A RESOLUTION OF THE CITY rotJNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 1141.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition for zoning variance from
the Russard Co., owner of certain real propertYQtuated in
the City of Anaheim, County of Orange, State of California,
described as follows:
The Vest 140 feet of that portion of Lot 21 of
Anaheim Extension, City of Anaheim, County of Orange,
State of California, as per Map of Survey made by wm.
Hamel and filed in the office of the County Recorder
of Los Angeles County, a copy of which is shown in
book 3, page 163, et seq., entitled Los Angeles
County Maps, in the office of the County Recorder
of said Orange County, described as follows:
BEGINNING at a point on the Northerly line of said
Lot, said Northerly line being the center line of
Vermont Avenue (formerly Broad Street) Easterly
162.09 feet from the center line intersection of
said Vermont Avenue and Palm Street said point of
beginning being the Northeasterly corner of the
land described in Certificate of Title No. 1155,
thence Southerly along the Easterly line of the
land described in said Certificate of Title and
along the most Easterly line of the 22.8053 Acre
Tract described in Certificate of Title No. 6539
to a point in the South line of said Lot 21 said
South line being the center line of Ball Road
which said point is Easterly 175.85 feet from the
center line intersection of Ball Road and Palm
Street thence Easterly along said center line of
Ball Road to the Southeast corner of Lot 21 thence
Northerly along the Easterly line of said Lot 21 to
the Northeast corner of said Lot 27, thence
Westerly along said center line of Vermont Aven.e
to the point of beginning.
EXCEPT that portion thereof lying Southerly of a
line drawn Easterly across said land parallel with
the Northerly line of said Lot 21 from a point
North 15. 24' West 1342 feet from the Southwest
corner of said land.
Also EXCEPTING that portion thereof lying Northerly
of a line drawn Easterly across said land parallel
with the Northerly line of said lot 21, from a
point North 150 24' West 1436 feet from the Southwest
corner of said land.

AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
August 11, 1959, notices of which said public hearing were
duly given as required by law and the provisions of Section
9200.11 of the Anaheim Municipal Code; and

WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No. 37,
Series 1959-60, granting Variance No. 1141, subject to the
conditions set forth therein; and
WHEREAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken
by the City Planning Commission in granting said variance
and did set a public hearing thereon to be held on the 22nd
day of September, 1959, at 7:00 o'clock P.M. in the City
Hall in the City of Anaheim, and notice of such public
hearing was duly given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the
present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting Variance No. 1141 to the Russard Co.,
5102 Firestone Place, South Gate, California, to erect a
semi-commercial swimming pool on the property hereinabove
described within the front yard setback lines, be and the
same is hereby disapproved, and that Variance No. 1141 be
and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed
by me this 22nd day of September, 1959.
