RESOLUTION NO. a6R-120
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF WATER STREET
EXTENDING EASTERLY AND WESTERLY FROM THE
TERMINUS OF ATCHISON STREET. (8S-l0A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 25th day of March, 1986, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, the City Council does determine that the
public convenience and necessity require the reservation and
exception of the easement(s) and right(s) of way hereinafter
specifically described.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of a portion of
Water Street, more specifically described as follows:
ALL THAT REAL PROPERTY IN THE CITY OF ANAHEM, COUNTY
OF ORANGE, STATE OF CALIFDORNIA, BEING THAT PORTION
OF WATER STREET, 48 FEET WIDE, AS SHOWN ON THE PLAT
OF RESUBDIVISION OF THEODORE REISER'S SUBDIVISION,
RECORDED IN BOOK 1, PAGES 10 AND 11 OF MISCELLANEOUS
MAPS, RECORDS OF SAID ORANGE COUNTY, BOUNDED WESTERLY
BY THE SOUTHERLY PROLONGATION OF THE EASTERLY LINE OF
LOT 2, BLOCK C OF SAID RESUBDIVISION AND BOUNDED
EASTERLY BY THE SOUTHERLY PROLONGATION OF THE
EASTERLY LINE OF BLOCK D OF SAID RESUBDIVISION.
EXCEPTING THEREFROM THAT PORTION THEREOF LYING WITHIN
THAT CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHEAST CORNER OF LOT 5, BLOCK C
OF SAID RESUBDIVISION, BEING THE POINT OF
INTERSECTION OF THE NORTHERLY RIGHT-OF-WAY LINE OF
SAID WATER STREET WITH WESTERLY RIGHT-OF-WAY LINE OF
ATCHISON STREET, FORMERLY ORANGE STREET, 50 FEET
WIDE; THENCE ALONG SAID NORTHERLY RIGHT-OF-WAY NORTH
74 DEGREES 21' 04" EAST, SO.OO FEET TO THE SOUTHWEST
CORNER OF LOT 1, BLOCK D OF SAID RESUBDIVISION AT THE
EASTERLY RIGHT-OF-WAY OF SAID ATCHISON STREET, SAID
POINT BEING THE BEGINNING OF A NON-TANGENT CURVE,
CONCAVE NORTHEASTERLY AND HAVING A RADIUS OF 63.00
FEET, A RADIAL LINE OF SAID CURVE TO SAID POINT BEARS
SOUTH S7 DEGREES 27' 29" WEST; THENCE SOUTHWESTERLY
14.95 FEET ALONG SAID CURVE THROUGH A CENTRAL ANGLE
OF 13 DEGREES 35' 49" TO THE BEGINNING OF A REVERSE
CURVE, CONCAVE NORTHERLY AND HAVING A RADIUS OF 3S.00
FEET; THENCE SOUTHEASTERLY, SOUTHERLY,
SOUTHWESTERLY, WESTERLY, NORTHWESTERLY AND NORTHERLY
144.88 FEET ALONG SAID CURVE THROUGH A CENTRAL ANGLE
OF 237 DEGREES 10' 32" TO THE BEGINNING OF A REVERSE
CURVE, CONCAVE WESTERLY AND HAVING A RADIUS OF 63.00
FEET; THENCE NORTHERLY 16.66 FEET ALONG SAID CURVE
THROUGH A CENTRAL ANGLE OF 15 DEGREES 09' 14" TO THE
POINT OF BEGINNING.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
