPROVEMENT: THE IMPROVEMENT OF "RROAD_
WAY STREET. FROM KENMORE STREET TO DAI F. AVF.NffF.

WHEREAS, the City Oouncil of the City of Anaheim did ca~ to
be published in a newspaper of general circulation, printed, published
and circulated in the Oity of Anaheim, to wit: The Anaheim G~v.P.ttP.
on the 1 th and 2 th da ~
a notice invi ing seale proposals ollowing:
All plant, labor, services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and complete in
a good and workmanlike manner, in strict accordance with the
specifications, plans and drawings therefor on file in the office
of the City Engineer or City Clerk of the City of Anaheim, the
following public improvement, to wit: The Improvement of Broad-
way Street, from Kenmore Street to Dale Avenue, by excavation,
including haulaway and disposal of existing material, construction
of plant-mix surfacing per typical section, including paint binder
and weed killer, remodeling of existing driveways, adjusting exist-
ing manholes to grade, adjusting existing driveway culverts to.
grade, lowering existing irrigation line, construction of standard
paddle boards and removal of existing trees, including haulaway
and disposal~ and appurtenant work as indicated on the plans,

in accordance with the design, plans, profiles and specifioations of
said public improvement on file in the office of the Oity Olerk of the
City of Anaheim; and
WHEREAS, said notice inviting sealed proposals for e.aid public
improvement did provide that sealed proposals would be rece~ved by the,
City of Anaheim at the office of the Oity Olerk of the Oity of Anaheim
up to the hour of .6J.QQ...o' clook P.M. on the 1st day of October ,

more partioularly mentioned and desoribed, and whioh notioe did state
and deolare that pursuant to the provisions of Seotion 1770 of the
Labor Oode, the Oity Oo~il of the Oity of Anaheim had asoertained
the prevailing rate of wages in the locality in which this type of
labor is to be performed for eaoh oraft or type of workman or meOhanic
needed to exeoute the contract and did set forth the prevailing hourly
wage scale so ascertained; and

WHEREAS, the Oity Olerk of the Oity of Anaheim did reoeive
the following sealed proposals prior to 2:00 0 t clock P.M. on the

plant, labor, services, me. terials and equipment, all util.i ties ..and

in strict accordance with the specifications, plans and drawin~s there-
far an file in the office of the City Clerk .of the City .of Ananeim,
the public improvement hereinabove mentioned and descri.bed, together
with the appurtenances thereto, and as specified in the rotice.inviting
sealed propasals, and that said propasal of said above named bidder
shauld be accepted and a contract awarded ta said bidder in accordance
therewith; and
WHEREAS, the City Council finds that the above mentianed sealed
praposal is the lowest responsible proposal received and that. the per-
stln, firm .or corporatian submitting said propas.al is a resp.ansible
persan, firm .or carparatian and that the propasal submitted is the
best suited and fitted far the public impravement ta be constructed.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City

AND BE IT FURTHER RESOLVED that the successful bidder .or bidders
upan each cantract awarded as hereinaQQve set farth, shall be, and they
are hereby required ta execute a cantract in the required farm with the
City .of Anaheimupan the terms and conditions specified in the notice
inviting sealed prapasals and the prapasal submitted by said success-
ful bidder .or bidders and in accardance with the plans and specifica-
tians for said public improvement hereinabave described, and in accard-

ance with the terms, conditions and provlslons of this reaalutio~,
and that said successful bidder or bidders to whom each contract is
awarded shall be required to furnish a surety bond in an amount equal
to one hundred per cent (100%) of the contract price for all bbor,
materials and equipment to be furnished and performed~ as s.e.t forth
in the sealed proposal submitted by said bidder for the c.onstruction
of said public improvement, together with the appurtenances the.reit.o
or such portion thereof as is covered by said contract,. as Eecurity
for the faithful performance of said contract and a separate surety
bond in an amount equal to one hundred per cent (100%) of the oon-
struction cost of said public improvement covered by saido'Ontract,
as security for the payment of all persons performing labor.and fur-
nishing material for said projecto
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the City of Anaheim,'..publlc.. .lia-
bility, property damage, compensation, and other insurance~ in the
amounts and for the purposes as set forth and specified in the notice
inviting sealed proposals, and subject to the approval .of the City
Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the. City Clerk
of the City of Anaheim be, and they are hereby~ authorize.d. and
directed to make, execute and enter into,. for and on behalfQf the.
Cl ty of Anahei.m, a. .writt.en.. contract with said successful bid.deror
bidders for the furnishing of all plant; labor, materials., and equip-
ment and performing all work, as hereinabove more particularly des-
cribed, for the construction, installation and completion of said
public improvement hereinabove described upon the terms and canditians
as specified in the notice inviting sealed proposals, the detailed..
design, plans, profiles, drawings and general specifica.tions and.de-
tailed s pecificati oris and drawings, and all addendathereto~and alll
modifications incorporated therein prior to the date of the,. opening
of bids, on file in the office of the City Clerk of the City :'Ot Ana..,.
