A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA-
BEIR ACCEPTING A SEALED PROPOSAL AND AWARDING A CON~
TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE
FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS
AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL .AND WATER, AND PERFORMING ALL
WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW-

WHEREAS, the City Council of the City of Anaheim did cauae to
be published in a newspaper of general circulation, printed, puplished
and circulated in the City of Anaheim, to wit: The Anaheim Gazette

a notioe inviting seale proposals or urnis ing 1:e ollowing:
All plant, labor, services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all wor~ necessary to construct and complete in
a good and workmanlike manner, in strict accordance with the
specifications, plans and drawings therefor on file in the office
of the City Engineer or City Clerk of the City of Anaheim, the
following public improvement, to wit: The Improvement of Cerritos
Avenue, from 1430 feet east of Euclid Avenue to 1350 feet west of
Euclid Avenue, by excavation, including removal of existing
material, haulaway and disposal, construction of two and four-inch
plant-mix surfacing, including paint binder and weed killer, ad-
justing existing manholes to grade, construction of Type liB" curb
and gutter, installation of standard paddle boards, adjusting
existing irrigation line to grade, and appurtenant work as indi-
cated on the plans, Job No. 247,
in accordance with the design, plans, profiles and specifications of
said public improvement on file in the office of the City Clerk of the
City of Anaheim; and
WHEREAS, said notice inviting sealed proposals for said pubUc
improvement did provide that sealed proposals wauld be received by the
City af Anaheim at the affice of the City Clerk of the City of Anaheim
up to the hour of 2..:...Q.Q...o'clock P.M. on the 10th day of Sp.ntP~1'" ,
19..n, for the furnrenrng af all plant, labor, ser:vices, mate:c B,
and equipment, all utilities and transportation, including power, fuel
and water, and performing all work necessary to construct and oomplete
in a goad and workmanlike manner, the public improvement hereinabove
more particularly mentioned and described, and which notioe did state
and declare that pursuant to. the pravisions of Section 1770 of the
Labor Code, the Oity Oo~il of the City of Anaheim had asoertained
the prevailing rate of wages in the lacality in whioh this type of
labor is to be performed for each craft or type of workman or meChanic
needed to execute the contract and did set forth the prevailing hourly
wage 80ale eo asoertained; and

WHEREAS, the City Clerk of the City af Anaheim did receive
the following sealed proposals prior to 2:00 o'clock P.K. on the

WHEREAS, the City Council finds that the above menti.oned sealed
proposal is the lowest responsible proposal received and that the per-
s~n, firm or corporation submitting said proposal is a resp.onsible
person, firm or corporation and that the prop.osal submitted.is the
best suited and fitted for the public improvement to be constructed.

NOW, THEREFORE, BE IT RESOLVED by the CitW Council of the City
of Anaheim, that the sealed proposal submitted by COX BROS. CONSTRUCTION
CO.. p. O. Box "C". Stanton. Cal ifornia
for the furnishing of all plant, labor, services,. materials and equip...
ment, all utilities and transportation, including p.awe:r., fuel and water,.
and performing all work necessary to construct and complete, in a good
and workmanlike manner, in strict accordance with the specificatrons,
plans and drawings therefor on file in the office of the: City-Clerk of
the Oi ty of Anaheim and the notice inviting sealed propo.sal.a,.. the pub-
lic works and improvement hereinabove more partioular~y mentioned and
described, together with the appurtenances thereto, be, and the same
is hereby, accepted, and that a contra.ct for the construction ,and Co,m-
pletion of said public improvement be,and.the same is hereby, awarded
to the said .above named bidder.
AND_BE IT FURTHERRESOLVEIl that thesuccessf'ulbidderorbidders
upon each contract. awarded as hereinab.gve se.t forth, shall b.e, and thet
are hereby required to execut.ea contract in. the required form with t.he
City of Anaheim upon the .terms and cOndit.ions specified in the notice
inviting sealed proposals and the proposal submitted by said success-
ful bidder or bidders and in accordance with the plans and specifica-
tions for said public improvement hereinabove described, and in accord-

and that said successful bidder or bidders to whom each contract is
awarded shall be required to furnish a surety bond in an amount equal
to one hundred per cent (100%) of the contract price for- all b.bor,
materials and equipment to be furnished and performed., as s.at forth
in the sealed proposal submitted by said bidder for the construction
of said public improvement, together with the appurtenances thar~to
or such portion thereof as is covered by said contract, as .8e-curity.
for the faithful performance of said contract and a separa~e surety
bond in an amount equal to one hundred per cent (100%) of the aon-
structi on cost of said public improvement covered by saidct3.ntract,
as security for the payment of all persons performing labor_and fur-
nishing material for said projecto
AND BE IT FURTHER RESOLVED that said sucCessful bidtier or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to tHe City of Anaheim,-.publlc. 1.i.a-
bility, property damage, compensation, and other insurancecin lhe:
amounts and for the purposes as set forth and specified in the notice
inviting sealed proposals, and subject to the approval of the City
Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the. City Clerk
