A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE CITY
ENGINEER TO APPROVE PLANS AND DESIGNS OF
CONSTRUCTION, OR AN IMPROVEMENT TO,
PUBLIC PROPERTY OR TO APPROVE STANDARDS
FOR SUCH CONSTRUCTION OR IMPROVEMENT AND
RESCINDING RESOLUTION NO. 2007-017
WHEREAS, Section 1.04.120 of the Anaheim Municipal Code does
provide that the City Engineer shall perform any and all engineering functions as
necessary or required in connection with City -owned property, buildings, equipment and
public works, including the construction of all City -owned buildings and public works;
and
WHEREAS, engineering functions includes the review and approval of
plans and designs of construction, or an improvement to, public property or to approve
standards for such construction or improvement; and
WHEREAS, Section 830.6 of the California Government Code does
confer upon public entities an immunity from liability for injury caused by a plan or
design of a construction of, or an improvement to, public property where such plan or
design has been approved in advance of the construction or improvement by the
legislative body of the public entity or by some other body or employee exercising
discretionary authority to give such approval or where such plan or design is prepared in
conformity with standards previously so approved; and
WHEREAS, it is necessary and desirable to authorize the City Engineer to
exercise such discretionary authority.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Anaheim does hereby authorize the City Engineer, or in their absence their
authorized designee, to exercise the discretionary authority to give such approval of all
such plans or projects or to approve standards for such plans or projects.
BE IT FURTHER RESOLVED that the appointment of the current and
future City Engineer be, by the Director of Public Works, approved.
BE IT FURTHER RESOLVED that no City plan or design of construction
of, or an improvement to, City of Anaheim property shall be commenced until such time
as the City Engineer, or their authorized designee, shall affix their signature thereto.
BE IT FURTHER RESOLVED that Resolution No. 2007-017 shall be
rescinded upon the operative date of this Resolution.

Council of the City of Anaheim this 13_ day of February , 2024, by the
